Justification and Approval for Other than Full and Open Competition – FAR Part 6

1. Contracting Activity: 120th Airlift Wing Mission Support Contracting

2. Description of Action: The Government is anticipating a single firm fixed price construction contract for this requirement

3. Description of Supplies/Services: This purchase is for the purchase and installation of 2 Installation and Warning System (INWS) Poles to include the construction of a foundation and electrical.

4. Authority Cited: 10 United States Code 3204(a)(1) as implemented in Federal Acquisition Regulation 6.302-1(a)(2)(iii)(A), Substantial duplication of cost to the Government that is not expected to be recovered through competition.

5. Reason for Authority Cited:

The 45' Monopoles were previously designed and constructed under a subcontract to a larger National Guard Bureau (NGB) parent contract that was canceled. Currently available equipment for this system (i.e. mounting brackets, speakers, hardware) is specifically compatible with the poles we are requesting to have purchased. Additionally geotechnical surveys were performed, and the poles were custom built based upon those surveys for their intended locations. 25% of the contract price was paid upfront to have the poles built to specification. The poles are unable to be used by another customer as were designed for specifications at this location.

6. Efforts to Obtain Competition: A pre-solicitation notice was posted to Sam.gov on March 02,2023 and as required by FAR 5.201 the solicitation will be published, and any bids or proposals received shall be considered.

a. Effective competition. There is not expected to be effective competition on this project as the poles have already been constructed and 25% of the purchase price has been paid.

b. Subcontracting competition. This project does not require a subcontracting plan and there will be very minimal subcontracting associated with this project.

7. Actions to Increase Competition: This is a single project and no further follow on actions are expected.

8. Market Research: The contractor who manufactured the poles Sabre, Communications Corp., and is currently is in possession of the poles is honoring the pricing of the poles that was established within the original contract to Microtechnologies LLC with the addition of a storage fees for the poles. Due to the inflation that has occurred since the initial purchase of the poles and the partial payment that has already occurred for these poles it has been determined that there would not be resulting cost savings from competition.

9. Interested Sources: To date, no other sources have written to express an interest.

10. Other Facts: Procurement history. A partial procurement of this requirement was done under a subcontract to contract FA8732-14-D-0021 awarded September 29, 2016, to Microtechnologies LLC, who subsequently subcontracted for the purchase of these poles to Sabre Communications LLC. Work for the Montana Air National Guard was being conducted in 2020. This contract was later terminated with our location being partially completed.
