About this file
This is a Sole Source Justification memorandum from the Washington Army National Guard's U.S. Property and Fiscal Office for Washington, dated February 12, 2026, with Control Number FY26-JA-003.
The procurement is for the movement, relocation, and re-installation of eight audiometric hearing booths and associated equipment at a total estimated cost of $20,145.00. The requirement includes disassembly, specialized handling, transportation, reassembly, calibration verification, and functional testing to ensure the booths meet operational and medical readiness standards. The contract will be awarded as a firm-fixed-price order. The sole source justification is based on FAR 6.302-1 (Only One Responsible Source), citing that e3 Diagnostics Occupational Health Solutions is the only qualified vendor capable of performing the specialized work due to the booths' manufacturer-specific assembly requirements, acoustic integrity needs, and exclusive manufacturing and configuration authority retained by the original equipment manufacturer. No alternative sources were identified as capable of meeting statutory, technical, and schedule requirements without risking structural damage, loss of acoustic integrity, or invalidation of calibration and certification standards. The interested vendor is e3 Diagnostics Occupational Health Solutions, located at 555 Andover Park West, 2nd Floor, Tukwila, WA 98188, with point of contact Dennis Allen at 425-877-9854 or deae@e3diagnostics.com. The justification was certified by MEDDET Training Officer Taylersue K. Jack on February 12, 2026, and approved by Contracting Officer Nicholas Parker.

| Text2: Sole-source award is justified under 10 U.S.C. § 3204(a)(1) and FAR 6.302-1 as only one responsible source can provide a Group 1/2 UAS compliant with FY24 NDAA restrictions, HQDA EXORD 272-25 authorization, and immediate mission timelines. Market research identified no alternative sources capable of meeting statutory, technical, and schedule requirement |
The proposed vendor is the original equipment manufacturer of the required UAS and retains exclusive manufacturing, integration, and configuration authority. The vendor does not authorize resellers or distributors, and no third party is authorized to produce, modify, or supply the system or its critical components. As a result, no other responsible source can legally or technically provide the required capability without violating intellectual property restrictions or introducing unacceptable performance, cybersecurity, and configuration-control risks.
The required capability is a Group 1/2 UAS system that supports unit-level training, experimentation, and capability development and complies with statutory and policy restrictions on covered foreign entities. The proposed system is the only commercially available solution that:
Meets statutory compliance requirements imposed by the FY24 NDAA (American Security Drone Act), including restrictions on covered foreign entities and cybersecurity risk.
Is authorized for procurement and operation under HQDA EXORD 272-25, which directs rapid fielding of low-cost UAS and delegates approval authority for training and experimentation.
Supports immediate operational need, with no other known vendors able to meet the technical, security, and delivery requirements within the required time frame.
Is non-developmental, COTS, and already demonstrated to meet mission requirements, eliminating schedule and performance risk associated with alternative sources.
Market research did not identify any other responsible sources capable of meeting the Government’s requirements without unacceptable delay, increased cost, or statutory non-compliance.
Awarding this requirement on a sole-source basis is necessary to meet mission timelines, comply with statutory and policy requirements, and avoid unacceptable operational and schedule risk.
