Performance Work Statement (PWS)
Performance Work Statement (PWS) For Hazardous Waste Disposal base plus four (4) option periods
SLTC
PART 1
General Information
SLTC seeks Hazardous Waste removal services with capacity to cover removal from OSHA’s Salt Lake Technical Center (SLTC).
Description of Services/Introduction:
The contractor shall provide all personnel, equipment, tools, materials, supervision, and other items and non-personal services necessary to Hazardous Waste disposal including shipping, packaging, labeling and disposal services for OSHA as defined in this Performance Work Statement, except as Specified in section C-3 as government furnished property and services. The contractor shall perform to the standards in this contract action.
Background:
OSHA’s Salt Lake Facility in Utah qualifies for a Very Small Quantity Generators (VSQG) status for hazardous waste. OSHA has purchased hazardous waste disposal services in the past by contract and by direct purchase when within purchase limits for these facilities.
The Hazardous Waste Disposal services will allow OSHA to dispose of hazardous materials The selected vendor(s) shall provide services to the OSHA SLTC.
Objectives:
Provide a Hazardous Waste Disposal at SLTC to dispose of hazardous waste requirements to include:
• Hazardous Waste checks against provided inventory or inventoried to ensure that all waste designated for removal is accounted for.
•All Hazardous Waste will be removed in a timely manner (30 days from request) to ensure that Very Small Quantity Generator (VSQG) status is secure.
•Ability to remove and dispose of hazardous waste from SLTC on an on-call basis •Ability to dispose of batteries and electronics.
•Ability to dispose of old escape respirators (KO2 for example) •Package and hazardous waste properly for shipment and disposal •Ensure proper chain of custody is met for removal and disposal of hazardous waste for analysis for legal purposes.
• Package and Ship the Dangerous Goods from the Salt Lake Technical Center (SLTC)
• Package and label the dangerous good properly for shipment
• Prepare the proper shipping papers for shipment of the dangerous goods
• Ensure proper chain of custody is met for shipments of dangerous goods for analysis for legal purposes.
Scope:
Provide the following services or equivalent 2-3 times per year at OSHA SLTC
Services include Transportation of Hazardous Waste Materials from VSQG to disposal sites Chemist Time and Services Manifest Fees State and Federal Hazardous Waste transportation and disposal fees.
Labpack Acid & Acid Compatibles for Incineration Labpack Basic & Basic Compatibles for Incineration Labpack Mercury Salts And Solutions For Incineration Labpack Organics for Incineration Labpack Required To Be Packaged Alone Per DOT Labpack Boxes various sizes packing and disposal services Polymer and metal drums of various sizes packing and disposal services Vermiculite and other sorbents Utilized and exhausted electrochemical Dragersonsors ™ Utilized and exhausted sealed oxygen sensors that contain lead and metal acetates Lithium-Ion Batteries Mercury containing bulbs D-List Waste removal P-List Waste removal U-List Waste removal Package and ship Dangerous Goods to include excepted quantities to regulated limits of the Dangerous Goods as prescribed the DOT and IATA for the material being shipped.

Period of Performance:
The period of performance shall be for one (1) Base Period of 12 months and four (4) 12-month option periods. The Period of Performance reads as follows:

The government reserves the right to extend the term of this contract action at the prices set forth in Section B in accordance with the terms and conditions contained in clause 52.217-9 entitled, “Option to Extend the Term of the Contract”.
General Information Quality Control:
The contractor shall develop and maintain an effective quality control program to ensure services are performed in accordance with this PWS. The contractor shall develop and implement procedures to identify, prevent, and ensure non-recurrence of defective services. The contractor’s quality control program is the means by which he assures himself that his work complies with the requirement of the contract. As a minimum, the contractor shall develop quality control procedures that address the areas identified in Technical Exhibit 1, “Performance Requirements Summary”. After acceptance of the quality control plan, the contractor shall receive the Contracting Officer’s acceptance in writing of any proposed change to his QC system.
Quality Assurance:
The government shall evaluate the contractor’s performance under this contract action in accordance with the Quality Assurance Surveillance Plan. This plan is primarily focused on what the government must do to ensure that the contractor has performed in accordance with the performance standards. It defines how the performance standards will be applied, the frequency of surveillance, and the minimum acceptable defect rate(s). Quality Control Plan is for waste to be removed within 60 days’ notice of identification of waste starting 60 days after contract award. For dangerous goods shipping the plan is for goods to be shipped within 5 days’ notice of identification starting 60 days after contract award.
Government Remedies:
The Contracting Officer shall follow FAR 52.212-4, “Contract Terms and Conditions-Commercial Items” or 52.246-4, “Inspection of Services-Fixed Price” for contractor’s failure to perform satisfactory services or failure to correct non-conforming services.
Recognized Holidays:
Contractor is not required to perform services on holidays.

Independence Day Hours of Operation:
The contractor is responsible for conducting performance between the hours of 8:00 AM - 4:30 PM MST. Monday thru Friday, except Federal holidays or when the government facility is closed due to local or national emergencies, administrative closings, or similar government directed facility closings. The contractor must at all times maintain an adequate work force for the uninterrupted performance of all tasks defined within this statement of work when the government facility is not closed for the above reasons. When hiring personnel, the contractor shall keep in mind that the stability and continuity of the work force are essential. Telecommuting or “work at home” is not authorized under this contract action unless under emergency situations as determined by the Contracting Officer’s Representative (COR).
Place of Performance:
The work to be performed under this contract action will be performed at OSHA’s Salt Lake Technical Center (SLTC).
Type of Contract:
The government anticipates award of a fixed price contract.
Security Requirements:
Not applicable
Physical Security.
The contractor shall be responsible for safeguarding all government property provided for contractor use. At the close of each work period, government facilities, equipment, and materials shall be secured.

N/A Conservation of Utilities.
The contractor shall instruct employees in utilities conservation practices. The contractor shall be responsible for operating under conditions that preclude the waste of utilities, which include turning off the water faucets or valves after using the required amount to accomplish cleaning vehicles and equipment.
Special Qualifications:
Contractors shall meet the requirements of DOT and IATA training and shall ensure the transporters of Dangerous Goods are qualified to ship Dangerous Goods and further ensure the transporters of Hazardous Waste are qualified to dispose of such following all guidance of the Environmental Protection Agency Post Award Conference/Periodic Progress Meetings:
The contractor agrees to attend any post award conference convened by the contracting activity or contract administration office in accordance with Federal Acquisition Regulation Subpart 42.5. The Contracting Officer, Contracting Officer’s Representative (COR), and other government personnel, as appropriate, may meet periodically with the contractor to review the contractor's performance. At these meetings, the Contracting Officer will apprise the contractor of how the government views the contractor's performance and the contractor will apprise the government of problems, if any, being experienced. Appropriate action shall be taken to resolve outstanding issues. These meetings shall be at no additional cost to the government.
Contracting Officer’s Representative:
A COR will be delegated separately.
Key Personnel:
The follow personnel are considered key personnel by the government: Contract Manager and Alternate, The Contract Manager and Alternate. The contractor shall provide a contract manager who shall be responsible for the performance of the work. The name of this person and an alternate who shall act for the contractor when the manager is absent shall be designated in writing to the Contracting Officer.
The contract manager or alternate shall have full authority to act for the contractor on all contract matters relating to daily operation of this contract action. The contract manager or alternate shall be available between 8:00 a.m. to 4:30p.m., Monday thru Friday except Federal holidays or when the government facility is closed for administrative reasons. Qualifications for all key personnel are listed below: Contract Manager and Alternate, The Contract Manager and Alternate must have familiarity of hazardous waste removal and documentation – following all regulations and guidance of the Environmental Protection Agency, and Department of Transportation (DOT) and are Certified to dispose of hazardous material and meet International Air Transportation Association (IATA) currently used to ship dangerous goods. Certified to ship dangerous goods and hazardous materials. A Field Chemist must be present to oversee the collections and packaging of hazardous waste for disposal.
Identification of Contractor Employees:
All contract personnel attending meetings, answering government telephones, and working in other situations where their contractor status is not obvious to third parties are required to identify themselves as such to avoid creating an impression in the minds of members of the public that they are government officials. They must also ensure that all documents or reports produced by contractors are suitably marked as contractor products or that contractor participation is appropriately disclosed. Contractor personnel may be required to obtain and wear badges in the performance of this service.
Organizational Conflict of Interest:
Contractor and subcontractor personnel performing work under this contract action may receive, have access to or participate in the development of proprietary or source selection information (e.g., cost or pricing information, budget information or analyses, specifications or work statements, etc.) or perform evaluation services which may create a current or subsequent Organizational Conflict of Interests (OCI), as defined in FAR Subpart 9.5. The contractor shall notify the Contracting Officer immediately whenever it becomes aware that such access or participation may result in any actual or potential OCI and shall promptly submit a plan to the Contracting Officer to avoid or mitigate any such OCI. The contractor’s mitigation plan will be determined to be acceptable solely at the discretion of the Contracting Officer and in the event the Contracting Officer unilaterally determines that any such OCI cannot be satisfactorily avoided or mitigated, the Contracting Officer may affect other remedies as he or she deems necessary, including prohibiting the contractor from participation in subsequent contracted requirements which may be affected by the OCI.
