STATEMENT OF WORK (SOW) FOR THE REPLACEMENT OF THE BUILDING HEATING, VENTILATION, AND AIR

CONDITIONING SYSTEM AT THE APPROVAL AND CERTIFICATION CENTER (A&CC)

PART 1

General Information The mission of the Mine Safety and Health Administration (MSHA) is to administer the provisions of the Federal Mine Safety and Health Act of 1977 (Mine Act), the Miner Act of 2006 and to enforce compliance with mandatory safety and health standards as a means to eliminate fatal accidents; to reduce the frequency and severity of nonfatal accidents; to minimize health hazards; and to promote improved safety and health conditions in the Nation’s mines.

As a regulatory organization, MSHA’s jurisdiction includes the Nation’s mining industry, which consists of coal, metal, and nonmetal mines, including both underground and surface operations.

Just as mining is essential to the American economy, a safe and healthy mining workforce is essential to the mining industry as a whole. The mining environment is inherently hazardous. Unseen geologic instabilities, constantly changing terrain, the prevalence of large and complex haulage and mining equipment are only a few of the factors that make maintaining mine safety a continuing challenge.

To meet this challenge and accomplish its mission of protecting the safety and health of the Nation’s miners, MSHA develops and enforces safety and health rules applying to all U.S. mines, fosters compliance, and makes available technical, educational, and other types of assistance. More specifically, MSHA conducts mine inspections; investigates mine accidents, fatalities, discrimination accusations, hazardous conditions complaints, and other potential violations; issues citations and collects financial penalties; develops improved safety and health standards and policies; evaluates and approves mine plans as well as some equipment and materials used in mines; provides mine emergency response capabilities; trains and certifies mine safety and health professionals; and develops and delivers education and training programs and materials.

MSHA’s Approval and Certification Center (A&CC), located in Triadelphia, West Virginia, consists of 96 acres of property and numerous buildings that house laboratories, offices, and storage. The A&CC approves and certifies certain mining products for use in underground coal and gassy underground metal mines. Technical experts evaluate and test equipment, instruments, and materials for compliance with Federal Regulations. Products evaluated and tested range from extremely small electronic devices to very large mining systems. Following successful completion of evaluation and testing of a product, a license is issued authorizing a manufacturer to produce and distribute products for use in mines. The MSHA approval issued by the Center is internationally recognized. The Center performs other technical functions in support of MSHA's programs, including investigations of safety and health concerns relating to product approvals; litigation assistance on issues involving approved products; accident investigation assistance when an explosion, fire, injury or fatality involves or may involve approved equipment; identification of the need for technical solutions to problems in application of mining equipment, materials, and explosives; technical assistance in developing new or revised Federal standards and regulations; and research assistance to other government agencies on research programs that directly relate to MSHA. The Center also provides engineering support and technical assistance in the area of industrial safety.

1.1. Description of Services/Introduction:

The contractor shall provide all personnel, equipment, tools, materials, supervision, and other items and non-personal services necessary to procure and install new replacement units for the Carrier (or equivalent) chiller. The contractor shall perform to the standards in this contract action.

1.2. Background:

The existing facility was built in 1980s. The building is 116,000 square feet serving as the A&CC for the Mine Safety and Health Administration. The existing HVAC Chiller system is original to the building and is in need of complete replacement.

The existing chiller system is inefficient and has reached a state of disrepair where the 2nd stage of the dual system no longer functions. The current system has been operating at half capacity due to ongoing compressor failures. Standard repairs are no longer a viable option for the current unit in place.

1.3. Objectives:

With this action A&CC is anticipating the replacement of the Building 1 Chiller. The unit has reached the end of life and any type of repairs would require a continuation of already costly efforts. This equipment has had several thousands of dollars spent on it and is now beyond economical repair. HVAC valves on the hot water and glycol systems will also need replaced. Preferably this work would/should occur in the fall or early summer.

1.4. Scope:

The contractor shall accomplish removal of the current chiller as dictated by EPA standards for refrigerant and industry standards, installation of new 150-ton Carrier (or equivalent) unit with connections to current infrastructure, and startup of new chiller to ensure proper installation.

1.5. Period of Performance:

Removal of the old chiller including shut down shall start not later than 5 days after delivery of the new unit at the job site. All services should be completed within 120 days after delivery of the new units.

1.6. General Information:

1.6.1. Quality Control:

The contractor shall develop and maintain an effective quality control program to ensure services are performed in accordance with this SOW. The contractor shall develop and implement procedures to identify, prevent, and ensure non-recurrence of defective services. The contractor’s quality control program is the means by which they assure themselves that the work complies with the requirement of the contract. The Quality Control Plan is to be delivered within 10 days after contract award.

1.6.2. Quality Assurance:

Center operations division personnel will supervise, observe contractor work, and resolve any issues during the execution of this contract.

1.6.3. Government Remedies:

The Contracting Officer shall follow FAR 52.212-4, “Contract Terms and Conditions-Commercial Items” for contractor’s failure to perform satisfactory services or failure to correct non-conforming services.

1.6.4. Recognized Holidays:

Recognized Holidays: The contractor shall not be required to perform any services on the recognized Federal holidays. These holidays include New Year’s Day, Martin Luther King Jr.’s Birthday, President’s Day, Memorial Day, Juneteenth Day, Independence Day, Labor Day, Columbus Day, Veteran’s Day, Thanksgiving Day, and Christmas Day. In the case of an emergency, administrative closings, or government-directed facility closings, the contractor must ensure the stability and continuity of the work force to maintain uninterrupted performance of all tasks as defined within the performance work statement.

1.6.5. Hours of Operation:

The contractor is responsible for conducting performance between the hours of 7:00 a.m. through 6:00 p.m., Monday through Friday, except Federal holidays or when the government facility is closed due to local or national emergencies, administrative closings, or similar government directed facility closings. The contractor must at all times maintain an adequate workforce for the uninterrupted performance of all tasks defined within this statement of work when the government facility is not closed for the above reasons. When hiring personnel, the contractor should keep in mind that the stability and continuity of the workforce are essential. Telecommuting or “work at home” is not authorized under this contract action unless under emergency situations as determined by the Contracting Officer’s Representative (COR).

1.6.6. Place of Performance:

The work to be performed under this action will be performed at 765 Technology Drive, Building 1, Triadelphia, WV 26059.

1.6.7. Safety: The following safety criteria must be met at the time of the acceptance inspection:

a. Equipment. The Contractor must provide all safety equipment/devices, personal protective equipment, and clothing as required for its employees.

b. Construction Safety plan required.

c. The Contractor shall provide all necessary, applicable safety equipment and ensure that such equipment and all relevant safety procedures are being followed for the job being performed and are utilized properly.

d. The Contractor shall comply with all applicable Federal, State and local legal requirements regarding workers health and safety.

The requirements include but are not limited to those found in Federal and State Occupational Safety and Health Act (OSHA) statutes and regulations, such as applicable provisions of Title 29, Code of Federal Regulations (CFR) Parts 1910 and 1926. Contractor is solely responsible for determining the legal requirements that apply to activities and shall ensure safe and healthy working conditions for its employees. Contractor shall comply with all applicable codes, laws, rules, regulations, and safety requirements. Erect safety barriers, signs, flagging, and devices as appropriate to warn and protect the workmen and the public. Protect the existing site and other property. Remove all demolished materials, debris, waste and scraps. The waste materials will be disposed of in accordance with the environmental guidelines and standards of West Virginia No construction materials to include packaging materials will be left on site.

e. The Contractor shall assume full responsibility and liability for compliance with all applicable regulations (to include but not limited to OSHA regulations as well as submitted and approved safety plan) pertaining to the health and safety of personnel during the execution of work. The Contractor shall hold the Government harmless for any action on its part or that of its employees or subcontractors, which results in illness or death.

f. The Contractor shall take all necessary precautions to prevent injury to the public, occupants, or damage to property of others.

The public and occupants includes all persons not employed by the Contractors, or Subcontractors. In the event of inclement weather, protections such as tarps or heavy gage construction plastic shall be used to cover the louver opening to prevent water infiltration into the building.

g. Corridors, aisles, stairways, doors and exit ways shall not be obstructed or used in a manner to encroach upon routes of ingress, or egress utilized by the public or occupants, or to present an unsafe or unhealthy condition to the public or occupants. All construction-related equipment, materials, debris, etc. should not affect any other area outside of the construction area.

h. The Contractor shall store, position, and use equipment, tools, materials, scraps, and trash in a manner that does not present a hazard to the public or occupants of the building. Wherever practical, the work area shall be barricaded or otherwise blocked off from the public or occupants to prevent unauthorized entry into the work area. Red “DO NOT ENTER” and/or yellow “CAUTION” tape shall be installed in work areas. All entrance/exit doors in construction area shall be identified as construction areas to prevent visitors from entering/exiting through the construction area.

i. Store and transport refuse and debris in a manner to prevent unsafe and unhealthy conditions for the public and occupants.

Cover refuse containers and remove refuse on a frequent regular basis acceptable to the Contracting Officer. Use tarpaulins or other means to prevent loose transported materials from dropping from trucks. Dispose of all waste, demolition materials, etc., and recycle all to the extent possible. Report all items recycled to the Contracting Officer, and COR.

j. Hazardous waste disposal Abatement - In order to provide for abatement and control of all environmentally hazardous materials arising from demolition and/or construction activities, the Construction Contractor shall comply with all applicable environmentally hazardous material control and abatement and all applicable provisions of the Corps of Engineers Manual EM 385-1-1, "General Safety Requirements as well as the specific requirements stated elsewhere in the Contract Documents. 1.6.7. Type of Contract:

The government anticipates award of a firm-fixed-price contract.

1.6.8. Security Requirements:

Contractor shall adhere to all MSHA security policies during the performance of this requirement.

1.6.8.1. Physical Security.

The contractor shall be responsible for safeguarding all government property provided for contractor use. At the close of each work period, government facilities, equipment, and materials shall be secured.

1.6.8.2. Conservation of Utilities.

The contractor shall instruct employees in utilities conservation practices. The contractor shall be responsible for operating under conditions that preclude the waste of utilities, which include turning off the water faucets or valves after using the required amount to accomplish cleaning vehicles and equipment.

1.6.9. Special Qualifications:

All contractors should possess a valid HVAC technician certification for the state of WV meaning at least 2,000 hours of HVAC-related work, training, and experience and is licensed to install, maintain, test, and repair both residential and non-residential heating, ventilating, and cooling systems.

At minimum, two experience references that demonstrate a minimum of 5 years of experience within the last 5 years performing removal and replacement of a new 150-ton chiller (or equal).

The contractor performing the work will be required to provide proof of West Virginia HVAC Master state licenses and chiller trained service certificates (Or equivalent) to conduct this replacement with quote submission.

The contractor must be able to provide evidence they can provide an equivalent chiller, air handling units, and variable air volume boxes within 6 months after receipt of order.

1.6.10. Post Award Conference:

The contractor agrees to attend any post award conference convened by the contracting activity or contract administration office in accordance with Federal Acquisition Regulation Subpart 42.5. The Contracting Officer, Contracting Officer’s Representative (COR), and other government personnel, as appropriate, may meet periodically with the contractor to review the contractor's performance. At these meetings, the Contracting Officer will appraise the contractor of how the government views the contractor's performance and the contractor will appraise the government of problems, if any, being experienced. Appropriate action should be taken to resolve outstanding issues. These meetings shall be at no additional cost to the government.

1.6.11. Contracting Officer’s Representative (COR):

A COR will be designated separately.

1.6.12. Key Personnel:

The following personnel are considered key personnel by the government: Contract Manager or Alternate contract manager. The contractor shall provide a contract manager who shall be responsible for the performance of the work. The name of this person and an alternate who shall act for the contractor when the manager is absent shall be designated in writing to the Contracting Officer. The contract manager or alternate shall have full authority to act for the contractor on all contract matters relating to daily operation of this contract action. The contract manager or alternate shall be available between 7:00 a.m. to 4:00 p.m., Monday through Friday, except for Federal holidays or when the government facility is closed for administrative reasons. Qualifications for all key personnel are listed below

1.6.13. Identification of Contractor Employees:

All contract personnel attending meetings, answering government telephones, and working in other situations where their contractor status is not obvious to third parties are required to identify themselves as such to avoid creating an impression in the minds of members of the public that they are government officials. They must also ensure that all documents or reports produced by contractors are suitably marked as contractor products or that contractor participation is appropriately disclosed. Contractor personnel must sign in/out with the guard in the guardhouse or receptionist in Building 1 on a daily basis and will be required to obtain and wear badges in the performance of this service.

1.6.14. Phase In Period

To minimize any decreases in productivity and to prevent possible negative impacts on additional services, the contractor shall have personnel on board during the thirty (30) day phase in period. During the phase in period, the contractor shall become familiar with performance requirements in order to commence full performance of services on the contract action start date.

3.1 General:

The government will provide the facilities, equipment, materials, and/or services listed.

3.2 Utilities:

The government will provide all utilities in the facility for the contractor’s use in performance of tasks outlined in this SOW. The contractor shall instruct employees in utilities conservation practices. The contractor shall be responsible for operating under conditions that preclude the waste of utilities, which include turning off the water faucets or valves after using the required amount to accomplish cleaning vehicles and equipment.

3.3 Facilities:

Onsite. The government will furnish all necessary workspace required for the contractor to support the effort(s) outlined in this SOW.

Except for those items specifically stated to be government furnished in Part 3, the contractor shall furnish all other items required to perform the services in this SOW.

Unless otherwise approved by the COR as part of the Contractor’s recycling plan, the Contractor shall remove all packing material, debris, and cartons from the job site daily.

All construction material and debris, including the Air Handling Unit, must be hauled off of the campus and disposed of properly following all federal, state, and local rules and regulations.

The Contractor is required to provide a dumpster for disposal of recyclables, trash, and packing materials from the installation site.

No recyclables, trash, or packing materials shall be disposed of or discarded in facility-owned recycling or trash containers or dumpsters.

• Remove existing Carrier Chiller and dispose of according to EPA guidelines.

• Set new, warranted 150-ton Carrier Chiller or equivalent.

• Chiller unit shall consist of two equally divided circuits i.e. 75/tons each

• Each circuit needs to be capable of running independently of the other circuit

• Each coil needs to have an E-coating applied by dipping before installation of the coils during the manufacturing of the unit. This coating needs to be impervious to harsh environmental conditions like acid rain

• Reinsulate new chiller piping/valves

• Recharge system with legacy glycol and add new as needed

(d) Comptroller General Examination of Record.
