DETERMINATION OF EXCEPTIONAL CIRCUMSTANCES
ACKNOWLEDGEMENT FORM
A Determination of Exceptional Circumstances to incorporate HHSAR Clauses 352.227- 11 and HHSAR 352.227-14 has been approved for use by the NINDS for this acquisition. The edited HHSAR Clauses at 352.227-11, Patent Rights-Exceptional Circumstances and 352.227-14, Rights in Data – Exceptional Circumstances, which are included in full text in Article I.4. of the uniform contract schedule of this RFP, will be made a part of any resultant contract(s) under this solicitation. As such, any prospective offeror, must certify and agree that to be considered for award and if selected for award a contract that they do accept and will abide by the terms and conditions of these clauses.
The undersigned hereby acknowledges understanding of and intent to comply with the terms and conditions of HHSAR Clause 352.227-11, Patent Rights-Exceptional Circumstances (Sept. 2014) and HHSAR Clause 352.227-14, Rights in Data- Exceptional Circumstances (Sept. 2014).
