About this file
This is a Single Source Determination and Findings (J&A) document for a simplified acquisition threshold contract issued by the Bureau of Indian Education's A23 Acquisition Office for Wingate High School.
The requirement is for Educational Services & Professional Development (Purchase Request 44049996) with a period of performance from August 1, 2026 through July 31, 2029, plus two optional years. WestEd (UEI: WNCAQMKJ7WZ9), located at 730 Harrison Street, San Francisco, CA 94107, is identified as the single source to be solicited. The services involve continuing professional development for Wingate High School, including maintaining and updating curriculum documents, enhancing lesson planning to meet district expectations, developing Professional Learning Communities aligned with standards, and ongoing leadership development with team members. The contracting officer determined that only one source is reasonably available based on WestEd's highly specialized supply and service capabilities with unique qualifications and technological/specific training requirements. Market research through RFQs confirmed WestEd as the only vendor capable of meeting the requirement due to proprietary, copyright-protected curriculum and exclusive delivery model. The originating office attestation was signed by Gloria Arviso (Principal, Wingate High School) on July 20, 2026, and the contracting officer certification was signed by Charmaine Williams-James on July 16, 2026.

| Text12: West Ed has provided ongoing collaborative services for the last eight (08) years. Work from the current year helps to develop goals and outcomes for the upcoming year. Relationships, progress, and goals have been established based on historical work with WHS. |
Initial work began with an assessment of WHS' skills around instruction. Progress is evaluated annually to determine next steps. This work has supported the OnePlan (CNA and School Improvement), PLCs, supporting instruction, supporting administration and their efforts to support teacher. Additionally, this year will focus on supporting the leadership teams to enhance climate and culture within the school, based on work with current leadership team and staff input.
WestED are unique in that they integrate culturally responsive practices, data-driven instructional strategies, and hands-on coaching tailored to our staff’s skill levels and our students’ learning needs. This combination is embedded in their proprietary training framework, which is not available through other vendors.
Engaging a different provider would result in loss of continuity, require significant time for orientation to our context, and disrupt the progress made through the ongoing multi-year professional development plan. Empower Services is the only vendor capable of delivering the specific, customized training necessary to sustain and advance our instructional improvement efforts.
There was solicitation posted in 2022 for several actions to capture other vendors but based on the materials being generated specifically for each services being requested, other vendors could not provide those materials and WestEd did not want to sell their materials to them, so WestEd submitted a quote and was awarded those contracts. Prior awards made to other schools for similar services to this vendor as sole source for the past two years.
Text13: Efforts were made to solicit offers from as many potential sources as practicable. Market research conducted through RFQ 140A2324Q0172 and RFQ 140A2325Q0014 confirmed that WestEd is the only vendor capable of meeting the requirement due to its proprietary, copyright protected curriculum and exclusive delivery model. Prior awards (PO 140A2325P0435 and PO 140A2325P0436) were also issued to WestEd on a sole source basis for the same reason, as WestEd does not authorize other vendors to distribute or quote its curriculum materials, which limits competition.
A Notice of Intent to Sole Source will be publicized in accordance with FAR Part 5. Following the public notice period, a purchase order will be awarded to WestEd in accordance with applicable regulations.
