About this file
This document is a Justification and Approval for Other Than Full and Open Competition for simplified acquisitions over $3,000 for Lake Mead National Recreation Area (LAKE). The procurement involves installing a law enforcement package (lights, graphics, radios) on 3 GSA leased vehicles and removing upfit equipment from 1 GSA vehicle, with a quoted price of $113,179.26. McIntosh Communication has been the sole bidder for the past 4 years, with 11 previous contracts totaling over $576,000 for vehicle upfit services for three desert parks.
Market research was conducted across multiple counties in California and Nevada, but no alternative vendors were found with automotive upfit capabilities within a 100-mile radius of Boulder City, NV. The justification highlights that McIntosh offers reasonable proximity, has consistently performed previous contracts, and addresses quality control issues experienced with alternative providers like Unicor. The document notes that AbilityOne did not respond to inquiries, and Unicor was not considered a viable service provider due to transportation and logistical challenges. The procurement is not a local area set-aside, and the vendor is considered a small business with multiple NAICS codes.

1. Nature and/or description of the item/service being procured and its intended use (include the anticipated cost.
This procurement is to have a law enforcement package (lights, graphics, radios, etc.) installed on 3 GSA leased vehicles for LAKE, as well as the removal of installed upfit equipment on 1 GSA vehicles ready to be returned from lease. The park is in possession of vehicles and ready to transport to the installation facility. The quoted price is $113,179.26
2. Sole Source Justification rationale (Check one and explain below):
__X__ Only one responsible source.
Explain:
Mcintosh communication has been the sole bidder for the past 4 years with contracts totaling over $576K.
They are in Las Vegas NV with reasonable access to facility. Previous service orders for vehicle upfit through Unicor requires more day labor to shuttle vehicles to the nearest Unicor Facility and longer delivery times with modifications to extend the delivery date. Increasingly, QC issues have come up in past contracts with Unicor. The added distance results in added time for NPS staff, and travel costs and offers no additional benefit. There have been 11 contracts for law enforcement vehicle up fit services to
McInstosh over the past 5 year for the big three desert parks (MOJA, LAKE, DEVA).

This would not be a local area set aside, rather contracting and LAKE have determined that transporting vehicles long distances is not cost effective and adds risk as the final inspection process by a COR would not be reasonable if the vehicle is more than 100-miles away. Therefore, small businesses that can meet the NPS driving requirements are determined to be capable. This is a niche business and large cities that support municipal, state and federal law enforcement tend to have capable upfit companies over remote areas. Las Vegas is the nearest large city to lAKE that offers this service. Historically, no other business in Las Vegas has quoted upfit requirements for the NPS.
3. Market Research. Please explain the results or why one was not performed. State whether any other offers were received or anyone expressed interest:
AbilityOne and Unicor were surveyed for vehicle upfit services. AbilityOne has not responded to LE
Upfit inquiries in the past few years and Unicor, though they offer the service, has not been a viable source for this routine service in the southwest, remote, USA. See A21_Unicor Waiver Memo. Unicor does not offer vehicle transportation (pickup/delivery) as part of the upfit service. This requires NPS staff to drive excessive distances for a single purpose or contract separately for vehicle transport. Unicor does not subcontract to independent transport companies.
Historically, LAKE (and other desert park) required the above contracts to have installation facilities within 100 miles to reduce the burden on park staff delivering and pickup vehicles. A 100-mile radius map from Boulder City, NV is below:
SBDS was conducted within San Bernadino County, CA; Riverside County, CA; Inyo County, CA; Nye
County, NV; Clark County, NV; and Mohave County, AZ.
- No results for Inyo County, CA;
- 10 results for Riverside County, CA. However, none of the companies had capabilities statements that included automotive upfit work. Most of these companies were outside the 100-mile radius.
- 5 results for San Bernadino County, CA. However, none of the companies had capabilities statements that included automotive upfit work. All these companies were outside the 100-mile radius.
- 4 results for Clark County, NV. However, none of the companies had capabilities statements that included automotive upfit work.
- No results for Nye County, NV.
- No Results for Mohave, AZ.
McIntosh was not included in the SBA list for Clark County due to only one NAICS on record for the company (423690). SAM.gov lists many other NAICS for the vendor, as a small business, including
811210 Electronic and Precision Equipment Repair and Maintenance. See market research report.
4. If this is a determination for sole source, the contracting officer certifies:
a. Only one source is available, or urgent and compelling circumstances exist.

b. The anticipated price will be determined fair and reasonable using the price analysis techniques described in FAR Part 13.106-3(a).
