About this file
This is a Justification & Approval for Other Than Full and Open Competition document for a simplified acquisition for the federal government. The procurement request (PR Number: 44034511) dated January 30, 2026, seeks an annual service agreement with Ixom Water Care for maintenance of a Trihalomethanes removal system located at Katherine Landing, Arizona. The service contract is fully encompassing and covers service, inspection, tuning, and repair of the Ixom system, requiring one service visit per year with option years to extend the contract up to five years total.
The justification for sole source procurement is based on Ixom being the sole provider and manufacturer of the system, the only authorized party to work on or repair it, and the only entity available to offer service with warranty coverage. Market research determined that while another company offers a similar treatment system, it is not interchangeable with Ixom's system and does not service other brands. The government notes that new water treatment technology is currently in design for the Katherine Landing facility, and once implemented, it will transition to open market competition for future services and supplies. The acquisition was signed by Arthur V. Samons, Project Officer, on February 10, 2026, and approved by Contracting Officer Bradley Metler on the same date. The document references two previous sole source contracts awarded to Ixom (140P8124PP0036 and 140P8125P0002) over the past year for the same system.

JUSTIFICATION & APPROVAL FOR OTHER THAN FULL AND OPEN COMPETITION
for SIMPLIFIED ACQUISITIONS OVER THE MICROPURCHASE THRESHOLD (See FAR
Part 2) UP TO SAT (See FAR 13.106-1)
Date: 1/30/2026 PR Number: 44034511
1. Nature and/or description of the item/service being procured and its intended use (include the anticipated cost):
The scope of work is for the annual service agreement with Ixom Water Care, for the total Trihalomethanes removal system at Katherine Landing, AZ. This service contract is fully encompassing, it covers service, inspection, tuning and repair of the Ixom system at KL. The contract requires 1 service visit per year and includes option years to extend service to up to 5 years total.
2. Sole Source Justification rationale (Check one and explain below):
___X___ Only one responsible source.
______ Urgent and compelling circumstances exist. Include critical delivery or performance dates, and when you became aware of the requirement. Provide a specific statement of the impact on Government operations, financial or otherwise, if the required delivery or performance dates are not met.
______ Other _____________________________________________________
Explain: Ixom is the sole provider and manufacturer of this system. They are the only party authorized to work on or repair this system. Additionally, they are the only entity available to offer this service and provide warranty of their system. LAKE MABO has awarded 2 sole source contracts to IXOM for this system over the past year (140P8124PP0036, 140P8125P0002)
3. Market Research. Please explain the results or why one was not performed. State whether any other offers were received or anyone expressed interest:
Extensive internet searching shows that Ixom is the sole party that offers a service contract for their system. I was able to find another company that has a similar system but they do not interchange with Ixom. They do not offer service for any other brands. New treatment technology is in design at this time for KL water treatment facility. We are treating the current water with 25 year old treatment technology.
We are unable to meet the max contaminant levels for ever emerging contaminants that we are seeing.
Once this new treatment is designed and implemented we will be able to move away from these small bandaid fixes and go open market for services and supplies.
4. If this is a determination for sole source, the Contracting Officer certifies:
a. Only one source is available, or urgent and compelling circumstances exist.
b. The anticipated price will be determined fair and reasonable using the price analysis techniques described in FAR Part 13.106-3(a).
