About this file

This is a Justification & Approval document for a sole source acquisition under the simplified acquisition threshold authority. The National Park Service (NPS) is procuring fiber optic construction work from Lewis County Public Utility District (PUD) to connect existing PUD-owned fiber infrastructure to existing NPS-owned fiber at the park boundary at two locations. The estimated contract value is $16,000.00, with a purchase request number of 0044039363 dated February 19, 2026.

The justification for sole source award is based on the determination that only one responsible source is available. PUD is the sole entity that owns, operates, and maintains the fiber infrastructure at the designated meet points, and all construction, splicing, and integration work on PUD-owned facilities must be performed by PUD personnel or contractors under its direct control. Market research confirmed that no alternative vendors could legally or technically perform the required work, as access to the infrastructure is restricted to the utility and any alternative contractor would still require PUD authorization and involvement. The contracting officer certified that the anticipated price will be determined fair and reasonable using price analysis techniques, and the acquisition was approved by Casey Hicks (Telecom Specialist, MORA) on February 25, 2026, and by Contracting Officer Hal Hoversten (OLYM MABO) on March 6, 2026.

JUSTIFICATION & APPROVAL FOR OTHER THAN FULL AND OPEN COMPETITION

for SIMPLIFIED ACQUISITIONS OVER $15,000 AND UP TO $350,000.00 (OVER $2,000 for Construction, $2,500 for Services) (See FAR 13.106-1)

Date: 19 February 2026 Purchase Request: 0044039363

1. Nature and/or description of the item/service being procured and its intended use (include the anticipated cost):

Fiber optic construction work required to connect existing PUD-owned fiber to existing NPS-owned fiber at the park boundary at two locations for the purpose of gaining future access to broadband internet service providers through PUD's fiber network. Cost is estimated to be $16,000.00.

2. Sole Source Justification rationale (Check one and explain below):

10 U.S.C. 2304(c) and FAR 6.302-1, Only one responsible source and no other supplies or services will satisfy agency requirements.

Urgent and compelling circumstances exist. Include critical delivery or performance dates and when you became aware of the requirement. Provide a specific statement of the impact on Government operations, financial or otherwise, if the required delivery or performance date are not met.

Other:

Explain:

Lewis County Public Utility District (PUD) is the sole entity that owns, operates, and maintains the fiber infrastructure at the designated meet points required for this project. All construction, splicing, and integration work on PUD-owned facilities must be performed by PUD personnel or contractors under its control. No other vendor can legally or technically perform the required work because access to the infrastructure is restricted to the utility. Attempting to compete this requirement would result in unacceptable delays and duplication of cost, as any alternative contractor would still require PUD authorization and involvement. Therefore, award to PUD is necessary to meet the government’s operational need for reliable broadband connectivity.

3. Market Research.

Market research was conducted to determine whether alternative sources could perform the required fiber interconnection. The requiring activity reviewed regional fiber contractors to assess potential options. These efforts confirmed that interconnection at the specified meet points requires work on PUD-owned infrastructure, and PUD mandates that all construction be performed by its personnel or authorized contractors. No other sources were identified that could legally or technically execute the work. This supports the determination that only one responsible source is available for this requirement.

4. If this is a determination for sole source, the contracting officer certifies:

a. Only one source is available or urgent and compelling circumstances exist.

b. The anticipated price will be determined fair and reasonable using the price analysis techniques described in FAR Part 13.106-3(a).
