The J&A authorizes a sole source award to Firetrucks Unlimited under FAR Part 13 to expedite the critical repairs and return the fire engine to service as soon as possible.

Explain:
This is an urgent and compelling requirement due to the importance of the Fire Engine in need of repairs.
The engine is park’s sole structure fire engine must be returned to service as soon as practical as the park will not be able to adequately respond to a fire emergency without it. This engine provides structure protection to hundreds of historic, residential, and government Facilities. Currently the next closest engine to the park is over 45 miles away. The engine being out of service poses a large risk to the Government, the park, and the lives of park staff and visitors.___________________________________
Firetrucks Unlimited has performed an inspection of the engine and is mobilized and ready to start the needed repairs. This company is registered in SAM.gov under UEI NS2AP9298KM9.________________
3. Market Research. Please explain the results or why one was not performed. State whether any other offers were received or anyone expressed interest:
Due to the urgent nature of the requirement, these repairs and the remote local of Death Valley National Park a limited number of potential vendors could be identified, Firetrucks unlimited (large business) and Fairview Valley Fire (Small business). A search by the NAICS 811114 was performed through they SBA Dynamic Search tool for each surrounding county and only returned 1 small business that can perform the work, Fairview Valley Fire. Fair View Valley Fire Inc is a municipal fire station and will not prioritize repairs of firetrucks that aren’t their own so the company is not viable for the urgent repairs required.
Under normal circumstances, a small-business set aside would be considered, but with the urgent nature of this requirement, an urgent and compelling sole source to Firetrucks Unlimited is in the best interest of the Government by ensuring that a working Fire truck immediately available to use in the event of an

PRICE and/or COST REASONABLE MEMORANDUM Sole Source Procurement

(1) PURPOSE OF THIS MEMORANDUM: Price and/or Cost Analysis in compliance with Department of the Interior – Acquisition, Assistance, and Asset Policy – 0024, Enhancing Competition, and NPS-AP&P 1443.06-01.
Per DOI- AAAP-0024, “For any acquisition where only one offer was received (including competitive awards and planned non-competitive awards, set-asides, awards against single-award indefinite delivery vehicles, etc.), the Contracting Officer shall ensure that thorough and detailed price and/or cost analysis is documented in writing in the contract file. At a minimum, this analysis must include comparison of the offered price to market pricing. Comparison to an Independent Government Estimate is not adequate as the sole basis for determining that the price is fair and reasonable.”
Per NPS-AA&P, 1443.06-01, “For any acquisition where only one offer/quote was received, the contracting officers must maintain adequate documentation to comply with the requirements in DOI-AAAP-0024 and ensure inclusion of that documentation in the contract file. This documentation shall be made available to the Acquisition Policy Branch, Washington Contracting Office upon request.”
(2) DESCRIPTION: Death Valley National Preserve needs urgent and compelling repairs to the park’s only Structural Fire Engine.

The three contracts, above, are for repairs to similar trucks. The offeror’s $14,359.28 price is 4.5% lower than the lowest award, above. The offeror’s $14,359.28 quote is within this range of previous pricing found to be fair and reasonable.
(5) DETERMINATION:
In consideration of the above price or cost analysis, and in accordance with Federal Acquisition Regulation 15.4 or 13.106-3, as applicable, Fire Trucks Unlimited. proposed price in the amount of $14,359.28 is determined to be fair and reasonable.
