About this file

This document is a Justification & Approval for Other Than Full and Open Competition for a sole source refuse collection contract for the National Park Service's Golden Gate National Recreation Area. The contract will be awarded to Bay Cities Refuse Service for weekly and on-call trash collection services at multiple locations including Marin Headlands housing, non-housing units, Fort Baker, and Pier locations. The service will cover various container types and sizes, including 2-yard and 30-yard containers for trash, green waste, recycling, and compost, with service frequencies ranging from seasonal to weekly.

The contract is structured as a base year with four option years, totaling $243,039.32 over the entire contract period. The base year runs from 7/1/2025 to 6/30/2026 with an initial value of $78,631.05. The sole source justification is based on an existing franchise agreement with Marin County, which prevents competitive bidding. Market research conducted on 05/19/2025 confirmed no viable alternative providers, with only two identified businesses being investment companies unsuitable for county-wide trash removal services. The contract is set to be awarded under FAR 6.302-1 for sole source procurement.

2. Sole Source Justification rationale (Check one and explain below):

___X___ Only one responsible source.

______ Urgent and compelling circumstances exist. Include critical delivery or performance dates, and when you became aware of the requirement. Provide a specific statement of the impact on Government operations, financial or otherwise, if the required delivery or performance dates are not met.

______ Other _____________________________________________________

Explain:

Due to the existing franchise agreement with the county for refuse collection services, this is classified as a sole source procurement under FAR 6.302-1. The current amendment to the Consolidated County Franchise Agreement for Solid Waste Collection and Removal between the County of Marin and Bay Cities Refuse Service Inc, which was amended in 2018 and is set to terminate on June 30, 2028.

Additionally, Bay Cities Refuse's area of operation is outlined in their Southern Main Franchise Area No.

1, covering Marin Headlands and Fort Baker under their agreement with the county. The franchise agreement is between Marin County, pursuant to Section 40059 of the California Public Resources Code, and Chapter 7 of the Marin County code, the board of Supervisors may enter into agreements providing for exclusive franchise in certain areas within the unincorporated area of the county. In addition, the Franchise agreement outlines terms and conditions as well as pricing and Franchise area of service.

3. Market Research. Please explain the results or why one was not performed. State whether any other offers were received, or anyone expressed interest:

Market Research was conducted by the Contract Specialist on 05/19/2025. The CS search SBA Dynamic Small Business under NAICS 562111, for California in Marin County. The search resulted in two businesses RG Environmental Holdings Inc, and Cooper Cornerstone Holdings LLC, both of which are investment companies not capable of operating at such a magnitude for county trash removal. Capability statements and narratives are geared towards construction waste and hazmat removal services. The Franchise agreement has been established since 1993 and has multiple amendments which these Franchise agreements prevent any competition as these companies are mobilized and already established in each area for refuse services.

b. The anticipated price will be determined fair and reasonable using the price analysis techniques described in FAR Part 13.106-3(a).
