About this file

This document is a justification for a sole source contract award. It details an urgent need for Copper Mountain Services to perform emergency leak detection of a portable water line and repair of a sewer main line for Death Valley National Park. Within the past week, heavy rains from Hurricane Hillary caused approximately 50 feet of the Stovepipe Wells sewer line to wash out, disconnecting it from the main gravity feed system to the lagoons. The Cow Creek water system is also experiencing a major leak estimated at 40,000 gallons per day. Without urgent action, there is risk of loss of potable water to housing and hazards to human health. Brief market research identified Copper Mountain Services as the only local contractor with immediate response capability for these types of utility repairs. The contracting officer determined the $20,000 anticipated price from Copper Mountain Services was fair and reasonable based on price analysis techniques in the FAR. The related opportunity on the federal contract website seeks these urgent sewer and water services on a limited sole source basis from the Department of the Interior National Park Service Pacific West Region.

1. Nature and/or description of the item/service being procured and its intended use (include the anticipated cost):

Emergency Cow Creek flood damage leak detection of portable water line in wash & SPW sewer main repair. Anticipated cost is $20K

2. Sole Source Justification rationale (Check one and explain below):

______ Only one responsible source.

___X___ Urgent and compelling circumstances exist. Include critical delivery or performance dates, and when you became aware of the requirement. Provide a specific statement of the impact on

Government operations, financial or otherwise, if the required delivery or performance dates are not met.

______ Other _____________________________________________________

Explain: The DEVA Stovepipe Wells (SPW) sewer system was inundated with flood waters from the remanence of Hurricane Hillary. The main sewer line was washed out leaving approximately 50 feet of line laying in the wash thereby disconnecting it from the main gravity feed to the lagoon system. The

Cow Creek water system is experiencing a major leak in which 40,000 gallons per day (GPD) of portable water is leaking from the water system. The leak(s) are not easily found and leak detection is needed to determine where the leaks are located to perform repairs to reduce potable water loss.

Without urgent action, the park is at eminent risk of losing potable water to the housing area, which would pose a hazard to human health. The SPW gravity sewer line will need to be repaired to prevent further damage to the park natural resources and prevent hazards to human health. The risk is heightened as time passes for several reasons:

- Cow Creek potable water is currently flowing into the ground at an unknown location. The leak can introduce contaminants into the potable water system that are hazardous to human health.

Not to mention, the health and safety concern for structure fire suppression in the community. If the community should have a structure fire there would not be the prerequisite amount or flow necessary to adequately fight a structure fire.

- The Stovepipe Wells gravity sewer system is flowing onto the open ground violating several regulatory laws of the State of California. This too is a hazard to the environment and human health.

- The sewage system is also critical for the production of potable water for the Stovepipe Wells water system due to the fact that the water plant is a reverse-osmosis type system. The water plant produce approximately 2 gallons of sewage for every gallon of treated water that is produced.

Given the nature of the needed work with both the Stovepipe Wells community sewer collection system and the Cow Creek Water system, the park could very likely suffer catastrophic consequences if this service is not urgently completed before the next series of storms.

3. Market Research. Please explain the results or why one was not performed. State whether any other offers were received, or anyone expressed interest:

Brief market research was performed by performing searches on the SBA Dynamic Small Business

Search engine, reviewing past contracts for emergency services to park utility systems, and identifying contractors who regularly work both in the park and in other communities of the California and Nevada.

One firm, Copper Mountain Services and the market research conclusion recommended a Sole Source contract with Copper Mountain Services. CMS has the capacity to complete the work of the SOW. No other firms were identified who are local and have immediate response capability. The CO has determined that it is appropriate to award to Copper Mountain Services as a sole source purchase order or credit card purchase.

4. If this is a determination for sole source, the contracting officer certifies:

a. One source is available and an urgent and compelling circumstance exists.

b. The anticipated price, $20,000 is determined fair and reasonable using the price analysis techniques described in FAR Part 13.106-3(a).
