WEST_DEVA_EMERGENCY WATER REPAIR AT SPW Federal contract opportunity
Solicitation number

Issued by
Department of the Interior National Park Service Pacific West Region

About this file

This document is a Justification and Approval for Other Than Full and Open Competition (JOFOC) for a simplified acquisition of construction services to repair an 8-inch potable water main in Death Valley National Park. The contractor, Copper Mountain Services, was the only source reasonably available to perform the urgent and compelling repair work immediately, as there was a 100,000 gallon per day water loss and a public health risk. The contracting officer verbally awarded the contract, with an estimated price of $15,000, to be determined fair and reasonable. The National Park Service's Pacific West Region is the federal agency involved.

JUSTFICATION AND APPROVAL FOR OTHER THAN FULL AND OPEN COMPETITION

for SIMPLIFIED ACQUISITIONS OVER $3,000 ($2,000/$2500 for Construction/Services AND UP

TO $150,000

(See FAR 13.106-1)

Date: 21-AUG-2024 PR Number: TBD

1. Nature and/or description of the item/service being procured and its intended use (include the anticipated cost):

Construction services to excavate and repair an 8-inch potable water main. Contractor’s estimate is $15,000

2. Sole Source Justification rationale (Check one and explain below):

X Urgent and compelling circumstances exist

On Wednesday, August 21 at 1600 hours, a water main break occurred at Stovepipe Wells in Death Valley National Park. The 8-inch water main feeds the Stovepipe Wells Village and surrounding area, effecting 30+ employees and seasonal staff. As of 1700 hours, the break is experiencing approximately a 100,000 gallons per day (GPD) water loss. Attempts to repair the leak have been wholly unsuccessful as Park Staff are on leave and understaffed. Should the leak go unrepaired, a continued loss of treated water at the leak site will ensure, which correlates to wasted treatment chemicals, energy, and labor. Since the source water to the public will be under pressurized, a boil water advisory will be issued and additional monitoring for public health will be taken. The chances of a waterborne illness can increase and this poses an immediate danger to the public. Per FAR 13.106-1(b), the CO believes it is in the best interest of the government to sole source because there was one source reasonable available to perform the work immediately. DEVA is a remote location and it would have taken 3 hours to one day for other businesses to mobilize onsite. The contractor was working at DEVA and was immediately available to make the necessary repairs.

3. Market Research.

As an urgent and compelling public health situation, market research was not performed. Copper Mountain Services is a contractor that was onsite at Death Valley, and was able to immediately mobilize to assist in begin emergency repairs.Per FAR

4. If this is a determination for sole source, the contracting officer certifies:

a. Only one source is available, or urgent and compelling circumstances exist.

b. The anticipated price will be determined fair and reasonable using the price analysis techniques described in FAR Part 13.106-3(a).
