About this file
Summary
This is a Contracting Officer (CO) Determination and Findings (D&F) document justifying a single-source award for emergency repair of a broken domestic water line. The requirement involves immediate on-site assessment, excavation and exposure of the damaged line, removal and replacement of failed sections of domestic water piping, and testing, backfilling, surface restoration, and documentation. The acquisition is justified under FAR 6.302-2 (Unusual and Compelling Urgency) because delay would result in continued water service interruption, potential facility closures, sanitation concerns, and increased repair costs due to escalating system damage. The government determined that normal competitive procedures could not be followed within the required timeframe.
The contract will be awarded as a firm-fixed-price (FFP) agreement to a qualified small business contractor that demonstrated immediate mobilization capability, proximity to the facility enabling same-day response, and past performance in plumbing and utility repair. Funding is available in the amount of $49,125.00, with a quoted price determined to be fair and reasonable. The period of performance is immediate mobilization with estimated completion of part one within one week (dependent on site conditions and right-of-way permit requirements), and total project completion within 30 days. The CO verified the contractor's SAM.gov compliance and confirmed technical competence, licensing, and bonding capability via phone. The D&F was certified and approved on June 5, 2026, and a Justification & Approval will be prepared and posted in accordance with FAR 6.305.

CO Determination and Findings to Single Source Based on Urgency
Broken Domestic Water Line Repair
(IAW FAR Parts 6, 7, 10, 11, 13, and 19 as applicable)
1. Background and Requirement The requiring activity has identified a broken domestic water line that is currently disrupting essential facility operations. The failure presents an immediate risk to health, safety, and mission readiness. Immediate repair is required to restore potable water service, maintain safe occupancy conditions, and prevent further infrastructure damage.
2. Urgency and Impact if Not Awarded Immediately Delay in repairing the damaged water line will result in continued water service interruption, potential facility closures, sanitation concerns, and increased repair costs due to escalating system damage.
Under FAR 6.302-2, unusual and compelling urgency exists because:
• The Government would be seriously injured if the repair is delayed.
• The requirement cannot be met through normal competition timelines.
3. Acquisition Planning (FAR Part 7) Given the emergency nature of the repair, the acquisition strategy prioritizes rapid execution, minimal administrative burden, and ensuring contractor capability. A streamlined procurement approach consistent with urgent and compelling circumstances is required. All planning considerations emphasize restoring water service as quickly as practicable.
4. Market Research (FAR Part 10) Due to the urgent circumstances, market research was limited but adequate to ascertain the availability of qualified small business firms capable of performing the repair immediately. The requiring activity identified a known small business with:
• Demonstrated past performance in plumbing and utility repair,
• Immediate mobilization capability, and
• Proximity to the facility, enabling same-day response.
Expanded competition is not feasible without jeopardizing mission continuity and health/safety conditions.
5. Exception to Full and Open Competition (FAR Part 6) This action will proceed as a single-source award under FAR 6.302-2, Unusual and Compelling Urgency, which permits limiting sources when:
CO Determination and Findings to Single Source Based on Urgency
• The Government does not have the time to follow full competitive procedures, and
• Delay would result in unacceptable harm.
A Justification & Approval (J&A) will be prepared and posted in accordance with FAR 6.305, with redactions as applicable.
6. Small Business Considerations (FAR Part 19) The selected contractor is a small business, and the action aligns with the Small Business Act’s preference for maximizing small business participation. Under emergency conditions, a direct award to a qualified small business is appropriate and compliant with FAR 19.502-2(b), given the contractor’s known technical capability and immediate availability.
7. Contract Type (FAR Part 16) A firm-fixed-price (FFP) contract will be used to ensure cost control and to streamline award. The nature of the repair lends itself to a well-defined requirement once on-site evaluation occurs, and the FFP structure is suitable for straightforward construction/repair tasks.
8. Requirements Definition (FAR Part 11) The scope of work will include:
• Emergency on-site assessment,
• Excavation and exposure of damaged line,
• Removal and replacement of failed sections of domestic water piping,
• Testing, backfilling, surface restoration, and documentation.
SOW was created by the program and clearly describe the performance outcomes required, consistent with urgency and minimum necessary requirements.
9. Funding and Period of Performance Funding is available totaling $49,125.00 and properly certified by budget folks within program. The quoted price is determined to be fair and reasonable
. The anticipated period of performance is immediate mobilization with completion as soon as practicable, estimated completion for part 1 is one week depending on site conditions and if right of way permit is needed. Total POP for all stages of this project is for 30 days.
11. Determination of Contractor Responsibility (FAR Part 9) The identified small business contractor has been verified in SAM.gov as active and compliant. CO confirmed with vendor orally over phone that they have the technical competence, licensing, and bonding capability.
