About this file
This is a Single Source Justification form (FWS Form 3-0034) from the U.S. Fish and Wildlife Service's Joint Administrative Operations Acquisitions Operations division. The form is used to justify sole source acquisitions below the Simplified Acquisition Threshold (SAT) when only one source is reasonably available due to circumstances like urgency, exclusive licensing agreements, brand name requirements, or industrial mobilization.
The blank template form includes sections for Description of Need, Market Research Conducted, Other Capable Sources, Barriers to Competition, Contractor's Qualifications, Determination of Fair and Reasonable Cost, and requires certifications from both the Program/Project Officer and Contracting Officer. This particular form is specifically designed for purchases under the SAT threshold and must be completely filled out with no blank sections permitted when used. The form supports compliance with FAR subpart 13.106-1(b)(1)(i) and (ii) requirements for sole source justification documentation.

| Text3: There are several other Daikin authorized service providers in southeast Michigan, but they only service residential units, not systems like our Visitor Center. We have worked with several local HVAC companies, and they couldn’t resolve more complex issues and we had to call ThermalNectics to fix the problem these companies couldn’t. It ended up costing us more to work with two contractors instead of one. ThermalNetics, a Member of the Daikin Group, is the authorized Daikin Representative for our area (southeast Michigan) and they helped design our HVAC system and worked closely with the company that programed the computer that operates the HVAC system and several other systems. ThermalNetics is also the company that performed the start-up of the system and understands how the system is designed and supposed to operate. | |
| Text2: No market research to be done because the existing unit that has failed needs to be replaced by a Daikin unit. This unit is not a stand alone unit. The unit that failed works in conjunction with the other Daikin units that serve this portion of the building. Only a Daikin unit can replace the failed Daikin unit. Another manufacturer would not be able to be connected to the remaining Daikin units, so they function together as a complete system to heat and cool this portion of the 13,000 square foot building. In addition, this unit also has to be connected to and programmed into the building's existing automation control system. This requires Thermometrics to do the tie in and programing of the new unit, so this unit works in conjunction with the other existing units and controls that currently regulate the heating, cooling and air exchanges for the building. No other company has the knowledge of how the controls were originally programed and also how to program the replacement unit to tie it into the existing system. | |
| Text1: There is an urgency to replace this unit ASAP. At this time a year the nighttime temperatures drop below freezing and there is always a possibly that the building could be subject to damage due to the nighttime and sometime daytime below freezing temperatures. We are in the beginning of the winter season in Detroit and the nighttime temperatures will continue to drop as time progresses possibly into the single digits so the sooner the unit can be replaced the less likely the building will suffer from damage. The Visitor Center cost approximately $11 million to construct and it is imperative that the HVAC system operates efficiently and effectively to prolong the lifespan of all equipment and the building itself. Plus, it is critical to ensure staff and visitors are comfortable when working or visiting the building. | |
| Text4: These units need to be serviced by trained, authorized factory service representatives to function properly. Allowing HVAC professionals not trained on Daikin units put us at risk of severe damage to the equipment leading to higher maintenance costs and possibly even catastrophic failure resulting in total unit replacement. | |
| Text6: The offer given by ThermalNectics, is found fair and reasonable, based on urgent and compelling need, previous work done on this system by the supplier and that this is a custom system that requires the OEM to do any replacement and repairs. | |
