FAR PART 13
Purchase Orders Over $10,000 but not Exceeding $250,000
Acquisitions that do not allow for competition to the maximum extent practicable must be documented in accordance with Federal Acquisition Regulations (FAR). A Limited Sources Justification is required when soliciting fewer than three sources per FAR 13.104, or when using brand name descriptions per FAR 13.106-1(b)(1). A Limited Sources Justification is not required for brand name or equal procurements. Follow procedures at FAR PART 11.104.

Brief description of supplies or services required and the intended use:
DEA/EPIC requires plumbing (water and sewer) to support the (3) portable Forensic LARCs which are missions essential to DEA/EPIC mission. This task must be completed without delay to ensure Forensics has the services to perform analysis at EPIC, in the new portables LARCs.
Summary of the facts and circumstances that support the determination that only one source is reasonably available to supply the required supplies or services, or only the specified brand-name items can satisfy the Government’s need:
This plumbing, situated on the east side of the EPIC building will be utilized for the three forensic LARCs. Avila’s Plumbing & Construction has successfully completed several plumbing (water & sewer projects at EPIC in a timely manner with outstanding deliverables and without encountering any issues. This plumbing company has already been vetted by Fort Bliss Military Installation and EPIC to perform work at the building. The cost estimate provided by Avila's Plumbing & Construction encompasses all materials, labor, installation, and appropriate environmental disposal. All Federal Law Agencies across the United States will rely on the mission of EPIC’s LARCs regarding drug trafficking operations, among other matters. This is why it is critical for this project to receive approval to install the plumbing (water and sewer) that supports the Forensics, which supports the DEA/EPIC’s mission.
Describe in detail any market research conducted. EPIC did not conduct market research because of the urgency associated with this project which directly supports DEA mission. Avila's Plumbing & Construction has supplied EPIC with a detailed cost estimate for the installation of plumbing (water and sewer) to support the (3) Forensic LARCs, which is to be executed in a timely manner. Conducting any further market research would adversely impact a mission critical requirement and lead to additional costs and possibly prolong an already urgent and essential procurement process. Procurement issued a notice of intent via SAM.gov; all interested parties who believe are capable of meeting the requirements were invited to submit a response describing their ability to provide the product/service.
The Contracting Officer hereby determines that, due to the circumstances of this procurement:
Only one source is deemed to be reasonably available.
Only the specified brand-name item will satisfy the Government’s need. For orders exceeding $25,000, this Limited Source Justification shall be made available together with the solicitation and posted on the Contract Opportunities page on the Governmentwide Point of Entry (SAM.gov) in accordance with FAR 5.101(a)(1).
The Contracting Officer certifies that an order for the supplies or services will not be placed unless the price is found to be fair and reasonable.
