FAR PART 13
Purchase Orders Over $10,000 but not Exceeding $250,000
Acquisitions that do not allow for competition to the maximum extent practicable must be documented in accordance with Federal Acquisition Regulations (FAR). A Limited Sources Justification is required when soliciting fewer than three sources per FAR 13.104, or when using brand name descriptions per FAR 13.106-1(b)(1). A Limited Sources Justification is not required for brand name or equal procurements. Follow procedures at FAR PART 11.104.

Brief description of supplies or services required and the intended use:
Replacement of batteries and preventative maintenance for six uninterruptible power supply (UPS) units that service multiple instruments throughout the laboratory. All UPS are overdue for service for between 1 and 8 years. Failing to appropriately service and maintain the UPS could lead to leakages of the lead-acid batteries causing hazards in the workplace and damage to the units and laboratory facility. Additionally failure to maintain the UPS could lead to failures and costly replacement of the units resulting in work stoppages.
Summary of the facts and circumstances that support the determination that only one source is reasonably available to supply the required supplies or services, or only the specified brand-name items can satisfy the Government’s need:
Due to the sensitive and technical nature of the UPS as well as the specific parts and expertise needed for the service AMETEK Powervar in partnership with Hytec must be used. The parts needed can only be obtained from the Original Equipment Manufacturer (OEM) thus it is required that the OEM, in this case AMETEK Powervar in partnership with Hytec, be used for the maintenance of the UPS. Additionally, AMETEK Powervar partners with Hytec to provide service technicians that possess the expertise and knowledge to service the units without damaging the instruments the UPS are attached to or resulting in injuries to the technicians. If services are provided from parties that are not in partnership with the OEM the AMETEK Powervar warranties on the UPS can be considered invalidated.

When it was determined that the UPS were overdue for battery replacement and maintenance, the chemists reached out to AMETEK Powervar to request assistance in receiving service. After consulting AMETEK Powervar in partnership with Hytec, quotes were received and AMETEK Powervar in partnership with Hytec provided a Sole-Source Letter recommending that AMETEK Powervar in partnership with Hytec services the instruments. Not only is AMETEK Powervar in partnership with Hytec ISO certified they are also the sole source for factory-recommended replacement parts and appropriately trained personnel for the UPS needing repair.
The Contracting Officer hereby determines that, due to the circumstances of this procurement:
Only one source is deemed to be reasonably available.
Only the specified brand-name item will satisfy the Government’s need. For orders exceeding $25,000, this Limited Source Justification shall be made available together with the solicitation and posted on the Contract Opportunities page on the Governmentwide Point of Entry (SAM.gov) in accordance with FAR 5.101(a)(1).
The Contracting Officer certifies that an order for the supplies or services will not be placed unless the price is found to be fair and reasonable.
