About this file

This document is a Sole Source Documentation form for a federal contract opportunity. The Department of Justice Drug Enforcement Administration intends to award a sole source purchase order to BBNH Enterprises, Inc. for full-scale, off-site food services for SBC students and cadre at Fort Walker from May 20, 2025 to June 6, 2025. The justification for sole source selection is based on BBNH's existing security clearance for the facility, the lack of nearby restaurants, and absence of cooking or refrigeration facilities at the barracks. The contract is not a recurring requirement, and other vendors were considered but did not meet the security clearance requirements. The document follows FAR Part 13 guidelines for purchase orders over $10,000 but not exceeding $250,000.

A Limited Sources Justification is not required for brand name or equal procurements. Follow procedures at FAR PART 11.104.

Type of action: X sole source acquisition brand-name

DAC Number: D-25-OD-0022 Estimated total mount: Recurring Requirement: YES NO

Delivery Date: Period of Performance: 5/20/25 – 6/6/25

Brief description of supplies or services required and the intended use:

Full scale, off-site, food services for SBC students and cadre.

Summary of the facts and circumstances that support the determination that only one source is reasonably available to supply the required supplies or services, or only the specified brand-name items can satisfy the Government’s need:

BBNH Enterprises, Inc. already is in place and provides services at Ft Walker. BBNH currently has a security clearance for the company and its employees to work at Fort Walker. There are no restaurants within reasonable commuting distance to the barracks/training areas, nor are there cooking or refrigeration for store purchased food within the barracks facilities.

Describe in detail any market research conducted. Include results and state whether any vendors expressed interest:

Other quotes were obtained and provided to DEA; however, the vendors do not have a security clearance for the company and its employees to work at Fort Walker.

The Contracting Officer hereby determines that, due to the circumstances of this procurement:

Only one source is deemed to be reasonably available.

Only the specified brand-name item will satisfy the Government’s need. For orders exceeding $25,000, this Limited Source Justification shall be made available together with the solicitation and posted on the Contract Opportunities page on the Governmentwide Point of Entry (SAM.gov) in accordance with FAR 5.101(a)(1).

The Contracting Officer certifies that an order for the supplies or services will not be placed unless the price is found to be fair and reasonable.
