About this file
This document is a Justification for Brand Name Products for a federal contract opportunity. The National Park Service (NPS) is soliciting for wastewater treatment equipment replacement and equipment rebuild parts. The justification approves limiting competition to specific brand name products that are essential to the government's requirements and cannot be met by other manufacturers' products.
The required products include Deming pump impellers and mechanical seals, Air-O-Lator aeration mixers, and a JWCE headworks grinder. These items are needed to repair and maintain critical wastewater treatment equipment at the Saint Mary Wastewater Treatment Plant. The justification cites the unique qualifications of the brand name products and the potential harm to the government if improper replacement parts are used. The government conducted market research and determined these parts are only available from the original manufacturers. The justification concludes that the costs will be fair and reasonable.

Justification for Brand Name Products
Date: 07/09/2024
Project: GLAC SMWWTP Equipment Replacement - Sludge and Drain Pump Rebuild Parts
1. Identifications
a. Agency: National Park Service
b. Contracting Office: NR Major Acquisition Buying Office
2. Description of the action being approved:
The National Park Service (NPS) shall be soliciting for wastewater treatment equipment replacement and equipment rebuild parts. The documents included with the solicitation call for specific brand name products that are peculiar to one manufacturer. This written justification provides approval for limiting competition to the listed brand name products as authorized by the Federal Acquisition Regulations (FAR).
3. Description of supplies and services:
Item# 2.1 Two Sets each:
Deming pump IMPELLER: IMP,RH, 7-5/16DIA and Mechanical Seal: SEAL,MECH,1.25,D-1,BF2C1 Deming pump IMPELLER: IMP,RH,9-1/2DIA Mechanical Seal: SEAL,MECH,1.75,D-1,BF2C1
Item# 3.1 & 3.2 One each:
Air-O-Lator Inter-mixDD IM50-170 Aeration Mixer Air-O-Lator Mixer Guide Rail Mast Assembly
Item# 4.1 One:
JWCE Muffin Monster Open-channel grinder 300005-24
4. Authority:
a. 41 U.S.C. 253(c)(1): Only one responsible source and no other supplies or services will satisfy agency requirements.
b. FAR Part 11.105: The Brand Name products are essential to the Government’s requirements, and market research indicates other companies’ similar products do not meet and cannot be modified to meet the agency’s needs.
c. FAR 6.302-1: The use of the name brand products are essential to the Government’s requirements, thereby precluding consideration of a product manufactured by another company.
5. The description of the product’s unique qualifications or the unique nature of the acquisition:
Only the impellers and mechanical seals listed will fit and allow proper operation of the existing Deming pumps installed at the Saint Mary Wastewater Treatment Plant. These pumps are extremely expensive and time intensive to replace.
Rebuilding them in place with new impellers and mechanical seals provided from the original pump manufacturer (Deming, a part of Crane Pumps) will renew the life expectancy of these pumps. These wastewater pumps are critical to the proper operation of the Saint Mary Wastewater Treatment Plant. Without proper rebuild parts these pumps will soon

Contracting Operations Central fail. The Saint Mary Wastewater Treatment Plant has existing Air-O-Lator aeration mixers installed and the replacement mixer needs to match existing controls and mountings as well as ease of operation and maintenance with all needed parts being the same. The Saint Mary Wastewater Treatment Plant also has an existing JWCE headworks grinder that is a part of a larger JWCE non-organic trash removal system at the plant. The new grinder must be from the same manufacturer and be an exact replacement for the existing grinder so that it will work with the existing controls and the overall JWCE non-organic trash removal system. The failure of any of this equipment, or the installation of improper parts or equipment can cause damage to the treatment plant and cause interruption in the treatment of approximately 75,000 gallons of wastewater per day and cause major disruption to Park visitors, concessions operations and Park housing in two large developed areas within Glacier National Park. The disruption in treatment of the wastewater would violate Federal and State regulations as well as the treatment requirements stipulated in the National Pollutant Dischage Elimination System (NPDES) permit no. MTX000171 for the Saint Mary Wastewater Treatment Plant.
6. Efforts to obtain competition:
d. Efforts to ensure offers are solicited from as many potential sources as is practicable:
For acquisitions over $25,000 the solicitation will be issued on the Government’s Point of Entry, sam.gov.
e. Presolicitation notice per FAR 5.2:
For acquisitions over $25,000 a presolicitation notice shall be posted on the Government’s Point of Entry, sam.gov unless the exception noted at FAR Part 5.202(a)(13) applies.
7. Determination that costs will be fair & reasonable:
The Government will ensure that the parts are in-line with the prices already available as evidenced in market research.
8. Description of the market research conducted:
Research has been conducted on market pricing for the repair parts. It was determined that these parts are not commonly available from other sources as these are custom made for the original pump manufacturer (Deming of Crane Pumps).
9. Other facts supporting other than full & open competition:
f. Reason why documents suitable for full & open competition have not been developed:
The manufacturer of the pump is the only source for these custom impellers and seals for their proprietary pumps.
g. Data, estimated costs or other rationale as to the extent or harm to the Government:
The complete replacement of these items would be cost prohibitive to the government. The life expectancy of these pumps, if repaired, is comparable to new pumps.
10. Interested Sources:
Deming pumps, Crane Pumps.
11. Actions to remove barriers to competition in the future for similar acquisitions:
While the parts are only available from the manufacturers, interested vendors can obtain these parts from the source.
The pumps will be replaced during the next life cycle renewal.
12. Certifications:
Technical / Requirements Certification:
I certify that any supporting data that is the responsibility of technical or requirements personnel (i.e. verifying the
Government’s minimum needs or schedule requirements or other rationale for other than full and open competition) and which form a basis for the justification have been certified as complete and accurate:
