About this file
This document is a Brand Name Justification for the purchase of two replacement radiators and a commercial boiler for the GRCA Community Building. The radiators required are specific Oswald Supply models (MR625X20 and MR625X30) that were approved by the Park Historic Architect based on material and style. The boiler required is the Lochinvar Knight XL Commercial Boiler (model KBX1000) which meets unique needs such as altitude requirements, fuel type, and efficiency. Market research confirmed these are the only products that can meet the government's needs and that there are multiple potential suppliers that can provide the items competitively. The justification outlines the authority for the brand name requirement, efforts to obtain competition, and determination that pricing will be fair and reasonable. The related federal contract opportunity is for the GRCA Community Building Boiler & Radiators, solicitation number 140P1525Q0001, issued by the Department of the Interior National Park Service Intermountain Region.

4. Authority:
a. 41 U.S.C. 253(c)(1): Only one responsible source and no other supplies or services will satisfy agency requirements.
b. FAR Part 11.105: The Brand Name products are essential to the Government’s requirements, and market research indicates other companies’ similar products do not meet and cannot be modified to meet the agency’s needs.
c. FAR 6.302-1: The use of the name brand products are essential to the Government’s requirements, thereby precluding consideration of a product manufactured by another company.
5. The description of the product’s unique qualifications or the unique nature of the acquisition:
As described above, through Market Research, experience, and discussion with industry representatives who sell the type of required boiler, the Park identified the Lochinvar Knight XL Commercial Boiler (model number KBX1000) as meeting the specific needs of the acquisition. Several particular unique features of this model include the altitude requirements, fuel type, and efficiency. Further details of the unit’s capabilities are shown in the specification information. However, as stated, if a like in kind unit can achieve the same results, it could be considered technically acceptable. The radiators must also be as stated above or of like kind to meet approval by the NPS Historic Architect.
6. Efforts to obtain competition:
a. Efforts to ensure offers are solicited from as many potential sources as is practicable:
For acquisitions over $25,000 the solicitation will be issued on the Government’s Point of Entry, SAM.gov.
b. Presolicitation notice per FAR 5.2:
For acquisitions over $25,000 a presolicitation notice shall be posted on the Government’s Point of Entry, SAM.gov unless the exception noted at FAR Part 5.202(a)(13) applies.
7. Determination that costs will be fair & reasonable:
The Government will determine fair and reasonable pricing through a competitive process; vendors will be able to compete equally on SAM.gov to supply the products. All vendor’s bids will be evaluated using the same evaluation criteria and the specifications inherent in the Lochinvar KBX model for the boiler and the identified radiators.
8. Description of the market research conducted:
Market Research was committed to looking into similar products available from different manufacturers, such as Keystone, Bryan, Burnham, and Weil-McLain. Most other options and previous similar purchases across NPS were found not to meet the combination of needs for altitude, programmability, fuel type, robust BTU, and installation in the existing GRCA community building space. The Lochinvar commercial boiler unit described above was determined as the best-known fit for the current situation and could be installed, along with the replacement radiators, by GRCA personnel as part of the building’s heating system rebuild. Market Research did confirm that the boiler model manufactured by Lochinvar and the identified radiators could be obtained through various suppliers, allowing for competitive price and delivery offers.
9. Other facts supporting other than full & open competition:
a. Reason why documents suitable for full & open competition have not been developed:
As stated above, other boiler brands researched and previously purchased do not readily meet the altitude, fuel type, sensors and programmable capabilities, high BTU, and configuration to install into the existing GRCA community building space. Radiators must be approved by GRCA's Historic Architect.
b. Data, estimated costs or other rationale as to the extent or harm to the Government:
If this brand product is not acquired or a comparable product offered that meets the same specifications and GRCA personnel installation abilities, the government will not be able to adequately make the necessary upgrades to the community building within the time and funding expected. This will affect all users of the building and possibly cause damage during the winter months without a heated space.
10. Interested Sources:
Previous purchases across NPS/DOI have been made for a variety of boilers, including Lochinvar models. Typically, those procurements included installation services and/or units needing to match other existing equipment. As the boiler and the radiators for this requirement are commercially available items, there are numerous potential commercial suppliers that can provide the requested Knight XL Commercial Boiler model under the Lochinvar brand name, as well as the approved radiators.
11. Actions to remove barriers to competition in the future for similar acquisitions:
Competition can be achieved in the supply source for this immediate requirement. For future competition, the Government can continue seeking sources that can meet the necessary specifications, provided such units are commercially available and can handle the Government’s unique needs which differ across thousands of NPS locations nationwide within varying existing and sometimes historic structures.
12. Certifications:
Technical / Requirements Certification:
I certify that any supporting data that is the responsibility of technical or requirements personnel (i.e. verifying the Government’s minimum needs or schedule requirements or other rationale for other than full and open competition) and which form a basis for the justification have been certified as complete and accurate:
