Project Hazardous Waste Removal, Transport, Treatment and Disposal Services

General Information

1.0 Scope of Work

The Food Safety and Inspection Service (FSIS) is the public health agency in the U.S. Department of Agriculture responsible for ensuring that the nation's commercial supply of meat, poultry, and egg products is safe, wholesome, and correctly labeled and packaged. The FSIS Midwestern Lab (ML) is located at 7654 Natural Bridge Road, Saint Louis, MO 63121. The Eastern Laboratory (EL) is located in Russell Research Center at 950 College Station Rd, Athens, GA 30605. ML and EL, are regulatory laboratories and analyze meat, poultry and egg products to ensure that they are free of adulteration. As a result of laboratory operations, FSIS generates hazardous waste as defined in Subtitle C of the Resource Conservation and Recovery Act (RCRA). This waste includes, but is not limited to those waste streams identified in Section 2, Background below. ML, EL, and WL are classified as Small Quantity Generators and produce relatively small volumes of hazardous waste. Combined, the labs have approximately nine shipments per year, and occasionally generate unusual wastes that are seldom, if ever, repeated. Occasionally, all labs dispose of Drug Enforcement Administration (DEA)-regulated pharmaceutical waste.

ML, EL, and WL are seeking a contract for:

· Environmental Consulting Services

· Materials and Waste Recycling and Disposal Services

· Training

· Emergency Response

Contract services are for hazardous waste transportation, sampling, analytical services, off-site treatment, storage and disposal as well as training for annual RCRA Refresher training: DOT shipping and packaging training; and emergency response for chemical spills.

Contract type: requesting an IDIQ (Indefinite Delivery-Indefinite Quantity) with a base with 4 one-year options.

For the goods or services under this contract, an authorized Cardholder will place a call via e-mail for the required goods or services authorized under this contract within their single purchase limit and then the Contractor shall provide cardholder invoice(s) for payment.

For those individual invoices under $2,500 for services or $10,000 for goods, an authorized Government Purchase Cardholder will process those invoices.

If any invoice shall happen to go over the $2,500 for services or $10,000 for goods, a Warranted Contracting Officer with a Government Purchase Card will be authorized to process those invoices under this Contract via an issued Task Order.

This entire contract will be paid using the Government Purchase Card.

The guaranteed minimum amount for this contact is $5000. The maximum aggregate value of the orders that can be placed under this contract is $300,000.

2.0 Background

As Small Quantity Generators, all laboratories produce relatively small volumes of waste, make approximately nine shipments per year, and occasionally generate unusual wastes that are seldom, if ever, repeated. Occasionally, they all dispose of DEA-regulated pharmaceutical waste. A list of current waste streams follows.

a. ML: Mixed Laboratory Solvents, DOT Description: RQ, UN 1992, Waste Flammable Liquids, Toxic, N.O.S., 3 (6.1), PG II, (Acetonitrile, Chloroform), (D022, F002), ERG #131. RCRA Codes: U003, U123, U154, F002, F003, F005, D001, D022. Shipped in a closed-top 30 gallon metal drum. Approximately one drum is generated every two months.

b. WL: Mixed Laboratory Solvents, DOT Description: RQ, UN 1992, Waste Flammable Liquids, Toxic, N.O.S., 3 (6.1), PG II, (Acetonitrile, Chloroform), (D022, F002), ERG #131. RCRA Codes: U003, U123, U154, F002, F003, F005, D001, D022. Shipped in a closed-top 30 gallon metal drum. Approximately one drum is generated every two months.

c. EL: Non-Chlorinated Solvents, DOT Description: RQ, UN1993, Waste Flammable Liquids, N.O.S., 3, PGII, (Xylene, Hexane, Ethanol), (D001, F003), ERG#128. RCRA Codes: F003, F005, D001. Shipped in a closed-top 55 gallon metal drum. Approximately one drum is generated every four months.

d. EL: Hormones (HRM) Waste, DOT Description: RQ, UN1993, Waste Flammable Liquids, N.O.S., 3, PGII, (Acetonitrile, Methanol), (D001, D002), ERG#128. RCRA Codes: D001, D002. Shipped in a closed-top 15 or 30 gallon fiber drum. Approximately one drum generated every eight-nine months.

e. EL: Mobile Phase A and B, DOT Description: RQ, UN1993, Waste Flammable Liquids, N.O.S., PGII, (Acetonitrile, Water), (D001), ERG#128. Shipped in a closed-top 15 or 30 gallon fiber drum. Approximately one drum is generated every eight-nine months.

f. EL: Metals Waste, DOT Description: RQ, UN2922, Waste Corrosive Liquids, Toxic, N.O.S., 8(6.1), PGII, (Sulfuric Acid, Arsenic), (D004, D011), ERG#154. Shipped in a closed-top 15 or 30 gallon fiber drum. Approximately one drum is generated every eight-nine months.

g. All Labs: Lab Packs incinerated.

h. All Labs: Drugs suspended in formic acid. Containers are 1 ml glass or plastic autosampler vials. Usually shipped in a closed-top 15 or 30 gallon fiber drum. Approximately one drum is generated every two months from each lab.

i. All Labs: Veterinary Drugs (antibiotics, hormones, sedatives) or environmental contaminates (per and polyfluoroalkyl substances –PFAS) suspended in methanol or acetonitrile. Containers are 1 mL glass or plastic autosampler vials. Usually shipped in a closed-top 15 or 30 gallon fiber drum. Approximately one drum is generated every two months from ML. Possible DOT descriptions:

i. RQ, UN1993, Waste Flammable Liquids, N. O. S, 3, PG II, (Methanol), (D001, F003), ERG#128.

ii. RQ, UN2930, Waste, Corrosive Liquids, N. O. S., 8(3), PG III, (Formic Acid, Methanol), ERG#123.

j. ML and WL: Consolidation of small chemical containers. Amount and type of shipping container varies.

k. ML and WL: Remaining solutions in Illumina’s MiSeqv2 Reagent tray (used in whole genome sequencing) 300 cycles-PE. The Illumina MiSeqv2 Reagent trays are plastic cartridges containing 1 to 2 mL formamide waste solution with additional residual liquids remaining that also contain 2-3% formamide. These cartridges have been shipped in a waste drum that also includes buffer solutions with ethanol. DOT Description: UN2924, Flammable liquids, corrosive, N. O. S., 3(8), PG II, (Formaldehyde, Ethanol), ERG #132.

l. Unbroken 4’ and 8’ fluorescent light bulbs.

m. Lead acid batteries.

n. Mercury devices (Universal Waste).

o. Broken fluorescent bulbs.

p. Mercury debris.

q. Asbestos contaminated material.

r. Waste oil and wipes contaminated with solvents.

Contractor Requirements

3.0 Technical Requirements / Tasks

a. The Contractor shall furnish all trained and experienced personnel, tools, equipment, materials, supplies, services, and documents specified and the expertise necessary to prepare, remove, transport, treat, recycle, or dispose of hazardous waste (as applicable). The Contractor shall be responsible for classifying, inventorying, packaging, labeling, marking, loading, transporting, storing, treating, and disposing of hazardous waste. The Contractor shall abide by the Federal, state, and local regulations pertaining to the management of hazardous waste in all states in which the waste is generated, transported, stored, and treated, recycled or disposed.

All work performed by the Contractor shall comply with all applicable Federal, State and local laws and regulations, including, but not limited to, those promulgated under

b. The Contractor shall maintain all permits, licenses, and other forms of documentation and certification required for compliance with such laws and regulations.

c. Only treatment, storage, and disposal facilities (TSDF’s), recycling facilities, and transportation companies that have been pre-approved in writing by the Contracting Officer’s Technical Representative (COTR) may be used to complete the requirements of this contract.

d. In the event the Contractor, its subcontractors, or any transporter or disposal facility used by the Contractor should become noncompliant with respect to any Federal, state, or local environmental or safety and health law or regulation, the Contractor shall not be relieved of the terms and conditions of this contract, nor of its responsibilities and liabilities under the contract. The Contractor shall immediately notify the COTR in writing specifying the nature and extent of the regulatory violation(s). The Contractor shall be solely responsible to the extent of the law for all monetary citations as a result of non-compliance with applicable laws and regulations once the hazardous waste is under the Contractor’s control.

e. The Contractor shall assign an employee as a primary point of contact for overall coordination of the services to be provided under this contract. Telephonic, facsimile, electronic mail, or written communication from FSIS shall be responded to by the Contractor with 24 business hours. In the event the primary contact is temporarily unavailable, an alternate familiar with the activities of this contract shall fulfill this provision. The COTR must be notified in writing of the appointment of a replacement of the primary point of contact prior to assumption of work on this contract.

f. The Contractor shall collect representative samples of the waste. This may also be done by FSIS.

g. The Contractor shall assist FSIS in characterizing a waste stream based on generator’s knowledge or by sending the waste to a laboratory for a Waste Characterization Analysis.

h. The Contractor shall classify the waste in accordance with DOT shipping and Environmental Protection Agency (EPA) disposal regulations with appropriate EPA and DOT labeling.

i. The Contractor shall secure approval by a Treatment Storage and Disposal Facility (TSDF) to accept the generator’s waste.

j. The Contractor shall prepare lab packs on-site and provide special containers for small quantities of special waste materials.

k. The Contractor shall supply drums and other appropriate waste containers. Supplying labels for marking waste accumulation drums and satellite accumulation areas.

l. The Contractor shall provide specialized waste packaging assistance.

m. The Contractor shall prepare manifests for the waste shipments. The Contractor shall leave the appropriate signed and dated manifest copies with the FSIS COTR to departure.

n. The Contractor shall provide an emergency notification contact and telephone number for use on the FSIS hazardous waste manifest. The contact point shall be operation on a 24-hour basis and be capable of providing emergency instructions for the identification and cleanup procedures of any spilled FSIS hazardous waste.

o. The Contractor shall prepare Land Disposal Restriction notifications for all applicable hazardous wastes according to 40 CFR 268 at the time of shipment. The Contractor shall leave a copy of the land ban form with the FSIS laboratory at the time of pick-up.

p. For lab packs, packing lists or inventory sheets shall be prepared by the Contractor at the FSIS laboratory and shall indicate the type of waste, net quantity, and size of containers. The packing list or inventory sheet shall identify the lab pack or overpack container in which the inventoried item is placed. Packing lists or inventory sheets shall be affixed to the exterior of the corresponding container and shall accompany the manifest and other related documentation. The Contractor shall leave a copy of the packing list or inventory sheet with the FSIS laboratory at the time of pick-up.

q. The Contractor shall arrange for pickup and transport of wastes to an appropriate TSDF. All containerized hazardous waste must be transported in vehicles with fully enclosed cargo boxes. Hazardous waste shall be transported on the public highways by Environmental Protection Agency (EPA) approved (with DOT implications) licensed haulers to an approved disposal site. All Contractor vehicles used to transport hazardous waste must be currently licensed, permitted or otherwise registered in accordance with all applicable Federal, State, and Local laws. License number must be posted on the exterior of the vehicle. Each truck or van transporting hazardous waste must have an emergency spill clean-up plan and basic cleanup equipment on board. Hazardous waste transporters must comply with the United States Department of Transportation (DOT) Regulations, Title 49 , Code of Federal Regulations (49 Code of Federal Regulations); and U.S. Environmental Protection Agency (U.S. EPA) Regulations, Title 40 Code of Federal Regulations. The following requirements must be satisfied:

i. Hazardous Materials Certificate of Registration with the United States of America Department of Transportation

ii. Registered Hazardous Waste Hauler with the United States Environmental Protection Agency

iii. HAZWOPER Certification-40-hour initial training and annual refresher training for all contractor employees

r. The Contractor shall ensure that off-site shipments of hazardous waste are labeled, marked, and placarded according to the U.S. DOT requirements.

s. The Contractor shall arrange for treatment or disposal by an appropriate TSDF. Waste generated by each FSIS laboratory and approved for transport to storage stations shall not be commingled in the same shipping container with wastes from any other generator, unless allowed by law. Disposal method shall be by recycle, incineration, treatment or land burial, whichever is appropriate and in compliance with Federal, State, and Local disposal regulations. The Contractor shall use a treatment, storage, or disposal facility that has a valid permit to manage hazardous waste. FSIS must approve all disposal facilities used by the Contractor. Contractor remains responsible for proper management of wastes even after it leaves ML or EL. This includes responsibility for any spill while in transit. The contractor agrees to clean up such spills or leak in a manner that complies with applicable Federal, state, and local laws and regulations.

t. The Contractor shall provide the generator with where the final TSDF the waste was sent to and how the waste was treated.

u. In the event that hazardous waste is misidentified by FSIS and is therefore refused by the TSDF, reasonable additional costs incurred by the Contractor shall be subject to an equitable adjustment.

v. The initial list of proposed TSDF’s for FSIS hazardous waste shall be identified on Table 1 for evaluation purposes.

w. The Contractor shall provide a signed Uniform Hazardous Waste Manifest and certificate of destruction or proper management from the TSDF. Signed manifests must be received within 35 days of hazardous waste pickup from Midwestern Laboratory, St. Louis Missouri. Otherwise, ML will be required to file a Hazardous Waste Generator Exception Report, MO 780-0651, with the Missouri Department of Natural Resources.

x. The Contractor shall prepare a consolidated invoice for the generator that includes all services rendered by all parties.

y. The Contractor shall assist with completing the generator’s annual or biennial regulatory reporting forms.

z. The Contractor shall provide a cost estimate to provide employee training for an annual RCRA Refresher course which includes information on new regulatory changes affecting waste management.

aa. The Contractor shall provide DOT Shipping and Packaging training. Employee training for emergency response (chemical spills.)

ab. For the purpose of this contract, the Contractor shall be responsible for the spill cleanup that the contractor causes at an FSIS laboratory or during transportation of FSIS waste and shall bear the cost of cleanups and any additional disposal costs. FSIS will provide spill cleanup materials in the event of an FSIS caused spill.

ac. When hazardous waste generated by an FSIS laboratory is spilled for which the Contractor is responsible, the Contractor shall submit a Spill Report to the COTR identifying all spills by type and amount of chemical and identifying personnel exposures that occur involving spilled waste, whether at any pick up or storage location or during transportation. The Contractor shall provide certification that the spill was removed, a statement regarding the effect on any employees, and a description of the cause and corrective measure the contractor has taken to ensure that nor future such spills will occur. Such incidents shall be reported immediately, but no later than 24 hours after such incident, by telephone to the appropriate regulatory authorities (including the National Response Center, if in excess of the reportable quantity) and the COTR. The Contractor shall follow up the telephone report in writing no later than seven days after leaving the FSIS laboratory.

ad. The Contractor shall provide spill response. The Contractor shall provide spill response/clean-up as required by FSIS. FSIS shall provide the Contractor with the location, size, name of chemical or material involved, proximity of sewers and urgency and any governmental agencies called. The Contractor has four hours to be on site after the phone call has been placed. The Contractor shall provide appropriate personnel and equipment to mitigate and remove release hazardous materials. Coverage shall be on a 24 hour, 7 day a week basis.

ae. The initial list of proposed TSDF’s for FSIS hazardous waste shall be identified on Table 1 for evaluation purposes.

4.0 Government Furnished

For the most commonly generated waste streams, FSIS provides the Contractor with a description of waste materials. The Contractor then provides FSIS with EPA, DOT and the Contractor’s specific waste codes. For less commonly generated waste streams, FSIS will either send chemical property information or a sample to the Contractor, who then provides FSIS with appropriate wastes codes.

For lab packed wastes, FSIS will first send the Contractor an inventory for a price estimate. Wastes are then classified and separated into their various waste categories by the waste management company upon removal.

(b) In addition to the days designated above as holidays, the Government may observe additional days in accordance with 5 USC 6103.

5.0 Deliverables / Schedule

Waste pickup will take place at

b. For Midwestern Laboratory, schedule six hazardous waste pickups at 2-month intervals on mutually agreeable dates scheduled between the labs and vendor. For Eastern Laboratory, schedule three hazardous waste pickups at 4-month intervals on mutually agreeable dates scheduled between the labs and the vendor. FSIS Labs will provide an inventory list of the waste prior to scheduling.

c. Services include hazardous material management, transportation, recycling treatment and disposal services including the collection, packaging, recycling, treatment and disposal of hazardous and non-hazardous waste, DEA regulated pharmaceutical hazardous waste. Treatment may include recycling, incineration, landfill or other treatment. Ensure hazardous or toxic wastes are sent to licensed, permitted, and approved disposal sites. Contractor shall provide the COTR with a list of transporters and treatment, storage, and disposal (TSDF) facilities that shall be used in conjunction with this contract. This list must include the name of the company, address, city, and state, zip code, telephone number, EPA ID number and disposal methods.

d. Manifests signed by the destination facility must be received by laboratories within 35 days of initial pickup.

e. Training for annual RCRA Refresher training; DOT shipping and packaging training; and emergency response for chemical spills.

The contract period will be from date of award through a twelve-month period. The Government reserves the option to extend the contract for up to four additional years.

Time of Performance.

a. The Contractor must make arrangements with the FSIS laboratory within (5) business days from the receipt of a Delivery Order for pick-up of hazardous waste. The pick-up date for the hazardous waste will be provided to the COTR within this 5-day period.

b. The manifest shall be presented to the COTR for verification and signature before the waste is transported from the laboratory.

c. The Contractor shall remove the hazardous waste no later than 30 calendar days after receipt of a Delivery Order.

d. Manifests signed by the destination facility must be received by labs within 35 days of initial pickup.

Payment

The Contractor shall receive payment of a Delivery Order total charge upon FSIS COTR’s receipt of the manifest signed by the final disposition facility and a Certificate of Proper Management or a Certificate of Treatment and Disposal.

6.0 Travel

7.0 Contractor’s Key Personnel

The Key Personnel specified in this contract are considered to be essential to the work being performed under this contract. Prior to diverting any of the specified individuals to other projects, the contractor shall notify the Contracting Officer within 15 days, providing a detailed explanation of the circumstances necessitating the proposed substitutions, complete resumes for the proposed substitutes, evaluation of the impact to the services and any additional information requested by the Contracting Officer. Proposed substitutes should have comparable qualifications for those of the persons being replaced. The Contracting Officer will notify the Contractor within 15 calendar days after receiving receipt of all required information of the decision on substitutions. No diversion shall be made by the contractor without the written consent of the Contracting Officer.

8.0 Special Criteria

Special Standard of Responsibility-Specialized Experience. The special standard of responsibility shall be used to determine the offeror’s specialized experience providing Hazardous Waste Material Removal and Disposal identified in this solicitation. The offeror shall provide evidence of specialized experience providing Hazardous Waste Material Removal and Disposal. If the Contractor or its subcontractors are ISO 9001, ISO 17025 and ISO 14001 certified environmental services provide documentation.

Special Standard of Responsibility-Certification to Transport Hazardous Waste. Certification to Transport Hazardous Waste. This special standard of responsibility will be used to determine the offeror’s certification to provide hazardous waste material removal and disposal services. The offeror shall provide evidence that they possess required certifications and licenses to provide hazardous waste material removal and disposal services. Specifically, the offeror shall provide copies of the following demonstrating that they have the required licenses and certification to provide hazardous waste material removal and disposal services:
