About this file
This document is a Single Source Justification form for a sole source procurement by the Centers for Disease Control and Prevention (CDC). The CDC intends to acquire an Advantage Level Service agreement for specific GeneXpert DX equipment from Cepheid, including one GXlV-4-L-10C, one GXXVI-16-L-10C, and one GXXVI-16-D-10C instrument, along with a computer for operating the Cepheid GeneXpert. The total estimated value is $57,868.00, with a service agreement period from 7/6/2025 to 7/5/2026.
The justification is based on the brand name requirement, as Cepheid is the sole provider of the GeneXpert DX automated system used to screen rectal swabs for specific bacterial genes. The document notes that Cepheid is the original manufacturer and the only vendor capable of servicing the equipment to their specifications. Other vendors like REMI cannot service the instrument due to Cepheid's strict warranty policy, which does not allow modifications or repairs by unauthorized providers. The procurement will be conducted under FAR 13.106-1(b), with interested parties given five days to respond to the notice of intent to sole source.

3. Rationale for soliciting from single source or brand name:

Exclusive Licensing Agreement – The required item or service is only available from the original equipment manufacturer (OEM) or there is only one authorized distributor/source for the OEM.

| Text24: Cepheid is the sole provider of the GeneXpert DX, an automated system that is used to screen rectal swabs specimens for the presence of Enterobactericeae, Acinetobacter baumannii or Pseudomonas aeruginosa that contain specific carbapenemase genes. The systems allows for same-day rapid detection of the carbapenemase genes directly from a swab. The GeneXpert DX will be integrated into current swab processing workflow and will also be used as support testing when the state partners are overwhelmed. The system will also be used with wastewater samples to compare the obtained data with the results obtained with the standard PCR test. |
Cepheid's limited warranty states that they will not cover modifications or repairs done by other than Cepheid or a Cepheid authorized service provider. Cepheid does not warrant any defects in the Instrument caused by (i) improper installation, removal or testing, (ii) Purchaser's failure to provide a suitable operating environment for the Instrument, (iii) use of the Instrument for purposes other than that for which it was designed, (iv) unauthorized attachments, (v) unusual physical or electrical stress, (vi) modifications or repairs done by other than Cepheid or a Cepheid authorized service provider, or (vii) any other abuse, misuse, or neglect of the Instrument. The Instrument is designed and certified with applicable regulatory authorities as part of an integrated instrument/reagent/consumable system. Use of unapproved parts, reagents or other materials with the Instrument will void any warranty and any service contract between Cepheid and the Purchaser that pertains to the Instrument.
Text25: Cepheid is the original manufacturer of this equipment and as such are the only vendor capable of servicing the equipment to their specifications, and supplying the associated computer required for operating the equipment. We did investigate if we could add this to an already existing CDC BPA with REMI group, but REMI was unable to support this piece of equipment. REMI cannot service this instrument due to Cepheid's warranty policy which states “states that they will not cover modifications or repairs performed by other than Cepheid or a Cepheid authorized service provider. Use of unapproved parts, reagents or other materials with the Instrument will void any warranty and any service contract between Cepheid and the Purchaser that pertains to the Instrument.” Program once again did an internet Google search and checked GSA Advantage to determine if there were other approved vendors who could provide a MA for the Cepheid GeneXpert. No additional vendors were found.
