SECTION MT-01009
PART 1: GENERAL
1.01 SUMMARY:
A. Description of Work: Furnishing labor, equipment, tools, and materials to construct new sections of trails and decommission old sections of trail at the Schnell Recreation Area.
Work to include but not limited to: construction of new trail typical along walking path, filling in of erosion ruts and troughs, and the rehab and reclamation of decommissioned sections of trail.
B. Location: Work under this Contract is located in Stark County, North Dakota. The work locations are shown on the drawings.
1.02 REFERENCES:
A. Referenced Specifications/Standards with Abbreviations and/or Acronyms: Wherever the following acronyms are used in these specifications or on the drawings, they are to be construed the same as the respective expressions represented. Copies of the referenced specifications/standards referred to herein may be procured by the Contractor from the following:

1.03 DEFINITIONS:
A. Approvals: Approval of the submittal is an indication that the Contractor's submittal has been reviewed and that there are no objections, except as noted. Approval of deviations shall apply only to those deviations or omissions from the requirements of the drawings and specifications brought to the Contracting Officer's attention in writing. After approval of an item, the Contractor may submit a substitute for approval when the approved item cannot be purchased or delivered in time to avoid delay in completion of the project.
1.04 SUBMITTAL:
A. Scope: Submittals may include, but not necessarily be limited to, the following: design computations, shop drawings, manufacturers' literature, as-built drawings, samples, and maintenance manuals.
B. Requirements: Refer to specifications for submittal required. Allow at least 5 working days for review. Submittal shall be delivered to the Contracting Officer or his/her appointed representative.
C. Identification of Submittal: Completely identify each submittal by showing at least the following information: submit two copies of each submittal for approval.
1. Name and address of submitter, plus name and telephone number of the individual to contact for further information.
2. Name of project as it appears in these specifications.

3. Contract number, drawing number, and specification section number to which the submittal applies.
4. Whether this is an original submittal or re-submittal.
5. Each item shall clearly note the manufacturer's name and address, trade name, product, lot, style, color, catalog designation or model number, and locations of use.
1.05 CERTIFICATES OF CONFORMANCE:
A. Requirements: The Contracting Officer may permit use, prior to sampling and testing, of materials when accompanied by Certificates of Conformance. Materials used on the basis of a Certificate of Conformance may be sampled and tested. Installation of materials on the basis of Certificates of Conformance shall not relieve the Contractor of responsibility for incorporating materials conforming to the requirements of the drawings and specifications. Material not conforming to those requirements will be subject to rejection, whether in place or not.
B. Format: The form of the Certificate of Conformance provided by the supplier shall be as follows: Submit two copies of the Certificate of Conformance for approval.
1. The certificate shall state that the named product conforms to the Contract requirements.
2. The certificate shall either be accompanied with a certified copy of the test results or certify that such test results are on file with the manufacturer and will be furnished to the Contracting Officer upon request.
3. The certificate shall provide the name and address of the manufacturer, the testing agency, and the date of tests.
4. The certificate shall set forth the means of identification permitting field determination of the product delivered as being the product covered by the certification.
1.06 QUALITY ASSURANCE:
A. Codes and Standards: The work shall comply with codes and standards applicable to each type of work and as listed in the individual sections of these specifications. This Contract incorporates materials, applications, and tests by reference, with the same force and effect as when they were given in full text.
B. Conflict: Where a conflict occurs between reference documents and project specifications, the project specifications shall govern.
C. Measurements: Where approved manufacturer's diagrams and shop drawings give specific measurements or rough-in dimensions for equipment, these dimensions shall take precedence over dimensions indicated on the drawings.

1.07 DELIVERY, STORAGE, AND HANDLING:
A. Delivery: The Contractor shall supply and deliver certified weed-seed free topsoil material to the site. Work with the Contracting Officer to determine an approved topsoil stockpile location that avoids sensitive areas.
B. Stockpile: The certified weed-seed free topsoil stockpile shall not be allowed to remain in one location for more than 5 days. Coordinate work in such a way that topsoil is used to perform Trail Reclamation work immediately after being transported to the site, unless otherwise directed by the Contracting Officer. Contractor shall not disturb the native topsoil during use of the stockpile.
C. Removal: All excess weed-seed free topsoil shall be removed from the site within 5 days of Trail Reclamation completion, unless otherwise directed by the Contracting Officer.
Contractor shall not disturb the native topsoil during removal of the stockpile.
1.08 PROJECT/SITE CONDITIONS:
A. Access to the Work: The work site is accessed by county road to the Schnell Recreation
Area. Coordinate with the Contracting Officer Representative (COR) for alternate access points.
1. Contractor shall have full access to the work area during construction. Motorized travel within the recreation area will be permitted for the contract, however, access and travel within the site shall be limited to explicitly authorized existing roads and trail systems.
2. Minimize vegetation disturbance and ground surface disturbance outside of the extents of existing trails and roads. Any route not explicitly authorized for travel will be considered an unauthorized route. Any surface disturbance outside of the extents of existing roads and trails explicitly authorized for travel shall be corrected at the Contractor’s expense to the satisfaction of the Contracting Officer.
3. Utilize existing water course crossings.
4. Ensure that sensitive areas are not disturbed. No excavation or surface disturbance outside the extents of the existing trails is allowed in trail reclamation and decommissioning work areas.
5. Provide proper traffic control to secure the work area from recreational pedestrian traffic while performing the work.
B. Environmental Considerations: The aesthetic values of the site and surrounding area are of prime importance. The Contractor shall take all care necessary to preserve all plant life and other natural features. Minimize ground surface damage and vegetation disturbance outside the clearing limits. Any surface damage outside the trail clearing limits shall be

corrected by the Contractor at their expense. Any damage to existing State, County, or local roads, used to transport materials to the project, shall be corrected by the Contractor at their expense.
C. Construction facilities:
1. Contractor shall be responsible for utility locations before starting work. All utility locations shall include public and private utilities on the site.
2. Remove and replace any trail signing that is damaged by the Contractor during construction at the Contractor’s expense.
D. Repair of Underground and Overhead Utilities: Contractor is responsible for any damage to underground and overhead utilities such as but not limited to: water, electrical, phone, sewer, and main power lines. All damaged underground or overhead utilities will be the full responsibility of the Contractor and shall be repaired at the Contractors expense.
1.09 SEQUENCING AND SCHEDULING:
A. Work Schedule: The schedule shall be submitted at the pre-work conference. When requested, the Contractor shall submit an updated schedule within 3 calendar days.
PART 2: PRODUCTS
(There are no applicable requirements.)
PART 3: EXECUTION
3.01 PROJECT MEETINGS:
A. Pre-Work Conference:
1. Notification: A pre-work conference will be held prior to the start of work. The Contractor will be notified in advance of meeting time, date, and place. The purpose will be to review required work, project drawings and specifications, construction schedules, payroll and payments, and administrative provisions of the Contract.
2. Attendance: The Contractor, subcontractors, and the persons responsible for coordination of the work shall be present at the meeting.
3. Presentation: The Contractor shall be prepared to summarize and explain procedures planned for the project and present the submittal requested in the specifications.
B. Progress Meetings:

1. Location: Meetings shall be held at the project site or as determined by the Contracting Officer.
2. Notification: Meetings may be called by either the Contracting Officer or the Contractor.
The request shall state who should attend.
C. Final Inspection:
1. Location: Meeting shall be held at the project site, or as determined by the Contracting Officer.
2. Notification: The Contractor shall notify the Contracting Officer, in writing, at least 5 working days before the completion date so the Government can schedule final inspection.
3. Attendance: The Contractor shall require the superintendent to be present during this inspection.
3.02 WORK LAYOUT:
A. Government Requirements:
1. General: The project is to construct new sections of a single-track recreational trail. Full bench trail excavation shall begin and end as shown on the drawings and as designated on the ground by the Government. The Government shall layout any trail features prior to construction. Contact COR for any proposed trail layout deviations that may benefit the overall finished trail. No trail re-routes will be approved for Contractor convenience.
Allow 3 working days for approval or denial before beginning site work, or for any additional field Government field staking work. Contractor shall be responsible for all measurements, lines, and grades necessary to perform the work required under the Contract. Baseline monuments, benchmarks, or reference points disturbed or removed during construction shall be reset by the Government at the Contractor’s expense.
3.03 CLEANUP:
A. Waste Removal: The Contractor shall at all times keep the premises free from accumulation of waste materials and/or rubbish caused by their employees or work. At the completion of the work, the Contractor shall remove all such materials from the work site. The Government may remove all such materials and charge the cost to the Contractor, if the site is left untidy.
PART 4: MEASUREMENT AND PAYMENT
4.01 METHOD OF MEASUREMENT:
A. Units: The work described in this section will not be measured for payment.

4.02 BASIS OF PAYMENT:
A. Payment: No direct payment for the work described in this section will be made.
Consideration for this item shall be included in the bid price for other items of the Contract.

MOBILIZATION

SECTION MT-01505
A. Section Includes: Preparatory work and operations, including those necessary to the movement of personnel, equipment, supplies, and incidentals to the project site; and for other work and operations which must be performed or costs incurred prior to beginning work on the various items on the project site. This specification does not include moves between project sites.

PART 3: EXECUTION

PART 4: MEASUREMENT AND PAYMENT
4.01 METHOD OF MEASUREMENT:
A. Units: Progress payments will be made as follows:
1. When 5 percent of the original contract amount is earned from other bid items, 50 percent of the amount bid for mobilization or 5 percent of the original contract amount, whichever is lesser, will be paid.
2. When 10 percent of the original contract amount is earned from other bid items, 100 percent of the amount bid for mobilization or 10 percent of the original contract amount, whichever is lesser, will be paid.
3. Upon completion of work for the project, payment of the amount bid for mobilization in excess of 10 percent of the original contract amount, will be paid.
4. The total sum of all payments shall not exceed the original contract amount bid for mobilization, regardless of the fact that the Contractor may have shut down the work on the project or moved equipment away from the project and then back again.

4.02 BASIS OF PAYMENT:
A. Payment: No direct payment for moves between project sites will be made. The
Contractor shall include consideration for moves between project sites in the bid price for other items of the Contract. Prices and payment will be full compensation for the work described in this section. No modification or adjustments shall be allowed for costs and changes to mobilization despite changes in fuel or transportation costs. Payment will be made under:

TRAILS

SECTION MT-02796
A. Section Includes:
1. This work consists of constructing trails in conformity to the dimensions, lines, and shown on the drawings.
2. This work includes excavation and embankment.
3. This work includes furnishing equipment, tools, and labor.
1.02 DEFINITIONS:
A. Backslope: The slope that has been excavated uphill of the trail.
B. Berm: The ridge of material formed on the outer edge of the trail that projects higher than the center of the trail tread.
C. Catch Point: The outer limits of a trailway where the excavation and/or embankment intersect with the ground line.
D. Clearing limits: The area surrounding the trail tread that is to be cleared, excavated, and sloped.
E. Compacted: Consolidation that is obtained by tamping or rolling mineral soil and fine aggregate in successive layers not to exceed more than 6 inches in loose depth. Compact until no noticeable displacement of material is observed.
F. Designated on the Ground: Point out or mark the location of materials, work areas, and construction items, including lines and grades, with stakes, flagging, tags, or paint.
G. Full Bench: Where the entire trailbed is constructed on undisturbed material.
H. Inslope: Where the trailbed is sloped downward toward the backslope of the trailway.
I. Mineral Soil: Non-organic soil that contains rock less than 2 inches in maximum dimension.
J. Outslope: Where the trailbed is sloped downward toward the embankment or daylight

side of the trailway.
K. Sideslope: The slope of the existing ground; usually expressed in percent.
L. Trailbed: The uniform bearing surface upon which traffic moves.
M. Trailway: The portion of the trail within the limits of the excavation and embankment.
N. Tread: The surface portion of the trail upon which traffic moves.
O. Water Course: Channels, either natural or constructed, where water flows or will collect and flow.
1.03 SYSTEM DESCRIPTION:
A. Design Requirements: See below for Trail Layout and Design Requirements. Layou t of trail and trail features shall be according to the design requirements, site conditions, and the contract drawings. Contact Contract Officer Representative (COR) for any proposed deviations from these standards.
1. Trailbed Width: 36 inches – 42 inches
2. Trailbed Outslope: 5%
1.04 SUBMITTALS:
A. General: Submittals shall be according to Section 01009 – General Requirements
1.05 SITE CONDITIONS:
A. Trail Closure: Provide controls to prevent traffic in and around work areas until those areas are suitable for traffic.
B. Motorized Equipment: Equipment appropriate for trail construction shall be used.
Access shall be scheduled with the COR.
C. Frozen Conditions: Do not begin or continue excavation or compaction work when the ground, borrow, or fill material is frozen.
PART 2: PRODUCTS
2.01 MATERIALS:
A. Sources: Sources for topsoil will be Contractor furnished from Contractor furnished sources. Include the cost of these items in the appropriate bid item.

B. All Contractor furnished topsoil shall be certified weed seed free.
PART 3: EXECUTION
3.01 TRAIL EXCAVATION AND EMBANKMENT:
A. Description: Excavation is required to shape and finish the trailbed and backslopes.
Work shall be accomplished to meet the lines and grades shown on the drawings.
Deviations from the trail alignment to avoid or minimize disturbance to physical terrain or vegetation shall be approved by the Contracting Officer.
1. Recompact disturbed soil within the clearing limits in lifts no greater than 6 inches.
Compaction shall consist of rolling materials with machine wheels, or plate compacting material, until no noticeable displacement of material is observed.
2. All Trail Excavation shall be full bench excavation.
3. Areas within clearing limits shall be accurately and uniformly graded and shaped to the elevations shown on the drawings or as designated on the ground, and to be stable and to prevent future erosion.
4. Depressions shall be filled, and mounds shall be graded down to uniform surface.
5. Remove rocks larger than 4 inches in diameter and backfill cavities with compacted material.
6. Access and travel within the site are limited to explicitly authorized existing roads and trails. Any surface disturbance outside of the extents of existing roads and trails explicitly authorized for travel shall be corrected at the Contractor’s expense to the satisfaction of the Contracting Officer. See Section MT-01009.
B. Excavated Material: Conserve and use suitable material in the construction of trailbed embankments, if necessary.
1. Place excess and unsuitable excavation material beyond the downslope edge of the clearing limits, uniformly spread to a depth not exceeding 4 inches. Placed so as not to obstruct drainage.
C. Excavated Material Quantities: Actual material excavation quantities will not be calculated by the Government. Contractor is responsible to make determinations of excavated quantities and is encouraged to do so by site visit.
D. Trailbed Width: The finished width shall be 36 inches to 42 inches, as shown on the drawings.
E. Trailbed Outslope: Trailbed outslope shall be 5%.

3.02 TRAIL RECLAMATION:
A. Description: Ruts and troughs of eroded portions of the reclaimed trail, as designated on the ground, shall be filled with certified weed-seed free topsoil. Work consists of filling the ruts and troughs and compacting the topsoil in lifts no greater than 6 inches, allowing for a finished surface one inch above the surrounding surface. Compaction shall consist of rolling materials with machine wheels, or plate compacting material, until no noticeable displacement of material is observed.
1. Contractor to supply and deliver weed-seed free topsoil to the project site in accordance with Section MT-01009. Work with the Contracting Officer to determine an approved stockpile location that avoids sensitive areas. Topsoil material shall not be stockpiled in one location for more than 5 days. Coordinate work in such a way that topsoil is used for Trail Reclamation work immediately after being delivered to the site. Minimize disturbance of the native topsoil while using or removing stockpiled topsoil.
B. Imported Topsoil Quantities: Actual imported topsoil quantities will not be calculated by the Government. Contractor is responsible to make determinations of topsoil quantities needed and is encouraged to do so by site visit.
C. Equipment, tools, and methods shall be used to ensure the surrounding, sensitive surface is not disturbed. Any surface disturbance outside of the extents of existing trails shall be corrected at the Contractor’s expense to the satisfaction of the Contracting Officer.
D. Additional reclamation actions, including erosion control and seeding, will not be a part of this Contract.
3.03 PROTECTION:
A. Traffic Control: Provide controls to prevent traffic in and around work areas until those areas are suitably prepared for traffic.
B. Protect native topsoil and site sensitive areas from disturbance.
3.04 CLEANUP:
A. Requirements: Clean the area by removing and disposing of materials not used. Excess topsoil material shall be removed and disposed of from the site within 5 days of Trail Reclamation completion. Debris resulting from development of material sources shall be disposed of by scattering evenly downslope from the clearing limit. Debris shall not be scattered within the clearing limits of trails or within roadsides. Debris from clearing and grubbing operations shall not be placed in streams, water courses, snow ponds, lakes, meadows, or in locations that impede flow through or from drainage facilities.
Dispose of litter and trash offsite at a landfill.

PART 4 MEASUREMENT AND PAYMENT
4.01 METHODS OF MEASUREMENT:
A. Units: The work associated with trail construction will be measured and paid for by the linear foot as measured on the ground along the centerline of the new trail under Section MT-02796(1) Trail Construction. Work shall include preparing and building the trail to the typical trail sections described in these specifications and shown in the contract drawings, as well as all material, labor, tool, incidental, and equipment costs associated with trail excavation described in this section. Actual excavation quantities involved in Trail Construction work will not be calculated by the Government. It will be the responsibility of the Contractor to include these quantities in the price of the bid item.
B. Units: The work associated with the supply and placement of the topsoil for trail reclamation and decommission shall be paid for by the linear foot as measured on the ground along the centerline of the reclaimed trail under Section MT-02796(2) Trail Reclamation. Work shall include all certified weed-seed free topsoil, material, labor, tool, incidental, and equipment costs associated with the supply, placement, and compaction of the topsoil described in these specifications and shown in the contract drawings. Actual topsoil quantities involved in Trail Reclamation work will not be calculated by the Government. It will be the responsibility of the Contractor to include these quantities in the price of the bid item.
4.02 BASIS OF PAYMENT:
A. General: Prices and payment will be full compensation for the work described in this section at the contract unit price per unit of measurement for the pay items listed below and shown in the bid schedule. Water for compaction will not be paid for separately but will be considered as a subsidiary obligation of the Contractor incidental to work specified. Payment will be made under:
