Performance Work Statement (PWS)

National Mall & Memorial Parks

3 March 2026

PART 1

GENERAL INFORMATION

1. GENERAL: This is a non-personal services contract to provide services for shaping the trees by pleaching at National Law Enforcement Officer’s Memorial. The Government shall not exercise any supervision or control over the contract service providers performing the services herein. Such contract service providers shall be accountable solely to the Contractor who, in turn is responsible to the Government.

1.1 Description of Services/Introduction: The Contractor shall provide with all labor, supplies, materials, equipment and travel, necessary to shape the trees by pleaching at National Law

Enforcement Officer’s Memorial. Contractor shall provide qualified crew and equipment to accomplish tree care tasks consistent with skills and equipment (e.g., truck to transport debris, ladders, gas-powered hedge trimmers, and manual hedge pruners, clean-up equipment, and related equipment) necessary to accomplish standard hedge topiary and small tree shearing, as defined by ANSI A300 (Part 1)-2017 Pruning, except for those items specified as Government furnished property and services. The Contractor shall perform to the standards in this contract.

1.2 Background: The National Mall and Memorial Parks where the nation comes to remember and where history is made. As “America’s Front Yard,” the National Mall and Memorial

Parks are home to many of our country’s most iconic memorials telling the story of people and events that shaped us as a nation. Each year, millions of people come to recreate, commemorate presidential legacies, honor our veterans, and make their voices heard. For more than 200 years, the National Mall symbolized our nation and its democratic values, which have inspired the world. The National Mall - the great swath of green in the middle of our capital city and stretching from the foot of the United States Capitol to the Potomac River

- is the premiere civic and symbolic space in our nation.

1.3 Objectives: Maintain the landscaping design of this memorial site and ensure the proper maintenance of the trees so that they remain healthy, safe, and aesthetically pleasing. The

National Park Service (NPS), National Capital Region (NCR), National Mall and Memorial

Parks (NAMA) are seeking contract services for tree care. The Contractor must at all times maintain an adequate workforce for the uninterrupted performance of all tasks defined within this PWS. When hiring personnel, the Contractor should keep in mind that the stability and continuity of the workforce are essential.

Tree Pruning at the National Law Enforcement Officer’s Memorial

1.4 Scope: Firm-Fixed-Price base with the possibility of up to 4 option years, in order to maintain the landscaping design of the National Law Enforcement Memorial to ensure the proper maintenance of the trees so that they remain healthy, safe, and aesthetically pleasing.

1.5 At this time only the Base year is fully funded

1.6 Place of Performance: National Law Enforcement Officers Memorial, 400 Block of E Street

NW, Washington, DC 20001 (Judiciary Square).

1.7 General Information:

1.7.1 Quality Control (QC): The contractor shall develop and maintain an effective quality control program to ensure services are performed in accordance with this PWS. The contractor shall develop and implement procedures to identify, prevent, and ensure non-recurrence of defective services. The Contractor’s quality control program is how the contractor assures itself that its work complies with the requirement of the contract.

1.7.2 Quality Assurance (QA): The Government shall evaluate the Contractor’s performance under this contract in accordance with the Quality Assurance Surveillance Plan. This plan is primarily focused on what the Government must do to ensure that the contractor has performed in accordance with the performance standards. It defines how the performance standards will be applied, the frequency of surveillance, and the minimum acceptable defect rate(s). This plan can be found as Attachment 1 – Quality Assurance Surveillance

Plan (QASP).

1.7.3 Hours of Operation: All work is to be scheduled and coordinated through the Contracting

Officers Representative (COR). All work must be scheduled in advance with the COR to ensure the Park can provide access/assistance for the sites. The standard hours of operation are 7:00 a.m. to 3:00 p.m., Monday through Friday. Work can be performed outside these hours but must first be coordinated and approved by the COR.

1.7.4 Recognized Holidays: The contractor is not required to perform services on holidays.

1.7.5 Type of Contract: The Government will award a Firm-Fixed-Price

1.7.6 Physical Security: The Contractor shall be responsible for safeguarding all Government equipment, information, and property provided for Contractor use.

1.7.6.1 Key Control: No keys will be issued to the Contractor by the Government. All access must be scheduled in advance with COR.

1.7.6.2 Lock Combinations: Not applicable.

1.7.7 Special Qualifications: To successfully perform the contract, the Contractor must have the following competencies:

1.7.7.1 The Contractor must submit copies of the following with the signed contract and bid submittal form to be eligible for the contract award:

• ISA Certified Arborist certification for person(s) appointed to oversee work.

1.7.7.2 Without expense to the Government, be responsible for obtaining any necessary licenses and permits, and comply with any applicable Federal, State, and municipal laws, codes, and regulations.

1.7.8 Post Award Conference/Periodic Progress Meetings: The Contractor agrees to attend any post award conference convened by the contracting activity or contract administration office in accordance with Federal Acquisition Regulation Subpart 42.5. The Contracting

Officer (CO), Contracting Officers Representative (COR), and other Government personnel, as appropriate, may meet periodically with the Contractor to review the

Contractor's performance. At these meetings the Contracting Officer will assess the

Contractor on how the Government views the Contractor's performance and the

Contractor will appraise the Government of problems, if any, being experienced.

Appropriate action should be taken to resolve outstanding issues. These meetings shall be at no additional cost to the Government.

1.7.9 Contracting Officer Representative (COR): The COR will be identified by separate letter.

The COR monitors all technical aspects of the contract and assists in contract administration. The COR is authorized to perform the following functions: assure that the Contractor performs the technical requirements of the contract: perform inspections necessary in connection with contract performance: maintain written and oral communications with the Contractor concerning technical aspects of the contract: issue written interpretations of technical requirements, including Government drawings, designs, specifications: monitor Contractor's performance and notifies both the

Contracting Officer and Contractor of any deficiencies; coordinate availability of government furnished property, and provide site entry of Contractor personnel. A letter of designation issued to the COR, a copy of which is sent to the Contractor, states the responsibilities and limitations of the COR, especially with regard to changes in cost or price, estimates or changes in delivery dates. The COR is not authorized to change any of the terms and conditions of the resulting order.

1.7.10 Key Personnel: The following personnel are considered key personnel by the

Government: Project/Contract Manager. The contractor shall provide a contract manager who shall be responsible for the performance of the work. The name of this person and an alternate who shall act for the contractor when the manager is absent shall be designated in writing to the Contracting Officer. The contract manager or alternate shall have full authority to act for the contractor on all contract matters relating to daily operation of this contract and must be fluent in English. The contract manager or alternate shall be available between 7:00 a.m. to 3:30 p.m., Monday through Friday, except Federal holidays or when the Government facility is closed for administrative reasons. The contract manager or alternate shall be available by email and telephonically with the capability of responding during business hours mentioned above within 2 hours of receiving a call or email from the CO/COR.

1.7.11 Identification of Contractor Employees: All contract personnel attending meetings, answering Government telephones, and working in other situations where the Contractor status is not obvious to third parties are required to identify themselves as such to avoid creating an impression in the minds of members of the public that they are Government officials. The Contractor shall require its employees to wear distinctive uniform clothing, safety shoes and shall assure that every employee is in uniform when performing contracted activities at the Park. The uniform shall have the Contractor’s name, easily identifiable, permanently attached above the waist. They must also ensure that all documents or reports produced by contractors are suitably marked as Contractor products or that contractor participation is appropriately disclosed.

1.7.12 Contractor Representative: Upon contract award, the Contractor shall provide to the

Contracting Officer and COR, the name, phone number and cellular phone number of the

Contractor representative and an alternate contact who is responsible for overseeing the performance of this contract. This person must be able to make decisions for the company.

1.7.13 Contractor Travel: The contractor shall be responsible for all travel necessary to complete the work described in the PWS.

1.7.14 Loss or Damage: If due to fault, neglect, dishonesty of the Contractor, his agency or employees, loss or damage to government property is incurred during the performance of this contract, the Contractor shall be responsible for the same. The Government, at its option, in lieu of repayment, may require the Contractor to replace at his own expense, all property as directed by the Contracting Officer.

1.7.15 Safety: The work area shall be maintained in a clean and safe condition at all times. All personnel providing service on-site shall have pictured identification and uniform displaying the name of the company. All on-site vehicles will also be marked with the company name. The contractor shall, with the use of barricades, ropes, signs, or audible signals, take all necessary precautions for the protection of the work and safety of the public. Any accident or incident, in regard to the work under this contract, shall be reported immediately, in writing, to the Contracting Officer.

1.7.16 Invoice Requirements: Invoices shall be submitted in arrears, and no advance payments shall be authorized. The contractor shall submit invoices for payment as follows:

1.7.16.1 Invoices must be submitted to the Department of Treasury's Invoice Processing Platform

(IPP). All invoices are to be submitted online through IPP. See:

1.7.16.2 All vendors must register at: https://www.ipp.gov/vendors/enrollment-vendors to establish an account in order to submit an invoice on this project. The benefits of registering with IPP include the ability to create invoices directly from a contract award and submit them electronically, as well as email notifications when invoice(s) are paid, online payment history and email notification when you are awarded a new contract.

1.7.16.3 The email notification of payment is sent when a payment is distributed to your bank account and will include all pertinent payment information. For all questions related to

IPP registration and issues with submitting invoices, please contact IPP Customer Support at 1 (866) 973-3131.

1.7.16.4 The contractor shall submit a final invoice within thirty (30) calendar days of the work being completed and accepted by the COR. After the final invoice has been paid the contractor shall furnish a completed and signed Release of Claims to the CO/CS. This release of claims is due within fifteen (15) calendar days of final payment.

1.7.16.5 In accordance with the Prompt Payment Act (Public Law 97-177), contractors have to submit proper invoices for payment. A proper invoice includes:

• Name and address of the Contractor

• Invoice date and invoice number

• Contract/order number

• Taxpayer Identification Number (TIN)

• Description, quantity, unit of measure, unit price, and extended price

• Name (where practicable), title, phone number, and mailing address of person to notify in the event of a defective invoice

1.7.16.6 The invoice must contain specific information as listed above or the invoice shall be returned to the contractor within seven days after receipt, noting reasons why it is not a proper invoice. The agency payment office will no longer “hold” or “pen and ink” the invoice in an attempt to correct it. The contractor must correct and resubmit the invoice through the Invoice Processing Platform (IPP).

1.7.16.7 Any required reports, manifests, or disposal tickets required shall also be uploaded with a copy of the invoice through the Invoice Processing Platform. Invoices will be rejected if the invoice is missing, incorrect, and/or the maintenance reports are missing.

PART 2

DEFINITIONS & ACRONYMS

2. DEFINITIONS AND ACRONYMS

2.1. DEFINITIONS:

2.1.1. CONTRACTOR. A supplier or vendor awarded a contract to provide specific supplies or service to the government. The term used in this contract refers to the prime.

2.1.2. CONTRACTING OFFICER. A person with authority to enter into, administer, or terminate contracts, and make related determinations and findings on behalf of the government.

Note: The only individual who can legally bind the government.

2.1.3. CONTRACTING OFFICER'S REPRESENTATIVE (COR). An employee of the U.S.

Government appointed by the contracting officer to administer the contract. Such appointment shall be in writing and shall state the scope of authority and limitations. This individual has authority to provide technical direction to the Contractor as long as that direction is within the scope of the contract, does not constitute a change, and has no funding implications. This individual does NOT have authority to change the terms and conditions of the contract.

2.1.4. DEFECTIVE SERVICE. A service output that does not meet the standard of performance associated with the Performance Work Statement.

2.1.5. DELIVERABLE. Anything that can be physically delivered but may include non-manufactured things such as meeting minutes or reports.

2.1.6. PHYSICAL SECURITY. Actions that prevent the loss or damage of Government property.

2.1.7. QUALITY ASSURANCE. The government procedures to verify that services being performed by the Contractor are performed according to acceptable standards.

2.1.9. QUALITY ASSURANCE SURVEILLANCE PLAN (QASP). An organized written document specifying the surveillance methodology to be used for surveillance of contractor performance.

2.1.10. QUALITY CONTROL. All necessary measures taken by the Contractor to assure that the quality of an end product or service shall meet contract requirements.

2.1.11. SUBCONTRACTOR. One that enters into a contract with a prime contractor. The

Government does not have a contract with the subcontractor.

2.1.12. WORKDAY. The number of hours per day the Contractor provides services in accordance with the contract.

GOVERNMENT FURNISHED PROPERTY, EQUIPMENT, AND SERVICES

3. GOVERNMENT FURNISHED SERVICES AND MATERIALS:

3.1. Services: All work is to be scheduled and coordinated through the Contracting Officer’s

Representative. Work should be scheduled in advance so that proper access to the area can be provided.

3.2. Materials: A parking pass will be issued for vehicle(s) and driver(s) performing work under this contract.

PART 4

CONTRACTOR FURNISHED ITEMS AND SERVICES

4. CONTRACTOR FURNISHED ITEMS AND RESPONSIBILITIES:

4.1. General: The Contractor shall furnish all supplies, equipment, facilities, and services required to perform work under this contract that are not listed under Part 3 of this PWS.

4.2. Materials: The Contractor shall furnish all supplies and materials required to perform work under this contract that are not listed under Part 3 of this PWS.

4.3. Equipment: The Contractor shall furnish all equipment required to perform work under this contract that are not listed under Part 3 of this PWS.

PART 5

SPECIFIC TASKS

5. Tree Pleaching

5.1. Independently, and not as an agent of the government, the contractor shall provide the

National Park Service, with all labor, supplies, materials, equipment and travel, necessary to shape the trees by pleaching at National Law Enforcement Officer’s Memorial. Contractor shall provide qualified crew and equipment to accomplish the tree care tasks consistent with skills and equipment (e.g., truck to transport debris, ladders, gas-powered hedge trimmers, and manual hedge pruners, clean-up equipment, and related equipment) necessary to accomplish standard hedge topiary and small tree shearing, as defined by ANSI A300 (Part

1)-2017 Pruning. The work shall include but is not limited to the following:

5.1.1. Shape all Linden trees encircling the memorial through the technique of pleaching or shearing. This pertains only to the trees with the pleaching effect already present.

Shearing is acceptable. Note: prune adjacent oak trees away from linden trees by creating approximately 3’ of clearance.

5.1.2. Clean area daily. All resulting tree debris shall be disposed of by contractor.

5.1.3. Site protection must be used to ensure safety of public and contractor employees during the performance of this contract. Contractor shall submit methodology to be used for site protection.

5.1.4. Provide equipment to access trees at memorials without damaging hardscape. Contractor shall submit with bid the equipment and soft/hardscape protection system(s) to be used for this work.

5.1.5. Do not park or drive any equipment onto critical root zone areas.

5.1.6. Appropriate flat bottom turf protection mats (or plywood) and outrigger pads should be used when trucks and equipment are parked on hard surfaces.

5.1.7. The contractor shall provide all labor, supervision, materials, tools, supplies, transportation, barricades, signs, traffic control measures/coordination and equipment incidental to and necessary to execute safe full spectrum pruning operations in accordance with industry most up to date ANSI Z-133 and A300 standards and best management practices (BMPs).

5.2. On-Site Supervisor

5.2.1. As a minimum, the contractor must provide one on-site supervisor to direct all contract personnel and maintenance operations.

5.2.2. The on-site supervisor shall be fluent in the English language in order to effectively communicate with the contractor’s employees and/or subcontractors as well as the COR and other Government personnel.

5.2.3. If the on-site supervisor is not present or absent due to illness or other reasons, the contractor shall provide an alternate supervisor to manage and direct all contract personnel and operations. The alternate supervisor shall possess the same qualifications as the on-site supervisor.

5.2.4. The onsite supervisor shall be available for phone calls during all working hours.

5.2.5. A current ISA Certified Arborist shall be on the job site at all times during operations and shall be the primary contact with the Government's technical representative responsible for controlling the quality of work and inspecting all completed work in order to ensure that contract performance requirements are met. The contractor shall provide the arborist’s certification ID for verification before work begins, and any time there is a change in the onsite arborist. Certification and currency will be subject to verification by the government utilizing the ISA database.

5.3. PERSONNEL QUALIFICATIONS

5.3.1. Personnel qualifications include, but are not limited to, being knowledgeable/capable of pruning, removing, and stump grinding of trees and hedges as well as other landscape and vegetation maintenance. The contractor shall make no substitutions or subcontracts without obtaining prior approval from the Contracting Officer.

5.3.2. Contractor shall, without expense to the Government, be responsible for obtaining any necessary licenses and permits, and complying with all applicable Federal, state and municipal laws, codes and regulations.

5.4. Site Maintenance

5.4.1. The contractor shall maintain the work site in a safe, neat and orderly manner. All supplies and equipment on the project site shall be stored to preclude any damage.

5.4.2. Limited space may be provided for the storage of materials, which shall be stored in a clean and neat condition as approved by the COR. This is not guaranteed; thus, the contractor must be prepared to transit the entire operational footprint daily.

5.4.3. All mud, dirt, debris, foreign objects or spills of any kind from the contractor’s operations shall be cleaned up daily or as requested by the COR.

5.4.4. All contractor generated refuse and waste shall be hauled from the work site daily.

Refuse and waste material shall be hauled in trucks with tight fitting covers to prevent spillage on roadways.

5.4.5. It shall be the contractor’s responsibility to take whatever measures are necessary to assure the protection of the Government assets and to perform the work so as to cause minimal disruption of ongoing activities near occupied areas.

PART 6

APPLICABLE PUBLICATIONS

Contractor shall operate in a manner that keeps not only their employees safe but ensures the safety of the public, Park Service

Personnel and Park property.

Work is halted for unsafe practices, by the US Park

Police, NPS Safety Officers, and or NPS Urban Forester.

The Contractor is expected to provide high quality safe services.

If the contractor is found to continuously perform operations with unsafe practices, meaning work is halted until proper safety actions are taken, and delays or damages occur the contractor will be responsible for corrections and liability. This may include negative comments on CPARS and could possibly lead contract termination for cause.

1.7.12 Contractor

5.2-5.3 On-site

Supervisor and ISA

Certified Arborist, personnel qualifications

Contractor shall provide an on-site supervisor and ISA Certified

Arborist for all work and personnel qualified to carry out the work.

On-site supervisor meets qualifications and there is an

ISA certified Arborist on every job.

The Contractor is expected to provide certain positions for each time the work is performed.

If the contractor is found not to provide the key personnel, meaning services are will be rejected as not having been complete the contractor’s performance will be affected. This may include negative comments on CPARS and could possibly lead contract termination for cause.

5.4 Site

Maintenance Contractor is required to maintain the site in a certain manner while performing work.

Low Quality Deliverables

- site is not maintained and the contractor is continually instructed to correct the conditions

If the contractor is found to continuously provide low quality services, meaning they are consistently sent back for corrections to site conditions as expressed in the PWS and/or are late or not meeting the standards contractor performance will be affected. This may include negative comments on CPARS and could possibly lead contract termination for cause.
