PERFORMANCE WORK STATEMENT

Grand Teton National Park Moose, WY

PERMIT COORDINATION SERVICES –

TELECOMMUNICATIONS INFRASTRUCTURE

GENERAL INFORMATION

Confidentiality: The information developed under this Call Order is the property of the U. S. Government and shall be kept in strict confidence.

Performance Period: The work of this task order shall be provided from approximately July 12, 2021 through December 1, 2021.

Project Locations:

All work areas are located in Grand Teton National Park and the John D. Rockefeller Memorial Parkway in northwest Wyoming.

GENERAL DESCRIPTION OF WORK

Grand Teton National Park has received a right of way application from NPS Diamond, LLC to install and operate telecommunications infrastructure in Grand Teton National Park and the John D. Rockefeller Memorial Parkway. The permit involves new fiber optic cables from the Park headquarters in Moose, along the Teton Park Road to Jackson Lake Junction (Hwy 191/89), and then following Highway 191/89 north to the south gate of Yellowstone National Park. The NPS holds contracts with Diamon, LLC to install branch fiber lines into concessioner land assignments through the park. Also included are nine cellular sites in the areas of Kelly, Moose, Beaver Creek, South Jenny Lake, Jenny Lake Lodge, Signal Mountain Lodge, Jackson Lake Lodge, Colter Bay, Triangle X, and Flagg Ranch as well as NPS contracts to install fiber in branch lines in these locations.

The permittee is responsible to develop an implementation plan and schedule. They are responsible to lead status and issue resolution meetings, and to provide daily status updates per direction of the National Park Service. However, it is inevitable that issues will arise that required changes to the schedule or the implementation plan – and these changes may require rapid communication and coordination with NPS and concessioner staff. The Permit Coordinator needs to be able to rapidly anticipate how permit and contract activities will affect visitors and park/concessioner operations. The project coordinator can expect up-front time requirements (meetings and preparation) to understand the plan, and to build a relationship with the permittee, as well as park and concessioner staff.

The permit coordinator’s primary role is to provide NPS and Concession coordination with the permittee and contractor. Communicating schedules, construction activities, and identifying impacts to visitors, NPS, and concessioners will be critical for a successful season of park operations.

The work in this task order consists of two major Tasks in support of management of this permitted work.

Task 1 is communications and coordination of permitted construction and its impact on park operations and park visitors to concession areas. This task consists of meetings and status briefings to keep park staff and concessioners advised of ongoing and planned permitted construction, and developing alternatives with the permittee for potential solutions. This task includes reviewing installation plans as well as as-built plans. This task is intended to be primarily conducted by the Permit Coordinator (PC) with some tasks delegated to the Permit Coordinator Delegate (PCD) as appropriate.

Task 2 is site visits on concessioner land assignments during and after fiber installation and cell site work. This will include coordination and resolution of fiber line installation issues including termination points inside concessioner assigned historic buildings and installation of underground fiber lines in concessioner land assignments. This task is intended to be overseen by the Permit Coordinator (PC) and delegated to the Permit Coordinator Delegate (PCD) as appropriate.

All work shall be performed under a single contract.

GOVERNMENT PROVIDED MATERIALS

Available after contract award.

a. Permit and fiber contract documentation

EQUIPMENT REQUIRED

a. The Permit Coordinator (PC) shall provide the following equipment:

i. Communication Equipment:

1. Provide a cell phone for use in the project vicinity capable of voice mail, sending and receiving calls, local and long distance.

ii. All safety equipment (hard hats, orange safety vest, work boots, safety glasses, dust masks, etc.) for exclusive use of the PC/PCDs. Equipment must be provided as required by applicable Federal and State law. Equipment must be worn in accordance with construction site, OSHA, and NPS safety requirements.

iii. Each PC/PCD shall be equipped adequately to perform tasks necessary as part of general construction.

iv. Each PC/PCD shall have available for their use:

1. Digital camera

2. Clip board

3. Appropriate clothing and personal protective equipment

4. Personal or laptop computer

v. Each PC/PCD shall have appropriate means of transportation.

TASK 1: MEETING COORDINATION

Subtask 1: Site Plan and As-Built Review Review permittee’s implementation/installation plan and traffic plans including schedule.

Provide qualitative and constructive feedback of any concerns to concession operations or questions (in writing) to the COR Review As-Builts of fiber lines on concessioner land assignments and confirm accuracy or comments with COR.

Subtask 2: Project Status Meetings Attend recurring project status updates (estimated weekly, from 1 May – 1 Nov, each meeting approximately 1 hour) Provide input and analysis of permittee activity impacts on traffic, visitor activities, potential closures, movement of emergency response, concession operations, or other park activities.

Subtask 3: Site Kickoff Meetings:

Coordinate NPS, Concessioner, and Permittee attendance at site kickoff meetings at each developed area prior to start work (estimate 2 hours each for 10 different areas).

TASK 2: FIBER AND CELL SITE INSTALLATION COORDINATION

Subtask 1: Field Oversight and Recommendation The awardee shall provide site visits for the time period that work is in progress. The goal of the site visits are to review the work of the permittee for adherence to agreed upon site plans, building termination points, schedules, and site reclamation and to provide recommendations to the COR on proposed installation of fiber lines as it pertains to impacts to existing infrastructure and buildings. The work crews from the permittee include: two crews for fiber optic plowing, up to two crews for borings, up to two crews working on handholes, and up to two crews working on cell sites. On any given day, there may be up to 8 work locations between Jackson, WY and South Gate of Yellowstone National Park, the basis of estimate is an average of six active crew locations across the project duration. The PC/PCD will perform site visits to accurately perform coordination needs with NPS and concessioners. Site visits are expected to start upon initiation of the contract and end 1 December 2021and generally be performed 3 days per week. Permittee Work is intended to occur from 7:00am to 7:00pm, Monday through Friday. Some work may occur outside of this schedule, but will be irregular and require discussions prior to the work occurring.

Report to the COR regarding the status of the work, problems, disputes, etc. The PC/PCD shall promptly notify the COR of any problems or issues observed.

Notify the COR of work that changes from agreed upon site plans and building termination points.

Notify the COR of safety deficiencies and if a deficiency is life threatening, he/she may request that the work be stopped.

Interact with the permitee on the day-to-day activities of the construction.

Plan and coordinate site visits with the permitee to minimize impacts on construction operations, and confirm that agreed upon coordination occurs.

Provide an update (in writing) to the COR at the end of each week regarding work that occurred in the past 5 days and planned activities within the next 5 working days. Update the COR in writing as plans are changed by the permittee.

As part of site visits, track punch list closeout items from the permittee and confirm with COR on status and completion.

Quality Control Plan: The Contractor shall institute a Quality Control Plan (QCP) to ensure the requirements of this contract are provided as specified. The goal of the QCP should be to identify and correct any problems that may arise before they are identified by the CO or his/her representative. A written Quality Control Plan must be submitted to the Government at least 10 days prior to commencement of work and will be incorporated into the resultant contract identifying anticipated site visit schedule to cover work, communication plans for various coordination and feedback requirements, and key points of contacts from concessioners/NPS for coordination planning. At a minimum the QCP should include:

An communication plan for various coordination requirements.

A system for identifying and correcting deficiencies and/or a pattern of deficiencies in the quality or quantity of services provided. This shall include providing consistency and precision among coordination efforts and document reviews.

A file system to maintain/record documentation of coordination and reviews. Coordination and review documentation must be kept current and made available to the CO upon request.

Subtask 2: Issue Resolution Background: In general, the resolution of fiber line installation issues is the responsibility of the permittee. These could range from final determined locations to install underground utility to building entry/termination points on structures.

Work with the concessioner, NPS, and permittee to anticipate impacts of planned work and work with all parties to recommend changes to work and plans to avoid issues.

Ensure the permittee is immediately notifying the concessioner and NPS per permit protocol of unanticipated damage to any park infrastructure or utilities.

Notify the COR and obtain a point of contact from each concessioner. Participate in dialogue between NPS, permittee, and concessioner. Inform COR of the status of the dialogue and advise if NPS direction is implement in the field by the permitee.

This work is estimated to be 20 hours of labor.

QUALIFICATIONS

Permit Coordinator (PC)- Shall have the following minimum knowledge, skills, abilities and experience:

Shall possess one of the following minimum qualifications:

Registered Professional Engineer; or Bachelor Degree in Civil Engineering or Construction Management with 3 years on-site project administration; or minimum of 5 years of progressively responsible experience in exterior construction projects including at least 3 years as a Project or Resident Engineer on State or Federal construction or equivalent projects.

Current NICET Certificate - Level III (Construction), and an Associate Degree in Engineering Technology with a minimum of 7 years of increasingly responsible construction inspection experience, of which at least 5 years must have been on exterior construction projects as assistant to the project supervisor or as a principal inspector.

Ten years increasingly responsible experience as inspector, project engineer, or the equivalent, on city, county, state or federal highway or similar construction, with specific experience in exterior concrete, asphalt and roadway construction.

Permit Coordinator Delegate (PCD)- Civil Engineering Technician, as defined by the US Bureau of Labor (https://www.bls.gov/ooh/architecture-and-engineering/civil-engineering-technicians.htm#tab-1):

a. Shall possess one of the following minimum qualifications:

1. Associates Degree in Civil Engineering or Construction Management with 3 years on-site project administration; or minimum of 5 years of progressively responsible experience in exterior construction projects.

2. Current NICET Certificate - Level II (Construction), and an Associate Degree in Engineering Technology with a minimum of 5 years of increasingly responsible construction inspection experience, of which at least 3 years must have been on exterior construction projects as assistant to the project supervisor or as a principal inspector.

3. Five years increasingly responsible experience as Inspector, Project Engineer, or the equivalent, on city, county, state or federal highway or similar construction, with specific experience utility construction.

B. The permit coordinator delegate should have good judgement and communications skills. Experience leading or managing complex undertakings (not necessarily construction) is strongly desired. Work experience should includes some level of job-site superintendence.

VIII. PROTECTION OF INFORMATION

a. Performance under this contract may require contractor access to data and information proprietary to the National Park Service, another government contractor, concessioner, or of such nature that its dissemination or use, other than as specified in this contract, would be adverse to the interests of the Government and/or others. Employees shall not divulge or release data or information developed or obtained under performance of this contract, except to authorized government personnel or upon written approval of the CO. Employees shall not use, disclose or reproduce proprietary data other than as specified in each task order.

b. Inquiries received by the Contractor for work performed under this contract shall be referred to the COR for evaluation under the Freedom of Information Act. The Contractor is responsible for search and submission of records upon request by the COR.

IX. REPLACEMENT OF PERSONNEL

All changes in assigned personnel will be subject to approval by the CO.

a. The CO shall have the authority to require the replacement of any Contractor personnel not exhibiting integrity, capability, responsibility, or reasonable safety in their job performance; see FAR Clause 1252.237-70, Qualifications of Contractor Employer. For the purposes of this contract, on-site contractor employees have the same restrictions as Federal Employees in regards to 5 U.S.C. §§ 7321-7326, the Hatch Act. Unsuitable job performance includes but is not limited to the following:

i. The PC does not report to their assignment for the scheduled work hours.

ii. The PC employee is late by ½ hour or more two times in any four-week period.

iii. The PC causes a safety hazard at the work site.

iv. The PC deliverables consistently contain errors, are incomplete, or services provided are below the required standard of performance.

v. The PC does not exhibit adequate capability in performing the work.

vi. On-site PC employees do not follow the restrictions of the Hatch Act. (Partisan Politics)

vii. Improper use of Government property, including items such as the telephone, computer, facsimile, and copier.

b. A PC removed due to Government determination of unsuitability shall be replaced within 5 calendar days.

X. PERSONNEL REQUIREMENTS

A. PERSONNEL

The Contractor shall employ personnel qualified and capable to perform these services as required under this Performance Work Statement. All personnel providing services inside the buildings shall be permitted to work in the United States and shall be able to read, speak, write, and understand the English language. The Contractor shall ensure that all employees are legal residents of the United States. Personnel providing services under this contract shall not be considered employees of the Government. All employees assigned by the Contractor to perform work under this contract shall be physically able to do the assigned work during the entire period of the contract.

All contract personnel attending meetings, and working in other situations where their contractor status is not obvious to third parties are required to identify themselves as such to avoid creating an impression in the minds of members of the public that they are Government officials. They must also ensure that all documents or reports produced by contractors are suitably marked as contractor products or that contractor participation is appropriately disclosed.

B. UNIFORMS

The contractor and their subcontractors shall require all employees, including supervisors, to wear distinctive uniform clothing with the contractor’s name for ready identification. At all times during contract performance contractor personnel shall wear a shirt or vest with the company logo and name. Every employee is to be in uniform no later than ten working days from the date an employee first enters on duty. Uniforms shall be clean and neat in appearance and well maintained (free of visible dirt, stains, tears, rips, fraying, missing buttons etc., and shall be worn presentably – i.e. buttoned tucked-in if applicable, collars turned down and worn neatly). Employees must be neatly groomed and presentable (hair worn neatly and presentably, clean and free of odors and dirt and stains, manicured with clean clothes and shoes, etc.). The Government reserves the right to approve the uniform recommended by the Contractor.

C. CONDUCT OF PERSONNEL

Contractor personnel's conduct shall not reflect discredit upon the federal government. The Contractor shall remove any employee for any violations of law or Park Service regulation from the jobsite as determined by the Contracting Officer or Park law enforcement. The removal from the job site of such a person shall not relieve the Contractor of the requirement to provide sufficient personnel to perform adequate and timely service.

D. THE CONTRACTOR SHALL NOT

Employ any person who is an employee of the United States Government if the employment of that person would create a conflict of interest.

E. WILDLIFE AND BEAR AWARE TRAINING FOR CONTRACTOR EMPLOYEES

The contractor shall attend a training session put on by NPS personnel regarding working within bear-frequented areas and within the National Park and around wildlife. At a minimum, the contractor shall have the Representative and all employees that shall work on this project attend the training. Contractor shall request to the COR a proposed date prior to beginning work for the training. Training shall cover how to handle and dispose of properly – waste and any other wildlife attractants, and to properly close doors and windows when working within the National Park.

XI. REVIEW PROCEDURES

Review by the Government of all coordination including phone calls, written correspondence, and document reviews will be reviewed by the COR and inaccuracies, inconsistencies, or conflict with the QCP will be called to the attention of the Contractor.

Correction of all deficiencies will be made prior to additional reviews and acceptance of work by the Government in conformance with the performance standards.

Any Government personnel may observe unacceptable services, incomplete work, or required services not performed and may contact the CO or the COR to communicate a complaint. Customer complaints will be substantiated by the COR for validity. Should the COR determine that the complaint is valid, the COR will inform the Contractor orally and in writing. Refer to the Performance Requirements Standards Summary Tables for remedy for non-conforming services. Unresolved disputes shall be forwarded to the CO for determination.

XII. FEE AND PAYMENT

a. Workmanship shall be of an acceptable quality such as would be found in a business office visited by the general public and meet the acceptable quality level (AQL) listed in Performance Requirements Summary Matrix.

b. Payment will be made monthly for work meeting or exceeding the Acceptable Quality Level completed and accepted by the Government covering the previous months' service. Request for progress payment shall be made on the basis of monthly-itemized invoices submitted for completed work. Upon acceptance, the Government will pay monthly the appropriate amount based on the percentage of contract completion.

c. Deductions – Anytime the performance of services falls below the AQL, a deduction for services that cannot be re-performed or are performed late will be made based on the level of service provided for that month. If the performance AQL is 95% for a particular deliverable item and that item is missed or the acceptable performance level drops below the AQL, the amount due for that pay item will be reduced to the appropriate level of acceptable performance for service provided for that month based on number of days in that month.

d. Invoices shall include a description of the work task, personnel involved, the dates and hours worked.

e. Payment shall not be made in excess of the ceiling price unless the CO authorizes a revision to the ceiling price in writing.

f. Invoices shall be submitted electronically through the U.S. Department of the Treasury’s Invoice Payment Platform (IPP) (https://www.ipp.gov/), after review of the draft invoice by the COR .

g. The following supporting documentation is required as an attachment for backup with each IPP invoice:

i. Record of Site Visits(Task 2, Subtask 1)

h. PC registration is required to access the IPP. The PC Government Business Point-of-Contact (as listed in the System for Award Management (SAM) System (formally the Central Contractor Registration (CCR) System)) will receive enrollment instruction via email from the Federal Reserve Bank of Boston (FRBB) within 3-5 business days after contract award. PC assistance with enrollment can be obtained by contacting the IPP Production Helpdesk via email ippgroup@bos.frb.org or phone (866) 973-3131.

i. If the PC is unable to comply with the requirement to use IPP for submitting invoices for payment, the PC must submit a waiver request in writing to the Contracting Officer with its proposal or quotation.
