NATIONAL MALL AND MEMORIAL PARKS

DUMPSTER SERVICES ON-CALL & DEBRIS DISPOSAL

1. BACKGROUND

The National Park Service, National Capital Region, National Mall and Memorial Parks (NAMA) requires a contract for the collection, disposal and/or recycling of solid waste and waste in the form of logs, brush, limbs, wood chips, trunks, stumps which may exceed 48” in diameter, organic debris from river (driftwood, limbs, tree pieces, etc.), dirty soil, concrete, asphalt, rocks, leaves and other trash generated on Government owned and operated premises located within the District of Columbia. Routine monthly reports of the nature of the materials, agreed upon measurements of materials, and description of processing facility for all recycled materials under this contract is also required. This contract will be a one (1) year base year, plus four (4) option years for a total of five (5) years.

2. PURPOSE

The purpose of this contract is to provide dumpsters for the National Park Service to load and call for pick up by the contractor who will properly dispose of and provide receipts and weight tickets of debris type, where it was recycled/disposed of and quantity of any recycled materials by category as well as collect and properly dispose of solid waste for the National Park Service, National Mall and Memorial Parks, Washington D.C. The services represent routine monthly waste removal and recycling services as well as separately priced “on-Call” services for unanticipated requirements such as severe storms or new construction.

3. LOCATION

All work is located in the National Mall and Memorial Parks:

A. East Potomac Maintenance Yard – 1100 Ohio Drive, SW, Washington, D.C.

B. Brentwood Maintenance Yard – 515 New York Avenue, NE, Washington D.C.

C. Hains Point Bone Yard D. National Mall and Memorial Parks Washington DC.

4. SCOPE OF WORK

Independently, and not as an agent of the government, the contractor shall provide the National Park Service, NAMA, with all labor, supplies, materials, equipment and travel, and containers necessary for the collection of refuse, garbage, construction material, and debris listed in this Scope of Services. The work shall include but is not limited to the following:

A. Provide covered dumpsters at the following sites that will remain on site to be filled by Park employees and picked up and emptied on call or routine by the contractor.

a. Brentwood Maintenance Yard – 515 New York Avenue, NE, Washington D.C.

i. One (1) 30-yard covered dumpster for construction wood debris, nails, etc. Pickup is on-call.

ii. One (1) 30-yard covered dumpster for concrete, asphalt, bricks etc. Pickup is on-call.

iii. One (1) 30-yard covered dumpster for drywall, plastic, miscellaneous construction materials, etc. (not metal). Pickup is on-call.

b. East Potomac Maintenance Yard – 1100 Ohio Drive, SW, Washington, D.C.

i. One (1) 30-yard covered dumpster for tree debris. Pickup is on-call.

ii. One (1) 30-yard covered dumpster for wood debris, pallets, plastic trash. Pickup is on-call.

iii. One (1) 40-yard covered compactor for solid waste Model #42-50 or approved equal. Pickup is weekly on Thursday. Area around compactor must also be maintained to be clean and obstruction free. All Trash and debris must be picked up and swept up within 10 feet of dumpster and if spilled while loading.

c. Hains Point Bone Yard

i. This will be for drop off call as needed 20-40 yard covered dumpsters.

d. National Mall and Memorial Parks Washington DC.

i. This will be for drop off call as needed 20-40 yard covered dumpsters.

B. The Government will collect the debris throughout the Park and take what is collected to a holding station (Hains Point Bone Yard). The type of debris shall include but is not limited to be hauled away includes various items associated with roads and grounds maintenance - logs, brush, limbs, wood chips, and trunks, stumps which may exceed 48” in diameter, organic debris from river (driftwood, limbs, tree pieces, etc.), soil (mixed/unclean), concrete, asphalt, rocks, and leaves.

C. The compactor trash consists of office waste and what the public visitors leave behind after picnics and recreation – paper plates, napkins and other paper products, food scraps, charcoal ashes, plastic bags and wrappings, trash left at memorials and parks throughout the Park, etc. This compactor will be emptied weekly on Thursday. Pick up and drop off must occur between 8am and 2:30 pm. The area around the compactor (20ft) must be maintained by contractor to be free of all trash, litter, and debris.

D. The contractor shall be responsible for the delivery, maintenance, and removal of containers and equipment, throughout the contract period. All containers shall be maintained in an operable condition as to close properly, prevent vermin form entry, and prevent leakage. The containers must not emit unpleasant odors, as identified by the Park contract officer’s representative. Issues shall be corrected immediately by the contractor at the contractor’s expense.

E. Contactor will be notified of need for pickup by phone and the pickup will be scheduled within 24 hours of notification for all other containers throughout Park.

F. Once the contractor has picked up the dumpster it is their responsibility to properly dispose of the material in compliance with all Federal, state, local, and National Park Service environmental and occupational safety laws, rules, and regulations.

G. The contractor shall email the weight tickets after every pull to the COR within a 24 hours of a pull.

H. All containers shall be approved by the Park COR before use.

I. The government will not be held responsible for damage to the contractor’s equipment. All contractor equipment shall be properly maintained by the contractor to minimize mechanical problems and breakdowns.

J. Contractor shall remove all containers belonging to the contractor from the Park upon expiration of this contract.

K. Additional 20 to 40 CY open top dumpsters with covers shall be provided by contractor upon request to areas within the Park for special projects/events and/or emergencies.

L. Contractor shall provide monthly reports stating how much of each recycling material is collected per month. The report shall be in a mutually agreed upon format and reflect the nature of the materials, tonnage or other agreed upon unit measurements, and brief description of the processing facility for all recycled materials to include metal plastics, construction materials, and wood collected under this contract. Monthly reports shall be submitted with the monthly invoice and must be legible.

M. The contractor shall identify all disposal sites and facilities used for waste disposal before contract performance. The contractor shall inform the COR at time of contract award any past or ongoing violations that have occurred at sites used. The contract must notify the COR of the specific violations, how they were rectified, if violations are ongoing, and whether they are still using that particular disposal site or facility.

N. If at any time during the course of this contract, a disposal site(s) used by the contractor receives a Notice of Violation, the contractor shall immediately notify the COR.

O. All contractor tickets for container pickups shall be given to the COR as proof of services performed. The contractor shall indicate on the ticket their company name, truck number, date and container pickup location. Both the authorized Park site representative and the contractor’s driver shall sign the ticket upon completion of the pickup(s). The contractor shall leave one (1) copy of the ticket with the Park site representative. Another copy shall be submitted with the contractor’s monthly invoice through IPP.gov. This must be done for every pickup before the driver leaves with the container.

P. The Contractor shall be accountable for the tickets. If a ticket is voided or lost, the contractor shall furnish the COR with the voided ticket or written explanation for the lost ticket. Legible copies of the tickets given by the landfill/transfer station for dumping containers must accompany itemized invoices. The weight of the roll-off container’s contents, the size of the container and the location of where it was picked up must be specified on the ticket.

Q. Container Type. Containers shall be washable, without holes, leak proof with tight-fitting lids, durable workable wheels and with all operable plugs. Containers shall have a tightly fitted lid or cover to prohibit entry into the containers by animals.

R. Delivery of containers upon contract award will be scheduled with the COR.

S. The contractor shall leave the service loading area at each Park site in a clean and orderly condition. Contractor shall pick up trash that is in immediate area (10 feet) of containers after each pickup.

T. Contractor vehicles, containers, equipment and employees must meet all local, state, and federal laws and regulations. The government is not responsible for any vehicles, containers, equipment or employee acts that break any local, state, or federal law and/or regulation; all incidents are at the expensive of the contractor.

U. Contractor shall repair or replace any portion of loading docks, building structures, or landscape features, damaged by contractor in the performance of this contract. Such damaged areas or materials shall be restored, repaired or replaced by the contractor to original condition, and to the satisfaction and as directed by the COR, at no expense to the Government.

5. PERSONNEL QUALIFICATIONS

A. Qualified personnel are essential for the performance of this contract to ensure that requests for waste pick-ups are responded to in a prompt, responsive, and safe manner. All contractor personnel performing under this contract shall be able to speak English and communicate effectively.

B. The contractor shall provide drivers, as well as, other employees necessary to work under this contract that have participated in organizational driver training and safety programs. Every driver performing under this contract shall possess a current commercial driver’s license (CDL).

C. All contractor personnel performing work under this contract shall be uniformed in a manner customary to the contractor that shall at a minimum identify the company name and, if applicable, corporate logo.

D. The contractor shall supervise the removal, transportation, and disposal of the solid waste to ensure compliance with the terms and conditions of this contract.

E. The contractor shall be responsible for the maintaining satisfactory standards of employee competency, conduct, appearance, and integrity. The contractor shall be responsible for taking disciplinary actions with respect to contractor’s employees as may be necessary.

F. The COR may require removal from the job site contractor’s employees deemed to be unsuitable or otherwise objectionable, or whose continued employment under this contract is deemed to be contrary to the public interest or inconsistent with the best interests of the Government.

G. The NAMA safety Officer or U.S. Park Police, independent of the COR, may issue a stop work order for any action they determine to be unsafe potentially endangering human life or natural or cultural resources of NAMA. These official will be required to inform the COR who will be the focal NPS contact for notifying the contractor’s supervisory representative of the issue at the earliest opportunity.

H. All vehicles used by the contractor shall be clearly marked with the contractor’s company name along with wording including the type of work the company performs.

5.1 DELIVERABLES

Contractor will submit with bid:

· Communication plan with the Contracting Officers Representative (COR) to ensure response time and contract fulfillment.

· Method of how invoices will be broken out showing: what was pulled; where it was pulled; when it was pulled; weight ticket; and the how and where the debris was processed/dumped.

· How the contractor will ensure that the COR has a signed ticket for all pulls before the driver leaves with a container.

· How the contractor will ensure that a weight ticket is emailed to the COR within a day of a pull being conducted.

· How the contractor will ensure that all invoices are submitted to the COR by email for approval with legible weight tickets and a break down of all recycled materials before they are uploaded through IPP.gov.

· The method of reporting recycled material type, tonnage and location of recycling.

· The contractor will explain their record keeping methods/software and how the Park would be able to access records if needed.

· Contractor will provide their equipment lists to include dumpster and vehicle inventory to ensure they have enough and correct equipment for the fulfillment of the contract.

6. CONTRACTING OFFICER'S REPRESENTATIVE (COR)

For the purpose of this contract, the COR will be announced at the time of award. The COR is responsible for: (1) monitoring the contractor's technical progress including the surveillance and assessment of performance and recommending to the Contracting Officer changes in requirements; (2) interpreting the Scope of Work; (3) performing technical evaluation as required; (4) performing technical inspections and acceptances required by this contract; and (5) assisting the Contracting Officer in the resolution of technical problems encountered during performance.

THE CONTRACTING OFFICER IS RESPONSIBLE AND HAS THE SOLE AUTHORITY FOR DIRECTING AND/OR NEGOTIATING ANY CHANGES IN THE TERMS, CONDITIONS, OR AMOUNTS CITED IN THE CONTRACT. INCREASES IN THE SCOPE OF WORK SHALL BE APPROVED ONLY BY THE CONTRACTING OFFICER

For guidance from the COR to the contractor to be valid, it must: (1) be consistent with the description of work set forth in this CONTRACT; (2) not constitute new assignment of work or change to the expressed terms, conditions, or specifications. incorporated into this contract; (3) not constitute a basis for an extension to the period of performance or contract delivery schedule; and (4) not constitute a basis for any increase in the total contract value.

8. CONTRACTOR'S REPRESENTATIVE

Upon contract award, the Contractor shall provide to the CO, the name, phone number and cellular phone number of the Contractor's representative and an alternate contact who is responsible for overseeing the performance of this contract. This person must be able to make decisions for the company. The Contractor's representative will report to the COR.

9. PERIOD OF PERFORMANCE

The period of performance for this contract shall be from date of award to one calendar year. The Government will retain the right to award up to 4 (four) subsequent option years based on need and past performance of the awarded vendor.

10. COORDINATION AND SCHEDULING OF WORK

All work is to be scheduled and coordinated through the Contracting Officers Representative. Weekly pick-ups at East Potomac Maintenance Yard will occur every Thursday between the hours of 8:00 a.m. and 2:30 p.m. On-Call work shall be scheduled in advance so that proper access to the area can be provided and shall be performed Monday through Saturday, between the hours of 8:00 a.m. and 2:30 p.m. On-call services shall have a twenty-four (24) hour response time after notification.

11. GENERAL LIABILITY INURANCE

The contractor shall be responsible for securing general liability insurance which will protect the government from any claims, or litigation connected with any injury or damage resulting from his/her (and all subcontractors) actions while working under this contract, and further agrees to save and hold harmless the government, its agents and employees, from any and all claims, damages, suits at law or equity of whatever kind of nature from damages to or loss of property or injury or death to persons resulting directly or indirectly from attributable to the contractor in connection with this task order.

12. TRAVEL

The contractor shall be responsible for all travel necessary to complete the work described in the Scope of Work.

13. LOSS OR DAMAGE

If due to fault, neglect, dishonesty of the contractor, his agency or employees, loss or damage to government property is incurred during the performance of this task order, the contractor shall be responsible for the same. The government, at its option, in lieu of repayment, may require the contractor to replace at his own expense, all property as directed by the Contracting Officer.

14. SAFETY

The work area shall be maintained in a clean and safe condition at all times. All personnel providing service on-site shall have pictured identification and uniform displaying the name of the company. All on-site vehicles will also be marked with the company name. The contractor shall, with the use of barricades, ropes, signs, or audible signals, take all necessary precautions for the protection of the work and safety of the public. Any accident or incident, in regards to the work under this task order, shall be reported immediately, in writing, to the Contracting Officer in accordance with FAR 52.236-13 Accident Prevention (NOV 1991).

A. The contractor shall provide safety controls to protect the life and health of contractor and Park employees and any other persons within the area where the contractor is working or travelling in NAMA, as well as for the prevention of damage of property, materials, supplies, equipment and natural and cultural resources in the performance of this contract. The contractor shall comply with all pertinent provisions of the Occupational Safety and Health Administration (OSHA) Standards, 29 CFR 1910 (with emphasis on Subpart T – Commercial Driving Operations) and any pertinent federal and local codes and requirements. All OSHA requirements may be obtained without cost to the general public at www.osha.gov. The contracting officer or NAMA Safety Officer may include additional measures if determined necessary or required by other federal, state or local law, or Park policy.

B. All employees shall wear the appropriate ANSI class reflective vest while doing work within 10ft of a traveled roadway as prescribed under 23 CFR Part 634.2.

C. Contractor shall submit a comprehensive written safety plan for dealing with; (1) on-the-job accidents and injuries involving his employees, (2) protection of Park employees and the public during maintenance operations, (3) any environmental safeguards needed, and (4) notification and reporting procedures.

D. The contractor shall have applicable licenses and permits necessary to perform the work required under this contract prior to the start of performance. Copies of all such permits and licenses shall be current. The contractor shall provide to the COR when requested, specifically, but not limited to, proof of all licenses, State and local permits, as well as, copies of organizational participation in driver training programs and safety programs. Contractor shall provide evidence that every driver performing under this contract has a current CDL.

E. Contractor shall, without expense to the Government, be responsible for obtaining any necessary licenses and permits, and complying with any applicable Federal, State and municipal laws, codes and regulations.

F. The contractor must submit to the CO proof of insurance coverage at contract award in the amount and format as stated within Clause No. 1452.228-70, Liability Insurance-Department of Interior.

G. The contractor shall perform operations associated with this contract in accordance with all current State/Federal environmental protection regulations applicable to the management of solid waste.

15. GOVERNMENT FURNISHED PEROPERTY

The government will provide laydown sites for dumpsters as well as access to the dumpsters.

16. INVOICE REQUIREMENTS

Acceptance will be given by the COR after an inspection and verification of the work performed as defined in the contract specifications. The contractor must submit their invoice by email to the COR for approval to upload through IPP.gov for processing.

The Contractor shall submit all invoices through www.ipp.gov as well as upload a copy of the invoice as an attachment through IP. Invoices must be submitted on a monthly basis and have the monthly report stating how much of each recycling material is collected per month as well as tonnage of all debris types. The report shall be in a mutually agreed upon format and reflect the nature of the materials, tonnage or other agreed upon unit measurements, and brief description of the processing facility for all recycled materials. Failure of submitting the report will mean the government will reject the invoice until the report is submitted. Failure of the contractor to attach the invoice through IPP.gov will result in the invoice being rejected.
