About this file
This document is a Justification and Approval (J&A) for the use of other than full and open competition due to a requirement that can only be fulfilled by brand name items. The Marine Corps Logistics Command is procuring brand name specific items to support the retrofit of vehicles in order to comply with the European Agreement Concerning the International Carriage of Dangerous Goods by Road (ADR). The estimated value of the procurement is $885,000, to be funded by Navy Working Capital Funds. The rationale for the brand name justification is that the specified items are not available through mandatory sources. Market research determined that the brand name parts were unavailable, thus justifying the use of the simplified acquisition procedures under 41 U.S.C. 1901. The Contracting Officer has determined the anticipated cost to be fair and reasonable based on previous contracts for similar items.
The related federal contract opportunity is a solicitation for the brand name ADR Kit items, under a Total Small Business set-aside. The basis for award is Lowest Price Technically Acceptable, with only quotes for the brand name product being considered.

JUSTIFICATION AND APPROVAL
FOR USE OF OTHER THAN FULL AND OPEN COMPETITION
J&A No. 15010
1. Contracting Activity.
Marine Corps Logistics Command (MARCORLOGCOM), Contracts Department Albany, GA.
2. Description of Action Being Approved.
This is a Justification & Approval (J&A) for the use of other than full and open competition due to the requirement only being able to be fulfilled by brand name items. The approval of this justification will result in a Firm-Fixed-Price (FFP) contract.
3. Description of Supplies/Services.
Marine Depot Maintenance Command (MDMC) has requested the procurement of brand name specific items to support the retrofit of vehicles in order to comply with the European Agreement Concerning the International
Carriage of Dangerous Goods by Road (ADR). The procurement of these brand name items will ensure the readiness of MDMC’s capabilities and maintain the specifications of the items previously bought by Marine Corps Systems
Command.
The estimated dollar value covered under this (J&A) is $885,000 which will be funded with Navy Working Capital
Funds (NWCF), as shown in Table 1 below.
Table 1: Estimated Dollar Value
FY24 Total
NWCF $885,000.00 $885,000.00
4. Statutory Authority Permitting Other Than Full and Open Competition.
FAR Subpart 13.5 procedures are being utilized for this acquisition in accordance with 41 U.S.C. 1901 as implemented by
FAR 13.501(a)(ii).
5. Rationale Justifying Use of Cited Statutory Authority.
The requiring activity specified that this requirement could only be met by brand name items due to the specifications required by the vehicles operating under the ADR. Additionally, market research concluded that the brand name parts were unavailable through the mandatory sources, thus justifying the use of 41 U.S.C 1901 for this acquisition.
6. Description of Efforts Made to Solicit Offers from as Many Offerors as Possible
In accordance with FAR Part 10, market research conducted through the mandatory and suggested sources of supplies, resulted in a non-availability of vendors capable of supplying supply the required items. Furthermore, a search of the FPDS-NG and EDA websites, resulted in contracts W912LD13F0030 and SPRDL123C0077 which demonstrated the availability of similar items however, there were no results regarding the brand name items that were searched for.
The specifications submitted to the contracts department, required the items being procured to be fulfilled by foreign brands and therefore will be best suited for a brand name justification to promote as much competition as possible within the open market, while ensuring the exact items are being quoted for.
7. Determination of Fair and Reasonable Cost.
The Contracting Officer has determined the anticipated cost to the Government for the supplies covered by this J&A as fair and reasonable based on the pricing found in contracts for similar items W912LD13F0030 and SPRDL123C0077.
