Justification and Approval for Sole Source and Brand Name Justification for Simplified Acquisitions – FAR Part 13
1. Contracting Activity: The United States Army Corps of Engineers (USACE) Engineer Research and Development Center (ERDC) Contracting Officer located at 3909 Halls Ferry Rd, Vicksburg, MS 39180-6190.
2. Description of Action : The Geotechnical and Structures Laboratory (GSL) has a requirement for annual software maintenance and upgrades to their existing versions of the TEMA software upgrade is requested due to the compatibility with the IEEB’s current, existing high-speed cameras and TEMA motion plane wands. The requested upgrades also require continuous updates and bug fixes throughout that exercised upgrade year. These annual software upgrades are vital to calibrate objects captured on video in a 3D space and will provide necessary improvements to the current equipment by enabling the wands to be calibrated to collect object trajectory data in a 3D environment. This software is used in the calibration of high-speed cameras for measuring the speed of projectiles during IEEB’s penetration research.
3. Description of Supplies/Services: TEMA Service Agreement and upgrade from TEMA software version t2023b to T2024b with options for 4 additional annual maintenance and upgrades to software through t2028.
Exercised options include any continuing updates/bug fix releases of existing imaging systems and licenses throughout that year.

4. Authority Cited: 41 USC 1901 as implemented in Federal Acquisition Regulation 13.501(a)(1) Sole Source or Brand name acquisitions of commercial supplies or services obtained using simplified procedures as applied in FAR Part 12.
5. Reason for Authority Cited: Extensive research was conducted to determine the best commercially available software that can measure 3D projectile trajectory data useful for penetration research conducted at the ERDC. As a result, in 2017, TEMA was determined the best to fit the requirements for the IEEB penetration research team. Overall, it has been determined that it is more advantageous for the government to upgrade existing TEMA hardware with software upgrades than it would be to purchase to replace hardware and accompanying software.

6. Efforts to Obtain Competition: A Notice to of Intent to Sole Source will be posted on SAM.gov.
7. Actions to Increase Competition: This action is not available for competition due to the fact that Specialised Imaging, Inc. is the only source for this requirement. In early 2024, Specialized Imaging, the current contractor on W912HZ21P0077, brought it to the GSL’s attention that the TEMA Software developer, Image Systems Trackeye, no longer has representatives or distributors of their software. Therefore, it was simultaneously decided after a meeting with Specialized Imaging, that a new contract was needed to be awarded solely with the developer of the software, Image Systems Trackeye, Inc, since there are no other distributors.
8. Market Research: Specialised Imaging, Inc. is the only developer of the software. A notice of intent to sole source will be publish on SAM.gov. There were no responses.
