Project Funding: A substantial source of funding for this project is Community Development Block Grant (CDBG) funds, which are federal funds awarded to the Village from the U.S.

Department of Housing and Urban Development (HUD). The contractor shall comply with CDBG requirements and may be asked to provide additional information to the Village for compliance with HUD.

Project Description: The following is a description of the improvements:

• These improvements include the removal and replacement of existing sidewalk sections, removal and replacement of existing driveway aprons, regrading and restoration of parkway, and maintenance and removal of erosion and sediment control measures along the following routes within the Village of Schaumburg: Covington Place, Alpine Drive, Elgin Lane, Ellington Drive, Elm Drive, Amboy Lane, and Exmore Drive; as illustrated within the 2024 CDBG Sidewalk Project Location map.

MBE/WBE: MBE/WBE Contractors are encouraged to apply. Contractor should provide proof of MBE/WBE status. Regardless of MBE or WBE status, the Contractor shall provide HUD Form 2516 to denote Minority Business Activity for the Contractor and any Subcontractors. Form 2516 must be submitted prior to issuance of payment, Disadvantaged business enterprise (DBE) means an entity owned or controlled by a socially and economically disadvantaged individual as described by Public Law 102-389 (42 U.S.C.

4370d) or an entity owned and controlled by a socially and economically disadvantaged individual as described by Title X of the Clean Air Act Amendments of 1990 (42 U.S.C. 7601 note); a Small Business Enterprise (SBE); a Small Business in a Rural Area (SBRA); or a Labor Surplus Area Firm (LSAF), a Historically Underutilized Business (HUB) Zone Small Business Concern, or a concern under a successor program.

Labor surplus area firm (LSAF) means a concern that together with its first-tier subcontractors will perform substantially in labor surplus areas (as identified by the Department of Labor in accordance with 20 CFR part 654). Performance is substantially in labor surplus areas if the costs incurred under the contract on account of manufacturing, production or performance of appropriate services in labor surplus areas exceed 50 percent of the contract price.

Minority business enterprise (MBE) mean a business enterprise that is at least 51 percent owned by a minority group or groups including: a Disadvantaged Business Enterprise (DBE) other than a Small Business Enterprise (SBE), a Labor Surplus Area Firm (LSAF), a Small Business in Rural Areas (SBRA), or a Women's Business Enterprise (WBE).

Small business, small business concern or small business enterprise (SBE) means a concern, including its affiliates, that is independently owned and operated, not dominant in the field of operation in which it is bidding, and qualified as a small business under the criteria and size standards in 13 CFR part 121.

Women's business enterprise (WBE) means a business concern which is at least 51% owned or controlled by women. Determination of ownership by a married woman in a community property jurisdiction will not be affected by her husband's 50 percent interest in her share.

Similarly, a business concern which is more than 50 percent owned by a married man will not become a qualified WBE by virtue of his wife's 50 percent interest in his share.

False Information: The Contractor is advised that providing false, fictitious, or misleading information with respect to CDBG funds may result in criminal, civil or administrative prosecution under 18 U.S.C. § 1001, 18 U.S.C. § 1343, 31 U.S.C. § 3729, 31 U.S.C. § 3801 or another applicable statute. The Contractor shall promptly refer to City and HUD’s Office of the Inspector General any credible evidence that a principal, employee, agent, subcontractor, or other person has submitted a false claim under the False Claims Act or has committed a criminal or civil violation of laws pertaining to fraud, conflict of interest, bribery, gratuity, or similar misconduct involving CDBG funds. The Contractor shall ensure that contractual language in third party contracts enforces these provisions.

Access to Project Site and Records: The Contractor will provide access to the City, HUD, the Comptroller General of the United States, or any of their duly authorized representatives to any books, documents, papers, and records of the contractor which are directly pertinent to that specific contract for the purpose of making audit, examination, excerpts, and transcriptions. Contractor will retain all required records for three years after final payments are made and all other pending matters are closed.

The Contractor will provide suitable access to the project site at all reasonable times during construction to the City, HUD, the Comptroller General of the United States, or any of their duly authorized representatives. Contractor shall also meet all reporting requirements to allow City to comply with the Federal Funding Accountability and Transparency Act of 2006 (Public Law 109– 282).

Suspension and Debarment: The Contractor certifies that neither it nor any person or firm who has an interest in the Contractor’s firm is a person or firm ineligible to be awarded Government contracts, contracts or participate in programs pursuant to 2 CFR Part 180.

The Contractor agrees that no part of this work shall be subcontracted to any person or parties listed on the government-wide Excluded Parties List System in the System for Award Management (SAM), in accordance with the OMB guidelines at 2 CFR 180 that implement Executive Orders 12549 (3 CFR Part 1986 Comp., p. 189) and 12689 (3 CFR Part 1989 Comp., p. 235). In addition, CONTRACTORs shall ensure that contractual language in third party contracts enforce this provision.

Subcontracting: The Contractor shall take the following steps to ensure that, whenever possible, subcontracts are awarded to small business firms, minority firms, women's business enterprises, and labor surplus area firms described in Executive Orders 11625, 12432 and 12138, and 2 CFR part 200:

1. Placing qualified small and minority businesses and women's business enterprises on solicitation lists;

2. Assuring that small and minority businesses, and women's business enterprises are solicited whenever they are potential sources;

3. Dividing total requirements, when economically feasible, into smaller tasks or quantities to permit maximum participation by small and minority business, and women's business enterprises;

5. Using the services and assistance of the U.S. Small Business Administration, the Minority Business Development Agency of the U.S. Department of Commerce, and State and local governmental small business agencies.

Davis Bacon: The Contractor will comply with all applicable standards, orders, or requirements of the Davis Bacon Act, as amended (40 U.S.C. 3141-3148) as supplemented by Department of Labor regulations (29 CFR part 5). In accordance with the statute, contractors must be required to pay wages to laborers and mechanics at a rate not less than the prevailing wages specified in a wage determination made by the Secretary of Labor. In addition, contractors must be required to pay wages not less than once a week. (State prevailing wage rates required in these Specifications may be higher. Contractor and subcontractors shall pay whichever rate is higher.)

Upon award and prior to construction, the Contractor shall provide HUD Form 4720 to denote compliance with the wage decision. Any Subcontractors used shall also be required to submit HUD Form 4720.

Copeland Anti-Kickback: The Contractor will comply with the Copeland "Anti-Kickback" Act (40 U.S.C. 3145) as supplemented in Department of Labor regulations (29 CFR part 3). The Act provides that each contractor or subrecipient must be prohibited from inducing, by any means, any person employed in the construction, completion, or repair of public work, to give up any part of the compensation to which it is otherwise entitled. The Contractor and each Subcontractor must submit a weekly statement on the wages paid to each employee performing on covered work during the prior week.

Contract Work Hours and Safety Standards: Bidder will comply with Sections 103 and 107 of the Contract Work Hours and Safety Standards Act (40 U.S.C. 327A 330) as supplemented by Department of Labor regulations (29 CFR part 5). The contractor must compute the wages of every mechanic and laborer on the basis of a standard work week of 40 hours. Work in excess of the standard work week is permissible provided that the worker is compensated at a rate of not less than one and a half times the basic rate of pay for all hours worked in excess of 40 hours in the work week. The requirements of 40 U.S.C. 3704 are applicable to construction work and provide that no laborer or mechanic must be required to work in surroundings or under working conditions which are unsanitary, hazardous, or dangerous. These requirements do not apply to the purchases of supplies or materials or articles ordinarily available on the open market, or contracts for transportation or transmission of intelligence.

Section 3: The Contractor agrees to comply with HUD’s regulations in 24 CFR part 75, which implement Section 3. As evidenced by the submission of their bid, the Contractor certifies that they are under no contractual or other impediment that would prevent them from complying with the regulations. Noncompliance with HUD's regulations in 24 CFR part 75 may result in sanctions, termination of this contract for default, and debarment or suspension from future HUD assisted contracts.

The Contractor agrees to include contract provisions requiring compliance with Section 3 in any subcontracts issued in association with this project and agrees to take appropriate action upon a finding that the subcontractor is in violation of the regulations in 24 CFR part 75. The contractor will not subcontract with any subcontractor where the contractor has notice or knowledge that the subcontractor has been found in violation of the regulations in 24 CFR part 75.

Project Timing: Construction is scheduled to begin upon the proper execution of the contract documents, which includes the submission of insurance and bonds and approval from HUD. The substantial completion date, including all work, is June 21, 2024.

The final completion for all other ancillary work, including landscaping restoration or plantings, not including any additional work, shall be completed and ready for final acceptance and payment on or before June 21, 2024. Failure to comply with the deadlines for the substantial completion and final completion shall result in the enforcement of liquidated damages in the amount of $550.00 per day for each and every calendar day that these improvements remain incomplete, in accordance with the Special Provision, "Liquidated Damages", and Sections 108.05 and 108.09 of the Standard Specifications.

Construction Schedule: At the project pre-construction meeting, the Contractor shall submit for review and approval by the Engineer, a detailed construction schedule that shall clearly indicate the sequential procedure of work proposed to be followed to complete the work as required by the contract documents. In preparing the construction schedule, the Contractor shall follow the required completion date, calendar days, and any additional Special Provisions as specified relating to the construction schedule.

The construction schedule shall depict all work components and essential activities, the time required for the completion of each of the activities and the sequence and interdependence of each of the activities in a project timetable which will translate each project day into an ordinary calendar day. The Contractor shall maintain the construction schedule, and shall submit an updated schedule to the Engineer on a weekly, biweekly, or monthly basis as determined by the Engineer. No separate payment will be made to the Contractor for the creation and maintenance of the construction schedule.

Due to Special Events throughout the Village of Schaumburg, holidays and the schedule of local school districts, the Contractor will be restricted from working at or near specified locations as instructed by the Engineer or a representative of the Engineer. During the school year, the Contractor shall keep one sidewalk open on each street at all times, or provide signage for a pedestrian detour route. No separate payment or compensation will be made due to these restrictions.

The Village provides the public with construction schedules and project status through the Village’s web page. The Contractor shall provide construction related information in a format consisting of an E-mail, letter, or fax acceptable to the Engineer. The Contractor shall assume that this information shall be provided on a daily basis during construction and may change to a shorter time frame based on construction activity changes or a longer time frame based on construction inactivity. The Engineer shall determine the time frame and format to be provided by the Contractor.

Liquidated Damages: Should the Contractor fail to complete the work, including cleaning up, to the point of final acceptance of the work by the Engineer within the time specified in the Contract Documents for the Date of Completion and/or Date(s) of Substantial Completion, and agreed upon by the Contractor by accepting the Contract, or within such extra time as may be allowed in accordance with the Contract Documents, there shall be deducted from any monies due the Contractor, or that may become due the Contractor, the sum(s) of $550.00 per day for each and every calendar day, including Sundays and holidays, that the work remains uncompleted.

This sum shall be considered and treated not as a penalty but as fixed, agreed, and liquidated damages due the Village from the Contractor by reason of inconvenience to the public, added cost of supervision, and other items which may have caused an expenditure of funds resulting from his failure to complete the work within the time specified.

The Village shall charge the Contractor, and may deduct from partial and final payments for the project, for all Engineering and Inspection expenses incurred by the Village in connection with any work accomplished after the Date of Completion as specified in the Contract Documents.

Permitting the Contractor to continue and finish the work, or any part of it after the time fixed for its completion, or after the date to which the time of completion may have been extended, shall in no way operate as a waiver on the part of the Village of any of its rights under the Contract.

Utility Location: The Contractor must exercise extreme caution while working around existing utilities. The Contractor shall notify JULIE (1-800-892-0123), a minimum of 48 hours before commencing construction for utility locations within the scope of the project. It is recommended that the Contractor conduct a joint utility meeting. It is the responsibility of the Contractor to contact all agencies who may or may not be part of the JULIE system to verify the location of their facilities.

The Village does not guarantee the accuracy or completeness of this information. The Contractor shall make his own investigation to determine the existence, nature, and location of all utility lines and appurtenances within the limits of the improvement. The Contractor shall locate all utilities far enough in advance to avoid all conflicts in grade separation between existing utilities and the proposed improvements. If the Contractor encounters a conflict between the proposed improvements and existing utility that was not located in advance by the Contractor, then the Contractor shall, at no cost to the Village, relocate the proposed improvements and/or the utility to avoid the conflict.

The Contractor will be required to cooperate with all utility companies involved in connection with the removal, temporary relocation, reconstruction, or abandonment by these companies of any and all services or facilities owned or operated by them within the limits of this improvement.

Before doing any work which will damage, disturb, or leave unsupported or unprotected any utility lines, or appurtenances encountered, the Contractor shall notify the respective Owner thereof, who will make all arrangements for relocating, adjusting, or otherwise maintaining or abandoning service on lines that fall within the limits of the proposed construction without cost to the Contractor, including the removal of all cables, manhole covers, and other appurtenances which the Owner desires to salvage. After such arrangements have been made, the Contractor will proceed with the work as directed by the Engineer. All utility lines and appurtenances which are abandoned by the Owner shall be removed and disposed of by the Contractor.

No extra compensation will be allowed to the Contractor for any expense incurred by complying with these requirements or because of delays, inconvenience, or interruptions in his work resulting from the failure of any utility company to adjust, remove, relocate, reconstruct, or abandon their services. The Contractor shall be responsible for prompt and timely adjustment, removal, relocation, reconstruction, or abandonment of their facilities by all utility companies involved, and the coordination of his own work with that of these companies to the end that work on this improvement is not delayed because of necessary changes in the existing utilities, public or private.

Construction Operations: In order to minimize the effect of construction noise on the area surrounding the improvement, the Contractor and his subcontractors shall comply with the following requirements. Any changes to this schedule will not be accepted unless approved by the Engineer.

• All engines and engine-driven equipment used for hauling or construction shall be equipped with an adequate muffler in constant operation and properly maintained to prevent excessive or unusual noises. Any machine or device or part thereof which is regulated by or becomes regulated by Federal or State of Illinois noise standards shall conform to those standards.

• Construction operations shall be confined to the daylight hours between 7:00 AM and 5:00 PM Monday through Saturday. No work of any kind shall be done on Sundays in residential areas unless previously approved by the Engineer. These time restrictions shall not apply to maintenance or operation of safety and traffic control devices such as barricades, signs, and lighting, or to construction of an emergency nature. If the Contractor requires additional time to complete a portion of the work on any given day or if he foresees the need to work extended hours for a number of days to comply with the construction schedule, he must receive the approval of the Engineer.

• The Contractor shall take all precautions necessary to protect the general public and his employees from hazardous locations that might occur within the limits of the improvement.

The Village is not responsible for site safety. The Bidder is solely and exclusively responsible for construction means, methods, technologies, and site safety.

• It shall be the Contractor’s responsibility to protect open cut trenches as may be required by OSHA, Illinois Department of Labor, State, or Federal Law. Trenches in pavements or in close proximity to the improved streets or roadways shall be sheeted or braced in a substantial and effective manner. Sheeting may be removed after backfilling has been completed to such an elevation as to permit its safe removal. Sheeting and bracing left in place must be removed for a distance of 3 feet below the established street grade. The cost of furnishing, placing, and removing sheeting and/or bracing shall be incidental to construction and included in the contract unit price for the work being done.

• The Contractor shall schedule and conduct his operations so that the closure time of existing driveways along the route of the improvement is kept to a minimum. Prior to removing any driveways the contractor shall provide the Village, or Village representative, sufficient time to provide 24-hour notice to the resident/owner of the driveway, allowing the resident/owner time to remove the vehicles. The Contractor shall make every effort to keep driveways open including temporary grading and placement of gravel.

• Beginning on the date that the Contractor begins work on this project, he shall assume responsibility for normal maintenance of all existing roadways within the limits of the improvement. This normal maintenance shall include all repair work deemed necessary by the Engineer. Traffic control and protection for this work will be provided by the Contractor as required by the Engineer. The work involved in maintaining the existing pavement and shoulders will not be paid for separately at the contract unit prices for the various items of work involved, unless otherwise specified elsewhere in these Special Provisions.

• If items of work have not been provided for in the Contract, or are not otherwise specified for payment, such items will be paid for in accordance with Article 109.04 of the Standard Specifications.

• The Village reserves the right to add or delete quantities from any of the items within these contract documents.

Concrete Breakers: When removing pavement, curb and gutter, shoulder, and/or any other structures the use of any type of concrete breakers that may damage underground public and/or private utilities, will not be permitted. Under no circumstances will the use of a frost ball be permitted.

The Contractor is prohibited from breaking up concrete by dropping it on the pavement, or in any other manner that in the opinion of the Engineer may damage existing or proposed pavements, or other roadway appurtenances.

Removal of Miscellaneous Items: Regarding the removal and disposal of any existing fences, gates, signs (except traffic signs), or other miscellaneous items which may interfere with the construction operations, the Contractor shall, with the approval of the Engineer, remove and dispose of these items outside the limits of the right-of-way at locations provided by him, and, if a pay item is not included in the Contract, the work shall be considered as incidental to the Contract.

Private Decorative Material: Unless indicated to be removed on the plans, extreme caution shall be exercised to protect existing private decorative material within or near the limits of all work.

The Contractor shall use extreme care when removing any item in conflict. The Contractor is responsible for the removal and replacement of said decorative material which includes any fences, gates, signs (except traffic signs), and landscape planters or other miscellaneous items to be removed and replaced as directed by the Engineer. Cost to be incidental to the Contract.

Mailboxes that interfere with construction operations shall also be removed and replaced as directed by the Engineer. Any damage done to said mailboxes or posts shall be the responsibility of the Contractor to correct or replace. Replacement mailboxes shall match the existing as near as possible in type and size, and shall be approved by the Engineer prior to placement. This work shall be considered incidental to the Contract.

Root Pruning, Shrub and Tree Trimming: This item of work shall be in accordance with Section 201 of the Standard Specifications, except as herein modified, and shall be considered incidental to the contract. Roots of existing trees and bushes in areas affected by construction activity shall be pruned. To prevent the tearing of roots during removal and excavation operations and including any other ancillary activities (storm sewer, electrical, etc.) described here within, roots shall be pruned around all trees and bushes prior to commencement of these operations, including those on private property as directed by the Engineer, which shall be pruned along the sidewalk frontage as a minimum. Pruning shall be accomplished at 6 to 12 inches behind the proposed work, to allow roots to grow back into undisturbed soils and prevent direct exposure to air and subsequent dieback. Actual locations of any equipment to be used for root pruning shall be as agreed upon by the Village’s Forestry Representative and the Engineer.

Clear shrubs to a distance of 2 feet on either side of the proposed sidewalk or bike path, or to the property line whichever is nearer. Trim shrubs to maintain a minimum of 8 feet of overhead clearance from the proposed sidewalk or bike path.

Root pruning, shrub and tree trimming shall be coordinated with the Village’s Forestry Representative and the Engineer prior to completing such work. This work shall be performed by a qualified Contractor and shall be considered incidental to the contract.

Construction Layout: The Contractor shall provide and set all necessary horizontal control, vertical control, alignments, and line and grade stakes for the project. Improvements shall be constructed as specified or otherwise directed by the Engineer.

The Contractor shall be responsible for any mistakes or errors arising from the tampering with or removal of any stakes and shall take proper care in the preservation of such stakes and marks. The Contractor is required to come out to the site as many times as necessary to set and/or re-set all necessary line and grade stakes to complete these improvements.

This work shall be considered incidental to the removal and installation contract items of work.

Inspection: All phases of the improvements will be subject to inspection by representatives of the Village’s Engineering and Public Works Department, or Village authorized Consulting Engineer. Projects will not be accepted by the Village without the final approval of the Village’s Engineering and Public Works Department.

The Contractor shall be bound by these specifications and by all Village ordinances and codes.

Dust Control: The Contractor shall at all times maintain proper dust control at the site. The Contractor shall water the entire site whenever the site conditions become unsafe due to blowing soil or dust. The site shall be watered as many times per day as necessary to maintain a safe work site, as determined by the Engineer. This work shall be considered as incidental to the costs of these improvements.

Housekeeping: These improvements are located in fully developed residential, commercial and industrial areas. It is imperative that the Contractor minimize the disturbance to these residents and businesses during construction.

The jobsite shall always be maintained with a neat and orderly appearance. Materials, equipment, and tools no longer needed shall be removed or relocated in a timely manner. The Contractor shall complete removal or cleanup of items requested by the Engineer within 24 hours unless otherwise specified.

Work shall progress in a timely fashion, and streets shall not remain in an uncompleted state for long periods of time. Required timelines for access restoration, progress of work, backfilling, and restoration are detailed throughout these specifications.

A housekeeping deduction in the amount of $750 per day may be assessed at the discretion of the Engineer, if at any time the Engineer deems the Contractor is not meeting the required timelines for housekeeping requests, access restoration, progress of work, backfilling, restoration, and other items as detailed in these specifications. This deduction will be applied to the next pay estimate due the Contractor.

Protection of Existing Drainage Facilities during Construction: The existing drainage facilities shall remain in use during the period of construction. All drainage structures are to be kept free of any debris resulting from the construction operations. Any accumulation of debris in the drainage structures resulting from construction operations shall be removed at the Contractor's own expense, and no extra compensation will be allowed.

Unless reconstruction or adjustment of an existing manhole, catch basin, or inlet is called for by the Engineer, the proposed work shall meet the existing elevations of these structures. Should reconstruction or adjustment of a drainage structure be required, the necessary work shall be done in accordance with the Standard Specifications.

The Contractor shall take the necessary precautions when working near or above existing sewers in order to protect these pipes during construction from any damage resulting from his operations.

All work and material necessary to replace existing sewers damaged because of noncompliance with this provision shall be as directed by the Engineer, in accordance with the Standard Specifications, at the Contractor's own expense. No extra compensation will be allowed.

Sawing Pavement, Driveway Pavement, Sidewalk, and Curb: This work shall be performed at locations shown on the plans or as directed by the Engineer. The Contractor shall cut the joint between the portion to be removed and that to be left in place with a sawing machine to prevent spalling when the item is broken out. This work shall be done in a manner that a straight and perpendicular joint will be secured. All saw cutting shall be to the full depth of the pavement, driveway, sidewalk, or curb to be removed.

After saw cutting, the Contractor shall immediately remove all concrete or asphalt slurry from the work area, specifically from the pavement, driveway, sidewalk and curb and gutter which is to remain in place. When the concrete or asphalt slurry is wet, it creates a slippery and hazardous condition. In addition, if the concrete or asphalt slurry is allowed to dry, it creates an unsightly aesthetic appearance. In the event the concrete or asphalt slurry is not removed immediately and the concrete or asphalt slurry cures and adheres to the adjacent surface, the Contractor shall remove and replace the portion with concrete or asphalt slurry to the satisfaction of the Engineer. No additional compensation will be allowed for removal of the slurry or removal and replacement of the adjacent area due to slurry which was not immediately removed from the adjacent area.

It is the Contractor’s responsibility to determine the thickness of the existing item to be removed and whether or not it contains reinforcement.

This work shall be considered incidental to the contract and the items to be removed. No additional compensation will be allowed for sawing reinforcement.

Material Inspection: The local agency shall be responsible for the quality assurance field inspection. The Village shall be notified at least 24-hours in advance of the placement of any Portland cement concrete. The Contractor shall allow the inspector access to his plant area to observe the operations and take material samples as required.

The Contractor shall be responsible for quality control inspection. For Portland cement concrete mixtures, attention is directed to Recurring Special Provision 25, “Quality Control/Quality Assurance of Concrete Mixtures”. QC Plan shall be submitted and approved by the engineer prior to paving all PCC and HMA work. IDOT approved letter of all PCC and HMA mixes shall accompany the QC Plan Submittal.

This work shall be considered incidental to the contract and to the Portland cement concrete items to be placed.

Earthwork: This work consists of the grading, cutting and filling of earth material at various locations within the project limits for the installation of the sidewalk, correcting grading issues or other improvements as indicated on the approved plans and cross sections.

Surplus, unstable, unsuitable, and organic material shall be disposed of in accordance with applicable portions of Section 202 of the Standard Specifications.

This work shall be considered incidental to the removal and installation contract items of work.

Concrete Driveway: This work shall consist of constructing a Portland Cement Concrete Driveway at the thickness of concrete pavement specified on a granular subbase in accordance with Section 423 and 440 of the Standard Specifications, applicable articles of Section 420 of the Standard Specifications and as specified herein. The driveway shall be constructed of Class PV concrete.

Work to also include all costs associated with placement of an aggregate sub-base, fine grading and sub grade preparation for the placement of concrete, steel bar, the expansion joint filler, joint construction, protective coat material and placement, proper finish, and all other labor, materials, and equipment necessary to properly construct this item in accordance with the plans and specifications.

Disturbed pavement and ground areas shall be restored immediately following replacement operations, in all cases within 3 calendar days from the date the driveway is cast. The Engineer shall stop the Contractor from further removal operations at any time he determines the restoration is not being done in a timely manner. Liquidated Damages of $550.00 will be assessed per day if the backfilling of the parkway is not completed within 3 calendar days.

Materials shall meet all applicable requirements of Sections 1004, 1006, 1020 and 1023 of the Standard Specifications.

The Contractor shall full-depth saw cut the existing driveways at the locations marked for removal on the plans or as directed by the Engineer. Then neatly remove the existing driveways as marked or as directed by the Engineer. This removal shall include removing the aggregate base underneath the Portland cement concrete.

Driveway pavement shall be constructed as per the detail in the plan set on a compacted, dry 4-inch Grade 9 aggregate base course.

Curing and protection shall be in accordance with Article 1020.13(a) and Article 1020.13(c) of the Standard Specifications. Membrane curing compound shall be Type III (white-pigmented).

All aggregates used in the Portland cement concrete material shall be crushed limestone, or approved equal. The concrete mix design, containing the crushed limestone aggregates, or approved equal, shall be submitted to the Engineer for approval. No concrete shall be placed without the Engineer’s approval of the concrete mix design.

If concrete is placed after November 1, 2024, a protective coat shall be applied to the Portland cement concrete driveway pavement in accordance to Article 420.18 or as directed by the

Engineer. The application of protective coat should not be paid for separately, but shall be considered incidental to the concrete driveway item.

PORTLAND CEMENT CONCRETE DRIVEWAY will be measured in place and the area computed in square yards. If additional pavement or sub-grade is removed due to negligence on the part of the Contractor, the additional quantity of pavement removal and replacement or sub-grade material will not be measured for payment.

This item shall be paid for at the contract unit price per square yard for PORTLAND CEMENT CONCRETE DRIVEWAY, thickness specified and includes all labor, material and equipment for providing, shaping, grading and compacting the aggregate base course, providing and setting the 24-inch long bars and providing and setting preformed bituminous fiber expansion joint.

Portland Cement Concrete Sidewalk: This work shall consist of the construction of the PORTLAND CEMENT CONCRETE SIDEWALK at the thickness of concrete pavement specified at locations and elevations as shown on the plans, or as directed by the Engineer. The sidewalk shall be constructed of Class SI concrete. The sidewalk’s thickness shall be increased to the thickness shown on the sidewalk detail when it runs through driveways.

If the existing base is soft or unsuitable, the Contractor shall remove the existing subgrade and provide a granular material (CA-6 or approved equal). This work shall be considered incidental to the contract unit price per square foot for PORTLAND CEMENT CONCRETE SIDEWALK.

The granular material shall be compacted to the satisfaction of the Engineer. The subgrade shall be tamped or rolled until thoroughly compacted before the granular material is placed.

Expansion joints shall also be placed where the sidewalk abuts existing sidewalks, between driveway pavement and sidewalk, and between sidewalk and curbs where the sidewalk abuts a curb, and as directed by the Engineer. Expansion joints shall be installed around sewer, water and other utility castings and valves. This work shall be considered incidental to the Portland Cement Concrete Sidewalk item.
