About this file
This is an evaluation clause (RFO 52.212-2) for a commercial services solicitation governing the award criteria and process for an eelgrass survey contract in and around the Swinomish Channel, Washington.
The Government will award the contract on a lowest-priced technically acceptable basis. All proposals will first be evaluated for price completeness and reasonableness, then ranked from lowest to highest total evaluated price. The apparent lowest-priced offeror will be evaluated for technical acceptability on a pass/fail basis. If the lowest-priced offer is technically acceptable, award will be made to that offeror without further evaluation. If deemed unacceptable, the Government will sequentially evaluate the next lowest-priced offers until identifying a technically acceptable proposal. The offeror's submission must demonstrate knowledge and experience from a minimum of two projects in the following areas: understanding the scope of the Swinomish Channel eelgrass survey requirement; conducting similar submerged aquatic vegetation surveys for eelgrass distribution and abundance on the Washington state west coast; using submersible video, sonar, hydroacoustic, and/or visual survey methods; following USACE eelgrass survey mapping protocols; producing GIS maps and data deliverables; and possessing necessary equipment, staff, knowledge, dive experience, and direct experience on eelgrass survey projects with permitting needs. The evaluation criteria specify that acceptable proposals must meet RFQ requirements and demonstrate the combined experience and knowledge criteria, though not all experience items need to be present in any single project. Unacceptable proposals fail to submit the required number of projects or do not collectively demonstrate the specific required experience areas. The clause also addresses option evaluation and notice of award provisions.

RFO 52.212-2 Evaluation-Commercial Products and Commercial Services (Feb 2026) (Deviation 2026-O0038)
(a) Evaluation factors. The Government will award a contract resulting from this solicitation to the responsible Offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors will be used to evaluate offers:
Factor 1: Price - All received proposals will be evaluated for price completeness and reasonableness. The Government will then rank all offers from lowest total evaluated price to highest total evaluated price. Award will be made on a lowest-priced technically acceptable basis considering the following two factors; price and technical. All offerors shall be considered in terms of price, lowest to highest, and then the apparent lowest-priced offeror will be evaluated for acceptability under the technical and price factors.
NOTE: If the lowest-price offeror is evaluated as unacceptable, the acceptability of the next lowest-price offeror will be evaluated, continuing this process as necessary.
Factor 2: Technical The Government will evaluate the technical proposal of the lowest-priced offeror only. This evaluation is strictly on a pass/fail (Acceptable/Unacceptable) basis against the criteria defined in the solicitation. If the lowest-priced offer is determined to be "Technically Acceptable," the evaluation process stops. The Government will proceed with awarding to this offeror without evaluating the remaining technical proposals. If the lowest-priced offer is found "Technically Unacceptable," the Government will dismiss that offer and evaluate the technical proposal of the next lowest priced offer. This iterative process continues until a technically acceptable offer is identified.
The offeror’s quote submission must demonstrate knowledge and experience(at minimum two(2) projects) in the following areas listed below:
-Demonstrates understand of the scope of the requirement to perform an eelgrass survey in and around the Swinomish Channel. Please read the Performance Work Statement thoroughly so that you have a clear understanding of the requirement.
-Demonstrates experience doing similar submerged aquatic vegetation surveys for eelgrass distribution and abundance in Washington state of the west coast.
-Demonstrate experience using submersible video, sonar, hydroacoustic and/or visual survey methods to perform eelgrass surveys.
-Demonstrate experience following USACE eelgrass survey mapping protocols.
-Demonstrates experience producing GIS maps and data deliverables for eelgrass surveys.
- Demonstrate your company has the necessary equipment, staff, knowledge, dive experience, and direct experience working on eelgrass survey projects with permitting needs like our project.
The government will evaluate experience on an acceptable/unacceptable.
Acceptable: The quote meets the requirements of the RFQ, demonstrates experience and knowledge criteria and does not demonstrate the capability to successfully perform the requirements of this contract. The Offeror must meet the criteria stated above, when combined, clearly demonstrate experience in the areas listed above. Not all experience items must be demonstrated in any one project.
Unacceptable: The quote does not meet the requirements of the RFQ, does not demonstrate experience and knowledge criteria and does not document the capability of the offeror to successfully perform the requirements of this purchase order. The Offeror fails to submit the required number of projects, or the submitted projects, when combined, do not demonstrate experience the specific areas listed above.
(b) Options (if applicable). The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. The evaluation of options does not obligate the Government to exercise the option(s).
(c) Notice of award. A written notice of award or acceptance of an offer furnished to the successful Offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
