STATEMENT OF WORK

Install Surge Protectors in 15 Facilities at WY ANG Installation

1. GENERAL: This is a contract to install surge protective devices in 15 facilities. The Government shall not exercise any supervision or control over the contract service providers performing the services herein. Such contract service providers shall be accountable solely to the Contractor who, in turn is responsible to the Government.

1.1 Description of Services/Introduction: Work to be performed under this contract consists of furnishing all labor, equipment, materials and supplies necessary to perform repairs at the Wyoming Air National Guard. The contractor shall perform to the standards in this contract.

1.2 Background: The 153d Civil Engineer Squadron is responsible for the maintenance of the Wyoming Air National Guard.

1.3 Objectives:

- Install 15 Liebert, parallel type Surge Protective Devices.

1.4 Scope: Contractor will install 15 Surge Protective Devices in facilities to be named in CLIN’s. Devices must be Liebert, parallel type devices which comply with UL 1449 at the service entrance with a 120 volt input. Provide surge protectors in a NEMA 1 enclosure per NEMA ICS 6. SPD must have the same short-circuit current rating as the protected equipment and shall not be installed at a point of system where the available fault current is in excess of that rating. Use type 1 SPD and connect on the load side of a dedicated circuit breaker. Submit performance and characteristic curves. Devices must be type 1 with a minimum surge current rating of 80,000 amperes for L-L mode minimum and 40,000 amperes for other modes (L-N, L-G, and N-G). The minimum MCOV (Maximum Continuous Operating Voltage) rating for L-N and L-G modes of operation: 120 percent of nominal voltage for 240 volts and below; 115 percent of nominal voltage above 240 volts to 480 volts.

1.5 Period of Performance: The period of performance shall be for 30 calendar days after NTP (Notice to Proceed)

1.6 General Information

1.6.1 Quality Control: The contractor shall develop and maintain an effective quality control program to ensure services are performed in accordance with this SOW. The contractor shall develop and implement procedures to identify, prevent, and ensure non-recurrence of defective services. The contractor’s quality control program is the means by which he assures himself that his work complies with the requirement of the contract. A quality control plan must be provided to the COR within 7 days of the contract award.

After acceptance of the quality control plan the contractor shall receive the contracting officer’s acceptance in writing of any proposed change to his QC system.

1.6.2 Quality Assurance: The government shall evaluate the contractor’s performance under this contract in accordance with the Quality Assurance Surveillance Plan. This plan is primarily focused on what the Government must do to ensure that the contractor has performed in accordance with the performance standards. It defines how the performance standards will be applied, the frequency of surveillance, and the minimum acceptable defect rate(s).

1.6.3 Recognized Holidays:

It is possible that the contractor will be called out on any of these holidays.

1.6.4 Hours of Operation: The contractor is responsible for conducting business, between the hours of 0730 and 1630 Monday thru Friday except Federal holidays or when the Government facility is closed due to local or national emergencies, administrative closings, or similar Government directed facility closings.

For other than firm fixed price contracts, the contractor will not be reimbursed when the government facility is closed for the above reasons. The Contractor must, at all times, maintain an adequate workforce for the uninterrupted performance of all tasks defined within this PWS when the Government facility is not closed for the above reasons. When hiring personnel, the Contractor shall keep in mind that the stability and continuity of the workforce are essential. The contractor will be required to meet all dates for the inspections listed in the Specific Tasks section of this PWS.

1.6.5 Place of Performance: The work to be performed under this contract will be performed at the Wyoming Air National Guard. This is in Cheyenne, Wyoming.

1.6.6 CLINS:

1.6.7 Work by Others: The services required in this contract are in addition to the routine operation and maintenance performed by Government personnel; however, the Government reserves the right to perform any or all of the services described herein with its own personnel or volunteers. The Government may undertake or award other contracts or have lessees or volunteers performing certain work, and the Contractor shall fully cooperate with such other Contractors, lessees, volunteers and Government employees and carefully fit their own work to such other additional work as may be directed by the COR. The Contractor shall not commit or permit any act which will interfere with the performance of work by another Contractor, by a lessee, by volunteers or by Government employees. The COR can alter the work schedules of the Contractor to avoid possible conflicts. Any such change or failure to make such a change by the COR shall not be the basis for a claim by the Contractor.

1.7 Standardization of Materials: Materials used shall be new, in good condition, free of defects and of the same brand or have the same salient characteristics as the existing products being used. The items used shall be standard products of manufacturers regularly engaged in the production of such items.

1.8 Disposal of Debris: The Contractor shall dispose of all materials and/or debris from maintenance work performed under this contract. All materials shall be disposed of off Government property and in strict accordance with all applicable laws and ordinances. No separate payment for the disposal of materials and debris will be made.

1.9 Administration Costs: All Contractor's administrative costs to include but not be limited to prepare estimates for task job requests, report results of service calls, payroll, and completing/maintaining all the necessary paper work required in this scope of work will not be considered as work for payment.

1.10 Completion Time: The intent of any maintenance work issued is to start and complete maintenance in a smooth flowing manner with the least amount of interruption to the public and to pursue the work until complete. Priority work issued on any given day does not relieve the contractor of the responsibility of finishing up maintenance already started elsewhere.

1.11 Testing: Upon completion of maintenance services involving parts replacement or repair, the total system shall be tested to confirm that all portions, including the replaced or repaired parts, are functioning properly.

1.12 Non-Compliance Work: Should the Contractor fail to satisfactorily perform services required under this contract, a contract deficiency report (CDR) may be issued. If the nature and the schedule of this type work do not afford an opportunity to re-perform the service, a deduction for the non-compliance work may be made.

1.13 Permits and Licenses: The Contractor shall, at his/her own expense, obtain any licenses or permits required to perform the contract. The Contractor shall comply with all current federal, state, and local laws and regulations and shall comply with any subsequent changes.

1.14 Identification of Contractor Vehicles: The Contractor's vehicles and major subcontractor's vehicles shall be identified with the company name prominently displayed on the outside of both front doors of each vehicle in such a manner as to provide a readily visible means of identification.

1.15 Utilities: The Contractor may use Government utilities (water and electric) where available. The Contractor shall make a dedicated effort to conserve utilities. Government furnished utilities shall be used only in the performance of work specified in this contract. Where water and electricity are not provided, the Contractor must obtain them from other sources at no additional expense to the Government.

1.16 Personnel Safety and Property Protection

1.16.1 Safety Requirements: In order to provide safety control for protection of the life and health of employees and other persons; for prevention of damage to property, materials, supplies, equipment, and for avoidance of work interruptions in the performance of this contract, the contractor shall comply with Occupational Safety and Health Act (OSHA) and all pertinent provisions of the publications.

If the contractor fails or refuses to promptly comply with the safety requirements as specified herein, the COR may stop all or part of the work until satisfactory corrective action has been taken. No part of the time lost due to any such stop shall be made subject to claim for extension of time or for excess costs or damages to the contractor. Also, the contractor will not be paid for work not performed as a result of work stoppage due to failure to comply with safety requirements.

1.16.2 Damage and Injury Protection: The contractor shall perform work requirements in a manner to protect buildings, vehicles and government and public personal property from damage, and employees and project visitors from any harm or injury. Work shall be scheduled and completed to afford this protection.

1.16.3 Accident Reporting and Records: The contractor shall maintain an accurate record of, and shall report to the COR, all accidents within 24 hours of the occurrence. All serious accidents (those resulting in death or injury requiring medical attention) shall be reported to the COR immediately.

1.16.4 Damage to Government and non-Government Property: The Contractor shall use reasonable care to avoid damaging buildings, equipment, vegetation and other Government and non-government property.

If the Contractor damages or loses any of this property, the Contractor shall replace or repair the damage, at no cost to the Government, as the COR directs. A written report of the incident and extent of such damage shall be submitted to the COR within 2 workdays (less weekends and holidays) of the occurrence and the contractor shall also report all damages of government property on the quality control program report. If the Contractor fails or refuses to make such repairs or replacements, the Contractor shall be liable for the cost, which will be deducted from the contract price. Contractor shall be liable for any and all damages or losses, public or private, caused through fault or negligence of his agents and/or employees.

1.16.5 Safety Deficiencies: The contractor shall immediately correct all safety deficiencies upon notification of the deficiencies by the Quality Assurance Representative, and shall notify the COR of the corrective action to be taken. Such notice when delivered to the contractor or his representative at the site of work shall be deemed sufficient for this purpose. The Government assumes no responsibility or duty to inspect. The contractor is responsible for ensuring that the equipment is in a safe operating condition, that it is used in a safe manner, and that it is used in a safe environment and condition.

1.17 Accident Prevention and Emergency Medical Treatment

1.17.1 Personnel Training: The contractor shall have competent personnel trained and capable of dealing with minor personnel injuries. In addition to this, each crew of workers shall be provided with first aid kits complying with OSHA and other Federal and State requirements and a minimum of one crew member trained and certified in first aid and CPR to care for minor injuries normally sustained in the type of work required.

1.17.2 Hazard Identification: The Contractor shall survey the work areas for hazardous conditions. The contractor shall flag, mark, or identify and report to the COR any hazardous areas that he/she discovers.

The contractor shall determine and use alternate methods and equipment to perform work in these areas in a safe manner.

1.17.3 Safety Meetings: The contractor shall conduct safety meetings with all personnel at a minimum of weekly intervals to discuss potential safety hazards, etc. The COR shall be notified 24 hours in advance and allowed to attend each safety meeting. A report of the agenda and attendees for each safety meeting shall be submitted to the COR. When a new employee is hired, the contractor shall furnish a statement that the new employee was briefed on safety procedures.

1.18 Personnel

1.18.1 Contract Manager: Provide a contract manager to be responsible for the performance of all work and with the authority to make on-site decisions on the behalf of the contractor on contract matters. Provide in writing within 7 days after award the name and contact information of the contract manager and an alternate authorized to act for the contractor when the designated contract manager is absent.

1.18.2 The Contract Manager or alternate: The Contract Manager or alternate shall be onsite whenever contract services are being performed. The Contract Manager or alternate shall have full authority to direct the work and to obtain supplies and equipment necessary to complete the work as required by these specifications

1.18.3 The Contract Manager and alternate must be able to read, write, speak and understand English.

1.18.4 The Contract Manager or alternate shall be available during normal duty hours within two hours’ notice to meet with Government personnel designated by the Contracting Officer to discuss problem areas.

The contractor shall ensure that communications between the contract manager and contractors employees shall be established within 30 minutes during normal duty hours.

1.19 Employees: The Contractor shall provide a list of names, addresses, and telephone numbers of those employees who will be performing work under this contract, due no later than 7 days after contract award.

Provide an updated copy of the list prior to allowing new employees to perform work on this contract. All Contractor employees shall be sixteen (16) years of age or older. The Government has the right to restrict the employment under the contract of any contractor employee, or prospective contractor employee, who is identified as a potential health, safety, or security threat to themselves or others.

1.20 Identification of Contractor Personnel: Contractor personnel shall present a neat appearance and shall always conduct themselves in a proper manner while in the performance of this contract.

Personnel shall be identified by wearing one or a combination of the following: a shirt, ball cap, hard hat or name tag that has the company and employees name clearly visible.

1.21 Qualifications: The Contractor will be required to provide qualified personnel or to subcontract the work to a specialist familiar with the type of work to be accomplished.

1.22 Damages or Loss of Contractor’s Supplies and Property: The Contractor is responsible for taking the action necessary to protect all Contractor property from loss, damage or theft. The Government assumes no responsibility for theft, damage, etc., of the above. Materials stored at a job site for the performance of this contract, are left at the contractor’s own risk. Additional payment will not be made by the government for replacement materials lost to theft or otherwise by the contractor.

1.23 Contractor Recommendations: It is the intent of these specifications to provide a contract in accordance with the best industry standards. The contractor may recommend alternative work methods that will improve the quality. If accepted, the contractor shall use those methods in executing the work of the contract. The Government has the prerogative to accept or reject the Contractor’s recommendation.

1.24 Environmental Program: The Contractor shall comply with Federal, State, and local laws, regulations and standards regarding environmental protection. All environmental protection matters shall be coordinated with the COR.

1.25 Interruptions to Service: All work that would necessitate an interruption of the use of the project or to the utility systems or otherwise disrupt building occupants and/or the visiting public shall be fully coordinated and approved in advance by the COR. Interruptions shall be kept to an absolute minimum and all repairs or replacements of equipment or components shall be accomplished in an expeditious and efficient manner.

1.26 Safeguarding Government Property: The Contractor shall cooperate with Government personnel in safeguarding Government property. The Contractor shall be responsible for reporting all acts of vandalism, larceny, or pilferage to the COR. The Contractor shall establish security procedures and safeguards that are compatible with the Government's existing procedures to protect all equipment, materials, supplies, tools, and other resources. The Contractor shall cooperate with and provide any assistance necessary to the Government during any audits, usage checks of expendable property and inventories of nonexpendable property. The Contractor shall maintain accurate records and make them available to the Government upon request.

1.27 Notification of Work to be done: When the Contractor is notified of work required under these specifications, the Contractor shall begin work in accordance with all schedules set forth in this PWS. The notification to the Contractor of work to be performed will be by issuance of Delivery Orders or by phone call if a delivery order is already in place. Except for emergency work to preserve life or avoid injury, absolutely no work will begin prior to issuance of a Delivery Order. Upon issuance of a task item Delivery Order, the Delivery Order becomes a firm, fixed-price order based on the contract bid prices.

1.28 Lost and Found: All articles found by contractor personnel to whom a reasonably prudent person would assign monetary, personal, or other value (including possible contraband items) shall be turned in to the COR. The contractor shall obtain receipts for articles turned in to the COR.

1.29 Pre-work Conference: At this meeting, the contractor shall submit for approval the following: a safety plan; a quality control plan; a written designation of an Contract Manager and alternate. No work may be performed on this contract until all required documents have been approved. The Government may require up to 3 working days for review and approval of late submitted documents. The Government reserves the right to accomplish the work required under this contract by an alternate means of in house labor or other contractors while required documents are pending submittal or approval.

1.30 Security Requirements for Contractor Personnel Accessing the Wyoming Air National Guard

1.30.1 Access and General Protection/Security Policy and Procedures: The contractor shall comply with all applicable installation/facility access and local security policies and procedures, which may be obtained from the

Contracting Officer’s Representative (COR). The contractor shall also provide all information required for background checks to meet installation access requirements to be accomplished by the local installation’s Security Forces, Director of Emergency Services or local Security Office. The contractor shall ensure compliance with all personal identity verification requirements as directed by DoD, HAF and/or local policy. Should the Force Protection Condition (FPCON) change, the Government may require changes in contractor security matters or processes. Contractor and all associated sub-contractors employees shall comply with adjudication standards and procedures using the National Crime Information Center Interstate Identification Index (NCIC-III) and Terrorist Screening Database (TSDB) (AFI 31-101 and AFI 10-245), applicable installation, facility and area commander installation/facility access and local security policies and procedures (provided by government representative), or, at OCONUS locations, in accordance with status of forces agreements and other theater regulations. If badges will be issued, they will be issued by the 153d Security Forces Squadron (SFS) to the contractor through the 153 CES COR.

Badges shall be issued, tracked, and collected in accordance with instructions from Security Forces.

1.30.2 Restricted Area Access: Contractors working in Controlled or Restricted areas or any area on the flight line must be issued a specific contractor identification badge or be escorted. (This project is not located on the flight line).

1.30.3 Vehicle Searches: All commercial, contractor, and sub-contractors’ vehicles are subject to random inspections each time they enter the base.

1.30.4 Physical Security: The contractor shall be responsible for safeguarding all government equipment, information and property provided for contractor use. At the close of each work period, government facilities, equipment, and materials shall be secured.

1.30.5 Key Control: No keys will be issued to the contractor for the performance of this contract.

1.31 Post Contract/Other

1.31.1 Post Award Conference/Periodic Progress Meetings: The Contractor agrees to attend any post award conference convened by the contracting activity or contract administration office in accordance with Federal Acquisition Regulation Subpart 42.5. The contracting officer, Contracting Officers Representative (COR), and other Government personnel, as appropriate, may meet periodically with the contractor to review the contractor's performance. At these meetings the contracting officer will apprise the contractor of how the government views the contractor's performance and the contractor will apprise the Government of problems, if any, being experienced. Appropriate action shall be taken to resolve outstanding issues.

1.31.2 Contracting Officer Representative (COR): The COR monitors all technical aspects of the contract and assists in contract administration The COR is authorized to perform the following functions: assure that the Contractor performs the technical requirements of the contract: perform inspections necessary in connection with contract performance: maintain written and oral communications with the Contractor concerning technical aspects of the contract: issue written interpretations of technical requirements, including Government drawings, designs, specifications: monitor Contractor's performance and notifies both the Contracting Officer and Contractor of any deficiencies, coordinate availability of government furnished property, and provide site entry of Contractor personnel. A letter of designation issued to the COR, a copy of which is sent to the Contractor, states the responsibilities and limitations of the COR, especially regarding changes in cost or price, estimates or changes in delivery dates. The COR is not authorized to change any of the terms and conditions of the resulting order.

1.31.3 Data Rights: The Government has unlimited rights to all documents/material produced under this contract. All documents and materials, to include the source codes of any software, produced under this contract shall be Government owned and are the property of the Government with all rights and privileges of ownership/copyright belonging exclusively to the Government. These documents and materials may not be used or sold by the contractor without written permission from the Contracting Officer. All materials supplied to the Government shall be the sole property of the Government and may not be used for any other purpose. This right does not abrogate any other Government rights.

1.31.4 Organizational Conflict of Interest: Contractor and subcontractor personnel performing work under this contract may receive, have access to or participate in the development of proprietary or source selection information (e.g., cost or pricing information, budget information or analyses, specifications or work statements, etc.) or perform evaluation services which may create a current or subsequent Organizational Conflict of Interests (OCI) as defined in FAR Subpart 9.5. The Contractor shall notify the Contracting Officer immediately whenever it becomes aware that such access or participation may result in any actual or potential OCI and shall promptly submit a plan to the Contracting Officer to avoid or mitigate any such OCI. The Contractor’s mitigation plan will be determined to be acceptable solely at the discretion of the Contracting Officer and in the event the Contracting Officer unilaterally determines that any such OCI cannot be satisfactorily avoided or mitigated, the Contracting Officer may affect other remedies as he or she deems necessary, including prohibiting the Contractor from participation in subsequent contracted requirements which may be affected by the OCI.

GOVERNMENT FURNISHED PROPERTY, EQUIPMENT, AND SERVICES

2. GOVERNMENT FURNISHED ITEMS AND SERVICES:

2.1. Services: The Government will not provide any services associated with this contract.

2.2 Facilities: The Government will not provide any facilities associated with this contract.

2.3 Utilities: The Government will provide utilities for the contractor to use on site such as water electricity and restrooms. The Contractor shall instruct employees in utilities conservation practices. The contractor shall be responsible for operating under conditions that preclude the waste of utilities, which include turning off the water faucets or valves after using the required amount to accomplish cleaning vehicles and equipment

2.4 Equipment: The Government will not provide any equipment associated with this contract.

2.5 Materials: The Government will not provide any materials associated with this contract.
