About this file
This document is a Memorandum for Record - Limiting Competition at or below the Simplified Acquisition Threshold for a sole source procurement by the Medical Readiness Contracting Office - East (MRCO-E). The procurement is for eight WAHTS AC Systems and two Admin Tablets with software for the Hearing Conservation Clinic at Womack Army Medical Center, Fort Bragg, NC. The systems are manufactured exclusively by WAHTS Hearing LLC, which is being awarded the contract under FAR 13.106-1(b)(1) due to being the sole provider of the specialized Wireless Automated Hearing Test System (WAHTS).
The procurement will be funded through Defense Health Program (DHP) funds for fiscal year 2025, with a completion/delivery date of 1 July 2025. Market research was conducted between 1 February and 14 March 2025, confirming WAHTS LLC as the only vendor capable of providing the required system. The sole source justification is based on WAHTS Hearing LLC being the manufacturer with proprietary intellectual property rights, and the system's unique capabilities including portability, immediate test result monitoring, and minimal electrical load requirements. A notice of intent to award will be placed on SAM.GOV, with a sources sought notice to potentially increase competition.

 FAR 13.106-1(b)(1): For purchases not exceeding the simplified acquisition threshold (SAT), only one source reasonably available, urgency, exclusive licensing agreements, brand name, or industrial mobilization.
5. Reasons for Authority Cited:
a. WAHTS Hearing LLC is the manufacturer of the WAHTS (Wireless Automated Hearing Test System) and as such is the sole provider for the system, parts, annual software access and service, including: WAHTS-AC; WAHTS-BC; Audhere software;
and Audmedical software. This is a completely portable system that can be used in remote areas where access to testing facilities is limited. The hearing care provider can monitor the test and provide results immediately. The system will also increase testing capacity and Soldier Readiness. The location for testing cannot support the electrical load for audiometric testing booths. The WAHTS can be used instead with minimal electrical load.
b. These supplies must be sole sourced to WAHTS LLC. WAHTS Hearing LLC has provided a Sole Source Justification letter which states they are the manufacturer and sole provider of the equipment. (See PCF file A.02, vendor sole source letter).
c. Failure to award sole source will result in a lapse in fit testing capability per new requirements listed in the Hearing Conservation Program (HCP), DODI 6055.12.
