About this file

This document is an After-the-Fact FAR Part 6 Justification and Approval for Other than Full and Open Competition for remediation actions at the Buxton Naval Facility in North Carolina. The United States Army Corps of Engineers (USACE) is seeking emergency soil contamination remediation services from Bay West, LLC, utilizing the Unusual and Compelling Urgency authority. During the week of 5 August 2025, petroleum odors and sheens were observed escaping into the ocean, prompting an immediate response to mitigate environmental risks.

The contract (W912HN24D1000 / W912HN24F1024) is a 36-day base period from 6 August to 11 September 2025, with Bay West selected due to their prior experience and specific expertise in the area. Key strengths include local knowledge of Buxton, heavy equipment proficiency, regulatory compliance, environmental awareness, and hazardous material mitigation. The procurement was conducted as a 100% small business set-aside through a competitive task order at the SATOC level, with Bay West being quickly identified as the most capable contractor to immediately address the contamination threat.
