Far Subpart 13.106-1(b) and FAR 11.105(a)(1)
1. CONTRACTING AGENCY:
Walla Walla District, U.S. Army Corps of Engineers, Contracting Division, 201 North Third Avenue, Walla Walla, WA 99362
2. DESCRIPTION OF ACTION:
A brand name justification is being requested for a new firm fixed price contract for a distributor who can supply Schweitzer Engineering Laboratories (SEL) protective relays, watt hour meters, and network switches for transformers, bus, and switchgear. 3. DESCRIPTION OF SUPPLIES/SERVICES:
The SEL equipment is for the navigation lock switchgear annunciation and controls. Schweitzer Engineering Laboratories has provided pricing as shown below for required items:

4. AUTHORITY CITED:
FAR 13.106-1 (b) Soliciting from a single source. (1) For purchases not exceeding the simplified acquisition threshold, contracting officers may solicit from one source if the contracting officer
Substitution of competitor’s components for SEL components would increase the initial and recurring costs of space parts inventory and software licenses.
All SEL software used to develop and program SEL devices is free or low one-time purchase. Utilizing a different vendor would not allow the project to be able to take advantage of existing SEL software already used onsite. Also, all NWW projects use SEL devices to a significant extent.
Network integration of SEL devices has been done at other NWW projects, and this project was intended to follow a similar system development design.
SEL devices are currently used throughout the powerhouse and NWW projects. Some SEL devices used for this contract may be interchangeable as spare parts for other electrical equipment.
c. Alternatives:
Not Purchase – this alternative is not feasible because we need to ensure the availability of a working and usable sequence of SEL products at the projects.
Purchase a different name brand – this alternative is not in the best interest of the US Army Corps of Engineers because of the additional cost that would be incurred with installing non SEL products.
6. DETERMINATION OF FAIR AND REASONABLE COSTS:
A Determination of Price Fair and Reasonableness will be determined at time of award. No award will be made unless prices may be determined fair and reasonable.
7. EFFORTS TO OBTAIN COMPETITION:
It is anticipated that there are multiple distributors of for the SEL components.
8. MARKET RESEARCH:
Research performed by the PM and Lower Granite Team indicates other companies’ similar products do not meet, or cannot be modified to meet, the agency’s needs.
