About this file

This is an RLP (Renovation and Lease Proposal) Exhibit K addressing swing space requirements for a FEMA federal lease opportunity at either 400 C Street, SW or 500 C Street, SW in Washington, DC. The incumbent lessor must submit a comprehensive swing space plan and schedule as part of the initial proposal to accommodate Government operations during building renovations. The swing space must be turnkey-ready, meeting a "like for like" condition with current operations, and sized at minimum 147,278 ABOA square feet (if offering 400 C Street) or 137,614 ABOA square feet (if offering 500 C Street). The lessor bears sole responsibility for all renovation costs, furniture, fixtures, equipment, IT/telecom/AV/security infrastructure, Level 4 security screening, and FEMA network connections at no cost to the Government.

The swing space must be located within the same building or, if at an alternate location, within the Central Employment Area (CEA) of Washington, DC. The lessor must demonstrate ownership through deed or provide an executed Letter of Intent with a lease term coterminous with renovation completion by Final Proposal Revisions; control must be demonstrated within 30 days of lease award. Renovations shall be completed in no more than two phases, with the Government granted 35 working days pre-completion access for FF&E installation and 25 working days between phases for occupancy and vacating. The Government pays rent on the entire current premises during renovation but not on swing space. The lessor is responsible for all moves, interim moves, and restacking beyond one move per Government employee. The required submittal includes a detailed narrative outlining staff moves and operational continuity, computer-generated floor plans at 1/8" = 1'0" scale showing swing space finishes, and a comprehensive schedule demonstrating adherence to lease requirements across all phases.

RLP EXHIBIT K SWING SPACE

SS 1.01 SWING SPACE - RLP (MAY 2026)

A. A renovation of the Space at the current location (400 C Street, SW or 500 C Street, SW) will be required to meet all the requirements of this

RLP package, including the schedule requirements outlined under the Lease. The RLP package outlines a level of base building/shell requirements, tenant improvements and BSAC that will require all or portions of the Space to be vacant during renovations.

B. As part of the initial offer, the incumbent Lessor must submit a plan and schedule outlining specific swing space alternatives meeting the requirements stated herein and under Lease paragraph “Swing Space - Lease.” Any plan or schedule that does not efficiently or timely house the Government’s requirements or fails to adequately prevent disruption of Government operations may be rejected and the offer may be considered technically unacceptable. The swing space plan and schedule must include, at a minimum, the following:

1. Detailed narrative demonstrating how renovations are proposed at the current location(s) in accordance with all of the requirements of this RLP/Lease package, including requirements set forth in this paragraph and Lease Exhibit - Swing Space. Narrative must clearly identify the number of Government staff member moves and outline how renovations will occur with minimum disruption and interference with ongoing Government operations.

2. Floor plan (computer generated plans set to 1/8” = 1’0” preferred) indicating block(s) of swing space including swing space finishes; and

3. Schedule of swing space and final Space to address interim moves demonstrating adherence to Lease schedule, inclusive of all phases, commissioning, and testing requirements.

C. Swing space must meet the agency “Swing Space Requirements” attached.

Swing space must meet the following:

1. Turnkey swing space ready for occupancy in a condition that is “like for like” with the current location(s) and that meets all of the minimum requirements of the RLP and Lease. The Lessor will be responsible for providing and paying for swing space equal in size to the amount of space vacated from time to time in either 400 C Street, SW or 500 C Street, SW, but in no event less than 147,278 ABOA SF if offering 400 C St., SW, or 137,614_ABOASF if offering 500 C St, SW. Lessor shall, at its sole cost and expense, be responsible for all renovations, FF&E, IT/Telecom/AV/Security cabling and infrastructure, Level 4 security screening and other measures, connections to FEMA Networks, and other expenses necessary to provide the turnkey Swing Space. All tenant improvements to the Swing Space shall be in accordance with plans and specifications approved by the Government.

D. Swing space must be located in the same building.

Swing space offered at a location other than 400 C Street, SW or 500 C Street, SW must have the following area of consideration. An area bounded as follows: CENTRAL EMPLOYMENT AREA (CEA) of Washington, DC.

Buildings with Property boundary(ies) on the boundary streets are deemed to be within the swing space delineated Area of Consideration.

E. Offeror shall demonstrate ownership of the proposed swing space through deed or other valid document. If the incumbent is not the owner of the offered property for swing space, an executed Letter of Intent for leasing such swing space to the Offeror, reflecting a minimum lease term coterminous with the completion of the renovation of the Space, must be submitted no later than Final Proposal Revisions. If selected, control through ownership, lease, or binding option of such specific alternatives must be demonstrated within thirty (30) days after Lease Award.

F. The Government reserves the right to require a single group of employees (including contractor personnel) or successive groups of the

Government employees to be moved into and out of the swing space, based upon the Incumbent Lessor's proposal. Each FEMA organizational component and sub-component must remain intact, with its employees collocated together and not intermingled with other organizational components, throughout the phased renovation. The Government must be responsible for the cost of moving each Government employee one time only, which must be identified as the last and final move from the swing space to the final Space. The Incumbent Lessor must be responsible for the cost of all moves, interim moves, and restacking in excess of one move per Government employee.

G. The renovation of either 400 C Street, SW or 500 C Street, SW, shall be completed in no more than two (2) phases. In the event of a phased renovation: the Lessor’s construction duration set forth in Lease Paragraph 4.01 (J) shall be divided among the phases in proportion to the square footage of each phase; the Government shall be granted access to each phase for purposes of installing Government Furniture Fixtures and Equipment (FF&E) at least 35 Working Days prior to the completion of each phase; and the Government shall be granted at least 25 Working Days in between each phase in order to occupy such phase and vacate space to be renovated in the next phase.

H. The Government will pay rent on the entirety of the current leased Premises at either 400 C Street, SW or 500 C Street, SW (depending on which building is offered under this RLP) during renovation for the term remaining under the existing FEMA lease but will not pay rent for the Swing Space.

I. Prior to Final Proposal Revisions, the Incumbent Lessor must submit a swing space layout that allows the Government to function efficiently during renovation of final Space, as determined by the LCO.
