APPLICABLE REGULATIONS GOVERNING PROCUREMENT

This is an emergency solicitation conducted under NRS 333.300(4), NRS 333.380, and NAC 333.150. The State reserves the right to waive formal solicitation requirements.

All applicable Nevada Revised Statutes (NRS) and Nevada Administrative Code (NAC) documentation can be found at: www.leg.state.nv.us/law1.cfm.

Prospective vendors are advised to review Nevada’s ethical standards requirements, including but not limited to NRS 281A, NRS 333.800, and NAC 333.155.

PROJECT OVERVIEW

This solicitation replaces solicitation 99SWC-S1692. Qualified vendors from both solicitations are considered one pool.

The State of Nevada Purchasing Division, on behalf of The Department of Health and Human Services (DHHS), Division of Public and Behavioral Health (DPBH) for the benefit of all State and local governments in Nevada is seeking proposals from qualified vendors to provide monoclonal antibody treatment mobile or fixed outpatient services for treatment of SARS-CoV-2 / COVID-19 as described in the scope of work and attachments.

The State intends to award multiple contracts in conjunction with this Request for Qualifications (RFQ), as determined in the best interests of the State. The State of Nevada, Purchasing Division shall administer contracts resulting from this RFQ. The resulting contracts are expected to be for a contract term of four years, subject to Board of Examiners approval.

This is a rolling award solicitation. The State reserves the right to accept and evaluate additional proposals for award after the initial submission deadline. The State will decide when and if additional proposals will be accepted at its discretion. All awarded contracts will have the same termination date as the first executed contract. Any contracts awarded during a successive enrollment period will be for the remaining term.

Usage of these contracts is as needed, and the State makes no guarantee of usage. This RFQ is non-exclusive and does not prevent individual Using Agencies from conducting their own solicitations for the same or similar services.

AGENCY BACKGROUND

Recent updates to the Emergency Use Authorizations (EUA) for COVID-19 monoclonal antibodies by the FDA expanded the definition of “high-risk” outpatients who are eligible for treatment and provide greater latitude to healthcare providers to exercise their clinical judgment.

In support of implementing this update, the State is conducting this RFQ to identify vendors to provide treatment as pop-up/mobile services to hopefully prevent people who have contracted COVID-19 from severe effects, entering the hospital system, and death.

The entities listed below are potential users of the contracts from this RFQ. Collectively these are known as “Using Agencies.”

State of Nevada departments, divisions, institutions, boards, commissions and other agencies in the Executive Department of the State Government, as defined in NRS 333.020(10).

State of Nevada Legislative and Judicial Departments and Civil Air Patrol pursuant to NRS 333.469.

Nevada System of Higher Education and Nevada political subdivisions or other entities including counties, cities, towns, boards, school districts, other districts, or any agency or department of a county or city pursuant to NRS 333.470.

GOALS AND OBJECTIVES

The State intends to select multiple Contractors and employ each Contractor on a case-by-case basis according to the needs of each Using Agency.

The State reserves the right to remove any Contractor from the qualified vendor list and to share the list of eligible providers with any entity it deems necessary.

This RFQ will save time and valuable, scarce resources, while avoiding duplicate solicitations being generated at similar times. This procedure follows 2 CFR Part 200 of the Uniform Administration Requirements which states: “To foster greater economy and efficiency, and in accordance with efforts to promote cost-effective use of shared services across the Federal government, the non-Federal entity is encouraged to enter into agreements where appropriate for procurement or use of common or shared goods or services.”

All procurement transactions shall be conducted in a manner to provide, to the extent possible, practical, open, and free competition.

We encourage small businesses, minority companies, veteran-owned and women-owned enterprises to apply.

SCOPE OF WORK

Contractor will provide services as described herein. Proposal should not include a line-by-line response to each SOW, but rather an acknowledgement that vendor agrees to all listed requirements.

Proposal response to Scope of Work should provide a detailed, narrative style explanation of Vendor plan for ensuring SOW requirements are met throughout the contract and individual projects.

If Vendor is unable to meet a Scope of Work requirement, that must be explicitly stated in Proposal response.

USAGE

Pursuant to NAC 333.114, the Department of Administration, Purchasing Division Administrator retains the authority to authorize an emergency contract as he or she determines that the emergency purchase is in the best interests of the State.

The State of Nevada and its eligible entities reserves the right, at any point during the life of the contract, to limit the scope and/or establish additional qualifications, specifications or other requirements, for services contracted under this RFQ.

Using Agencies should attempt competition from Contractors when awarding a service agreement if practicable.

Using Agencies must execute a written Service Agreement with the Contractor prior to starting work.

Usage of resulting contracts will be in accordance with a signed Service Agreement (or similar document) between the Using Agency and Contractor. The Service Agreement will identify any scope of work information not listed in this RFQ or the vendor proposal.

The order of precedence for Service Agreements are:
