Summary of Changes
Header Level Changes:
The Solicitation Close Date is changed from 2018-12-07 to 2018-12-11
959P0019R0002 Electronic Monitoring Services
The purpose of this Amendment is to incorporate the following:
1. Provide response to questions received through November 27, 2018. Questions are provided below. PSA response follows each in red italic font.
2. The closing date/time for this solicitation is hereby changed to December 12, 2018 at 10:00 am
ET.
3. No further questions will be accepted.
Questions & Answers
1. Is this a new requirement or is there an incumbent vendor? If available, can you please send along the incumbent contract number? This solicitation will replace an existing, expiring contract. The current contractor is Sentinel Offender Services and the contract number is PSA13004511.
2. In regard to the new RFQ, the original synopsis lists “This solicitation is issued as a 100% set aside for small business concerns”, however the pdf document
959P0019R0002_Electronic_Monitoring_Services, has the Set Aside box marked with 100% for, but the Small Business box is not checked. The “X” for the Small Business was inadvertently omitted in
Block 10 of the SF1449. This solicitation effort has been issued as a 100% set-aside for small business concerns. A revised SF1449 is included with this amendment.
3. Is there a contractor that fulfilled the same or similar efforts? If yes, could you please provide the incumbent contract ID and the Contractor’s name for the effort? Refer to PSA’s response to question
1 above.
4. Page 51: Product Samples. Are product samples to be included with the proposal or will the agency request samples from selected vendors? Product Samples, as referenced in Provision 52.212-1(c), are not required by this solicitation and is not applicable. Offerors do not need to send in product samples.
5. Where in the proposal should we insert the signed Standard Form 1449? Refer to question 7 below.
6. Where in the proposal should we insert the filled in document “Representations, Certifications and
Other Statements of Offeror”? Refer to question 7 below.
7. As this is a re-bid of a previous solicitation and the solicitation documents are, if not identical, very similar in many ways, we just wanted to make sure that it is the intention of the agency to reduce the number of pages significantly in Volume 1? From our experience, 20 pages to describe the organizational experience, personnel qualifications and the entire technical proposal is very tight.
(The RFP document (Section C) spends 13 pages to just outline what the proposal is to address in 20 pages.) May we suggest that an additional 10 pages be added to Volume 1, Section 2 in order to accommodate the a) the new information requested and b) the subsections moved to Section 2
(compared to the original solicitation)? Even at 10 pages added the page limit is 5 pages less than in the previous RFP. Refer to the table below for changes to the page limitations and proposal volume structures. The total page limitation for Volume I has been increased to 40 (the SF1449, SF30, proposed changes to the QASP, resumes, licenses, and certifications are not included in the overall page count). Volume II remains unchanged at 5 pages for the pricing proposal, but shall also include the Representations, Certifications and Other Statements of Offerors (which is not included in the page count).

Past Performance (Volume I, Section 3): The Offeror shall identify a minimum of three (3) contracts/task orders with the Federal, State, or Local Government and/or commercial customers that demonstrate a recent and relevant past performance. Recent is defined as within the last three years. Relevant is defined as work similar in complexity and magnitude of the work described in the
PWS as either the prime or subcontractor. Offeror shall notify each of their references that they may be contacted by PSA and authorized them to provide the past performance information requested.
Past performance information shall include, at a minimum, the following information:
Reference company name, address, point of contact, phone number and email address;
Contract number;

Offerors are highly encouraged to follow up with their references to ensure submission of the completed questionnaire prior to the date and time specified for submission of offers. Past performance questionnaires should be completed and returned for any proposed subcontractors as well. It should be noted that, since the questionnaires are submitted directly to the PSA

PSA will not provide Offerors with copies of completed questionnaires.
The Government reserves the right to consider other information obtained through other sources.
Proposed Changes to Quality Assurance Surveillance Plan (QASP) (Volume I, Section 4): The Offeror shall submit any proposed changes to the Quality Assurance Surveillance Plan (QASP) provided with the solicitation. In reviewing the QASP, offerors are advised that additional funds are not available to support monitory positive incentives. Positive incentives proposed must be non-monitory. If the proposed QASP is acceptable without requested changes, the Offeror shall so state.
Resumes, Letters of Commitment, Licenses, Certifications, and Information Security Requirements

The daily price per defendant shall be fixed and shall be inclusive of all labor, supervision, materials, monitoring, management, equipment, testimony and other costs as may be associated with providing the required services identified within the
Performance Work Statement and other requirements of the contract. The variable shall be the actual number of active defendants under electronic monitoring supervision during any given day.
For the purposes of estimating, Offerors shall base extended amounts on an estimated 475 defendants per month (this quantity is for estimation purposes only and should not be interpreted as a guaranteed minimum or maximum ceiling limit). Price proposals shall include a summary of the base year and each option period using the format below. Offerors should not include pricing information on the Standard Form (SF) 1449.

Subcontracting: This solicitation has been set aside for small business concerns and is therefore subject to FAR 52.219-14, Limitations on Subcontracting. In accordance with FAR 52.219-14(c), by submission of an offer and execution of a contract, the Offeror/Contractor agrees that in performance of the contract in the case for Services, at least 50 percent of the cost of contract performance incurred for personnel shall be expended for employees of the concern.
To ensure compliance with the Limitations on Subcontracting, Offerors proposing to outsource/subcontract work under this contract shall:
Clearly identify the proposed subcontractor;
Clearly identify the role the proposed subcontractor; and
Provide clear evidence of compliance to the requirement that at least 50 percent of the cost of contract performance incurred for personnel is expended for employees of the concern.
Representations, Certifications and Other Statements of Offeror (Volume II, Section 2): Provide a copy of the completed Representations, Certification and Other Statements of Offeror.
8. It is unclear whether Standard Form 1449 should be returned as part of the Technical Proposal, the
Price Proposal, or included in both volumes. Is there a specific place within the proposal where the form should be included? Refer to question 7 above.
9. Box 10 on page 1 is marked for a Set Aside of 100%, but none of the boxes below are checked. Based on Pages 34, 48, and 51 it appears that the solicitation has been set aside for “Small Business.” Can you please confirm? Refer to question 2 above.
10. Regarding the directions in Box 28, can you please confirm that you only want the original form to be signed and returned since the box for the number of copies is blank? Only one copy needs to be returned. An undated copy of the SF1449 is included with this amendment.
11. The directions at the top include boxes 23 and 24 to be completed by Offeror. Since these are not editable fields, and because there is to be a separate Price Proposal, can we assume that boxes 23 and 24 are not to be completed? Correct, blocks 23 and 24 of the Standard Form 1449 do not need to be completed. Pricing should be provided in the separate Price Proposal. Refer to Section L of the solicitation package and question 7 above for guidance on preparing the Price Proposal.
12. In addition to the Summary Table required on page 51 under Price Proposal (Volume II), is Section B
– Supplies or Services and Prices/Costs, beginning on page 4, also to be filled in and returned as part of the five )5) pages of the Price Proposal? Offerors do not need to complete and return Section B of the solicitation package. All pricing should be identified within the Offeror’s Price Proposal (Volume
II).
13. The Formatting instructions on page 48 state that the proposals must be submitted in two separate volumes, but the table on page 49 shows a Transmittal/Cover Letter without a Volume number. Are you requesting a separate Transmittal Letter for each volume, or that the Transmittal Letter be submitted as a separate document from Volumes I and II? Refer to the question 7 above.
14. When you request “labor category(s) on page 50, are you asking whether staff members are exempt or non-exempt? If not, can you please clarify? The intent is to determine the role the proposed individual will fill (e.g., on-site project manager, technician, etc.). We are looking to match the qualifications within the resume with the proposed position the particular individual will be filling.
15. Is Section K – Representations, Certifications, and Other Statements of Offerors to be returned in its entirety? Or would you prefer offerors only return the pages(s) applicable for their situation based on the instructions on what paragraph(s) to complete? Section K should be returned in its entirety.
16. If Section K is to be returned with the proposal, can you please specify where it is to be included?
Refer to question 7 above.
17. With the addition of the requests for information about the information security program, including the detailed response to the Questionnaire, and the narrative about asynchronous data exchange, this solicitation now requires more detail than Solicitation Number 959P0018R0026 required.
However, the page limits are fewer than were previously permitted after the Q&A was complete.
Will you please allow an additional 20 pages for Section 2: Technical Proposal and two (2) additional pages for Section 3: Past Performance so that vendors can provide a complete response to the requirements? Refer to question 7 above.
18. Form 1449 line 17a PSA is requesting cage code and facility code. Is the cage code and the facility code the same code? For Block 17a, please enter your DUNS number in space for the “CODE” and your CAGE Code in the space for the “Facility Code”.
19. Section C – 7.1. On-Site and Remote Staffing Requirements (page 9 of RFP). Paragraph 1 states the
Agency requires the contractor to provide fully qualified staff representatives on site to a) install, remove, maintain, retrieve and account for electronic monitoring equipment Monday through
Friday from 8:00 am to 5:00 pm or until completion of daily tasks and b) contractor staff maybe required to work during inclement weather when federal government offices are closed (according to OPM) and PSA is operating. The COR will notify contractor personnel when necessary. Will PSA please provide its recommendation as to the number of dedicated, full-time, on-site staff the contractor should provide to manage the requested services? PSA is not specifying the number of staff needed. Offeror’s should carefully review the requirements and propose appropriate staffing levels. Additionally, will PSA please confirm the number of dedicated (only to this program, not shared with any other local program) staff the current vendor provides onsite to service the PSA program? The current contractor has four (4) employees dedicated to the Electronic Monitoring
Program and one open field technician position. Two on-site office staff, one field technician, one employee located at the courthouse (500 Indiana Avenue, NW, Washington DC). However, Offeror’s are reminded that they should determine their own staffing levels to be proposed based on the services required in Performance Work Statement.
20. Section C – 7.3. System Requirements (page 10 of RFP). Paragraph 8 states the CMS must be able to scale vertically and horizontally based on the agency needs. Scaling vertically would allow the agency to increase or decrease the number of defendants under supervision, while scaling horizontally allows the agency to increase its hardware capacity. The automated system scalability options should not affect the case manager’s ability to perform supervision duties or impede the agency’s daily operation. What we are offering is cloud based and will automatically scale. Is this referring to a customer hosted option?
21. Section C – 7.5. PSA Client Management System Interface (page 11 of RFP). Paragraph 3 states the objective is to implement two-way communications so that PSA can make a request to vendor’s web service for specific data or action, and the vendor in turn will feed the requested data into PSA’s web service. To clarify, is the expected result to create a pull service so PSA can request information when needed?
22. Section C – 7.5. PSA Client Management System Interface (page 11 of RFP). Paragraph 4 states the
Web Service shall include endpoints for the following services, respective acknowledgments, and error handling:
Defendant enrollments and terminations
Equipment installations, removals, and service calls
Defendant events and alerts
Defendant’s GPS points, location addresses correspondent to the alerts
We have existing endpoints for this, but is PSA expecting us to implement a specific API specification? i.e. is PSA going to code their system to our existing API or are we going to provide a new API that conforms to their existing specification?
23. Section C – 7.5.1 Defendant enrollment and termination (page 11 of RFP). The web service shall make an endpoint available so PRISM can electronically request equipment installation, removals, or service calls. At a minimum the vendor’s CMS shall accept and respond with the following:
Equipment Serial Number (unique identifier), Equipment Type (Cellular, Landline, GPS, Cellular + GPS, and Landline + GPS) , Equipment Name, Equipment Status (active, inactive), Date-time install requested, date-time install completed, Date-time removal requested, date-time removal completed, Date-time service call requested, date-time service call completed, Location installed – address.
What address is this? Where the offender lives? Where we installed a beacon or other “fixed” asset? Where the offender was when we attached the device to their leg? Assuming the question is actually referring to Section C – 7.5.2 Equipment installations, removals, and service calls – the “Location installed – address” is the address where the defendant lives.
24. Section L – Page 49 of RFP – Volume I: Technical Proposal Section 2. The page allowance is twenty
(20) pages (not including resumes, licenses and certificates). Will PSA also consider allowing proposers to submit the required “Transition Plan” as an attachment that is not counted against the
Technical Proposal Section 2, 20-page allowance? PSA has increased page limit for Volume I which should allow adequate space for the transition plan within the new limits. Please refer to question 7 above.
25. Section L – Pages 49-50 of RFP – Volume I: Technical Proposals states “At a minimum, the offerors
Technical Proposal must discuss” 1 – 6 and a – j. Are the required “must discuss” topics 1-6 and a-j to be addressed within specific sections of the proposal response or can they be answered through the proposal as appropriate? If they are to be addressed within specific sections, will PSA please clarify the sections in which responses to items 1-6 and a-j should be placed? Refer to question 7
26. Section L – Technical Proposal, Volume I, Section 2 Page 49 of RFP – 2. The proposed methods and techniques for completing each task. Will PSA please clarify which “tasks” this requirement is referring to? This requirement refers to the methods and techniques the potential contractor will use to complete all requirements of the contract.
27. Section L – Page 50 of RFP – h. Applicable labor categories and quantities of each to be utilized for this effort. Will PSA please confirm that vendors can utilize the Labor Categories from the Bureau of
Labor Statistics, United States Department of Labor for this response? The intent is to determine the role the proposed individual will fill (e.g., on-site project manager, technician, etc.). We are looking to match the qualifications within the resume with the proposed position the particular individual will be filling. Use of the labor categories from DOL is not necessary.
28. Can this act as a FOIA request or does PSA require a vendor to receive information regarding vendor and or current contract pricing? Official FOIA requests must be submitted through the Court Services and Offender Supervision Agency (CSOSA) General Counsel’s office. Additional information on FOIA requests can be found at https://www.csosa.gov/foia/. However, the specific information being requested can be provided without going through FOIA and is provided below.
a. If this will act as FOIA or you are allowed to provide this information what is the current daily rate of the current vendor? The pricing structure with the current contractor is slightly different than what is being requested in this solicitation. Pricing for the current vendor is
$4.86 per day/per defendant and is inclusive of all costs less costs associated with the FTE located at 500 Indiana Avenue, which is billed at $4,147.98 per month. The current rate is
$4.86 per day/per defendant plus $4.147.98 per month. Offerors are reminded that for this https://www.csosa.gov/foia/ solicitation effort, PSA is seeking a single per day/per defendant rate which is inclusive of all services and service locations as identified in the Performance Work Statement.
b. Who is the current vendor? Refer to question 1 above.
29. Regarding page 4 – Section B – Supplies or Services and Prices/Costs – We have several questions about this:
a. Prices are to include on-site staff and install/removal services? PSA is seeking a per day/per defendant rate that is inclusive of all services identified within the Performance Work
Statement.
b. In the RFQ narrative and here there is no place to provide replacement equipment costs that is lost, intentionally damaged or stolen. Who is financially responsible for lost, stolen or intentionally damaged equipment? If PSA is, where do we put replacement costs for equipment? The contractor is responsible for these costs and should be factored into the per day/per defendant rate.
30. Regarding page 8 – 3. Scope of Work – “The contractor’s database should have scalability to store and retrieve electronic and location monitoring data for 7200 defendants each year of the contract, whether active or inactive.” Does this number represent and expected size of the caseload for PSA or the number of pretrial defendants that are active and achieved to date? This number represents the number of pretrial defendants that are active and achieved to date.
31. Regarding page 9 -. Applicable Document – “The following PSA policies apply to all contractors and can be found on PSA’s intranet site “MyPSA” Contractors will be required to comply with the most current version available on MyPSA.” We have several questions about these policies and this requirement:
a. PS3420 – We presume this was directed to any on-site contractor employees? Correct, this applies to on-site contractor staff.
b. PS5002 – There is a place where the employee will sign and are acknowledging the PII. Is there another form that the contractor would sign? At this time, there is no other form for use specifically by contractor personnel. Therefore, contractor staff will be required to sign the current form, noting that they are a contractor and the company name for which they are employed.
32. Regarding Page 9 – 7.1 – on-site and Remote Staffing Requirements. We have several questions about this:
a. Does your current vendor provide the staff for installation, removal and on-site and remote staffing currently? Yes.
b. If so, how many staff are there to support the contract as of today? Refer to question 19
c. To better determine how many staff would be required, how many installations does PSA have per month? During fiscal year 2018 (October 1, 2017 through September 30, 2018), the average number of installations was 116.
d. How many removals does PSA average per month? During fiscal year 2018, the average number of removals was 122.
e. To clarify, PS will not need priority type service for installs? IN other words, all installs can be completed in 24 hours after contacted by court/PSA? Installations that are requested to occur at the court are considered priority and should be completed within 15 minutes of the court’s request. However, the contractor has 24-hours to complete the installation process which includes updating their client management system (CMS), installing the equipment on the defendant within fifteen (15) minutes of the notification, scheduling any home visits that may be needed to complete the installation and ensure that the equipment is functioning properly.
f. Is current vendor staff dedicated to installs and removals based out of an office or are they remote and go to one of the four places of performance, defendant’s residence, or designated location? The current vendor staff is based on site at 633 Indiana Avenue, NW, Washington, DC & 500 Indiana Avenue, NW, Washington, DC. There are times when the field technician is required to install or remove equipment at the defendant’s residence or designated location.
g. To assure safety for the installer, is it possible for PSA officers to accompany the installers when installs are done at defendant’s residences? No, the agency does not have staff available to accompany the installers.
h. Will the PS provide office space for installers and on-site personnel or is it the vendor’s responsibilities to acquire their own office space? PSA will provide office space at one or more of the four places of performance.
33. Regarding page 9 – 5) item d – The on-site staff is to be responsible for entering exclusion zone into contractors automated system within 15 minutes of installation of monitoring equipment. I may have missed it but does the vendor’s on-site staff also enroll all PSA defendants as part of the daily responsibilities? Yes, the contractor’s on-site staff will be responsible for enrolling the defendant into the contractor’s client management system, which includes the entry of the stay away and any information pertaining to the defendant’s enrollment.
34. Regarding page 10 – 7.2 – Equipment – item 4: - “The contractor shall be responsible for ensuring adequate inventory is on site and readily available (operational) to ensure installation on defendants within fifteen (15) minutes of notification.” In section 7.1 – On-site and remote staff requirements, it states that installations should be completed in 24 hours and this is stating 15 minutes after notification of install. We have a couple of questions about this:
a. Was this used as an example to assure enough strap for unexpected demand by the court for pretrial release? The contractor has 24 hours to complete the installation process which includes updating their client management system (CMS), installing the equipment on the defendant within fifteen (15) minutes of the notification, scheduling any home visits that may be needed to complete the installation and ensure that the equipment is functioning properly.
b. How often does this occur where you need installs completed in less than 24 hours per month? Do you have an actual number of installs that this occurs? During fiscal year 2018, PSA required less than 5 installation and/or service requests to be completed in less than 24 hours.
c. What does the current vendor provide as allowable spare shelf inventory as a percentage of devices on defendants monthly? For example, 20% of 475 defendants active would be 95 units in spare inventory. PSA does not require the vendor to maintain a specific number or percentage of spare shelf inventory. Offeror’s must determine what is adequate to maintain the continuity of the contract. The current vendor maintains an average of 20 spare devices.
35. Regarding page 11 – 7.4 – Training – How many staff would need to be trained to initiate the contract? How many sites would you anticipate the vendor would be training at? A minimum of 30
PSA staff members will require initial training. Training would be at one of the four places of performance. PSA would attempt to provide training in one central location.
36. Regarding page 11 – 7.5 – PSA Client Management Interface – Is the current vendor already interfaced with the PRISM – Client Management System? Yes
37. Regarding page 13 – 10. – Deliverables – item 3 in the table – what information is PSA wanting the vendor to specifically provide PSA’s law enforcement partner agencies? Are you looking for vendor to provide access with specific permission levels to the vendors’ client management system or provide automated crime scene incident reporting or something else? PSA will be the agency with access to the CMS. The contractor will provide PSA staff with tracking information upon request from a requesting law enforcement agency. This would include current location and defendant’s movement history for defendants currently or previously under the supervision of PSA.
38. Regarding page 14 – 10. – Deliverables table item 6. – Court testimony – Could you please share how many times your current vendor has provided court testimony in calendar year 2018? Calendar year 2018 is not complete, however, during fiscal year 2018, the agency received twenty subpoena request for records and less than 5 required court testimonies.
39. Regarding the Quality Assurance Surveillance Plan – We have a questions regarding this:
a. Has the current vendor had a satisfactory AQL for the duration of the contract? PSA cannot comment on assessment of the current contractor Quality Assurance Surveillance Plan.
40. Section 1: Executive Summary has a one (1) page requirement, will PSA consider increasing the page limit to up to two (2) pages? Refer to question 7 above for revised page limitations.
41. Section 2: Technical Proposal (Resumes, Licenses, and Certificates do not count toward the page limitation) has a 20 page limit, will PSA consider increasing the page limit to up to 25 pages? Refer to question 7 above for revised page limitations.
42. Would the PSA consider capping the amount of equipment allowed to be lost/stolen/damaged at a level of 30% of the active number of defendants being monitored? And, b) would the PSA agree to pay for equipment exceeding the 30% lost equipment allowance provision? c) if not, does the successful offer have the ability to charge the defendant for lost/stolen/damaged devices, and/or seek charges against the defendant? No, PSA would not consider capping the amount of equipment allowed to be lost/stolen/damaged. The agency provides support in the collection of equipment from the defendants via case management and court judicial directives; however the defendants cannot be required to pay for lost/stolen/damaged equipment.
43. Please confirm PSA will continue to require five (5) dedicated local FTEs for the day to day support of the PSA Program as follows:
a. Program Manager + a back up to ensure coverage
b. Two (2) field technicians
c. Office Coordinator
d. Court house Technician
It is PSA’s intent to issue a performance based contract and are therefore not dictating the number of FTE’s to be provided by the successful Offeror. Offerors are advised to carefully review the requirements within the Performance Work Statement and proposal staffing levels accordingly.
44. The requirement for the Technical Proposal are a bit confusing. Can more clarity be provided on what items should be discussed in which sections? For example, there is a paragraph copied below that appears to belong in Section 2B Personnel Qualifications, but the list of items below (under “At a minimum, this sections of the proposal must include:”) includes three items that do not appear to relate to Personnel.
Offerors shall include (1) staffing plan, (2) resumes for key personnel, and (3) a description of your current personnel resources, which addresses their capabilities and experience related to the Performance Work Statement. At a minimum, this section of the proposal must include:
a. Organizational Structure (Org chart and resource headcount required to support the requirement),
b. Section 7.5 of the PWS requires the successful offer to provide a secure means for asynchronous data exchange between their CMS and PRISM via a secured Web Service. Include a brief narrative of how the offeror will meet this requirement,
c. The successful offeror must provide a detailed response to the Information Security
Requirements Questionnaire in Section 12.2.2
d. Definition of the primary skill set required for each role,
e. Description of resource planning processes and procedures to support the changing needs of the environment,
f. Description and definition of management methods and processes for all types of support activities, Description of resource training, skills development and certification approach, g.
Resumes and letters of commitment are required for all proposed staff. Resumes should be limited to three pages each and must include the proposed labor category for the individual,
h. Applicable labor category(s) and quantities of each to be utilized for this effort,
i. Brief narrative of offerors approach for conducting the product demonstrations as further described in the "Information Regarding Product Demonstrations found within this Section and
Section M which describes how the demonstrations will be evaluated and
j. Description of skills and experience per category.
Do you want the information about asynchronous data exchange and the Information Security
Requirements Questionnaire to be included in Section 2B as is implied by the location of the requirements? Can we assume that i. product demonstrations narrative belongs in Section 2D
Product Demonstration Plan, or do you also want more information in section 2B about the demonstration?
Please refer to question 7 above which provides additional clarity regarding the proposal structure/format and revised page limitations.
45. Can you confirm that your preference for discussion regarding items 1 through 6 above that paragraph would be in Section 2A, Management Approach and Technical Capabilities? Please refer to question 7 above which provides additional clarity regarding the proposal structure/format and revised page limitations.
