Single Source Justification FAR 13.106 - Not Exceeding the Simplified Acquistion Threshold

1. Nature and/or decription of the item/service being procured and anticiapted cost.

The Court Services and Offender Supervision Agency (CSOSA), Office of Information Technology, requires continued maintenance and support for the agency’s licenses of the ServiceWise helpdesk ticket tracking system software. CSOSA already has an existing purchase order, 9594CS19P0006, which expires on May 2, 2024, to the below identified Contractor.

The annual anticipated annual price for maintenance and support of the above identified licenses is $22,240.00. This acquisition will include one 12-month base period and two 12-month option periods for a total estimated value at $66,720.00 ($22,240.00 per period of performance).

TechExcel, Inc. is the only manufacturer of the ServiceWise software CSOSA has standardized on. In addition, there are no resellers for this product.

CSOSA has a separate help desk database supporting each of the following six CSOSA offices:

• Office of Information Technology (OIT);

• OIT Change Control;

• Office of Human Resources (OHR);

• Office of Community Supervision and Intervention Services (OCSIS) – GPS Section;

• Office of Research and Evaluation (ORE); and

• Office of Facilities (FAC).

These separate help desk databases were individually customized to each of the CSOSA offices identified above by a consultant from the TechExcel, Inc. To standardize on a different product would require the agency to duplicate costs as follows:

• Cost to purchase new software licenses (vs only purchasing maintenance and support from the current manufacturer, TechExcel, Inc.). Market research of competitor software products, such as ServiceNow and Zendesk, are estimated to cost $100,000.00 for the initial software purchase.

• Cost of training staff. There are currently 20 users of the software product in the six CSOSA offices. Selecting a different product would require all of the users of the software product to be trained on the newly awarded software product. The single source justification approved for the current purchase order identifies this training cost as $5,000 per person. Using this same amount (without escalating to today’s costs) would result in an estimated additional cost of $100k if a different product was purchased (20 users x $5k each user = $100k).

• Implementation. The implementation of each help desk databases for each of the six CSOSA offices required effort spread across approximately three to four months to plan, configure and deploy. Costs for deployment included:

o A software manufacturer consultant at approximately 40 hours x $150/hr x

7 days = an estimated cost of $54,000.00; and o A GS-14, IT Specialist, at $78.36/hr for 40 hours = $3,135 (rounded)

The above costs do not include the time for users to work with the consultant and OIT staff to identify workflow and other requirements to configure the software for each individual CSOSA office.

• Lastly, to implement new software help desk would also require a security assessment and authorization. Costs for a security assessment and authorization for a system of this size is approximately $30k, based on an average of historical costs CSOSA has experienced for systems of this size.

Based on the above, the estimated total cost of implementing a new product will result in a significant amount of duplicated costs (over $200k). In addition, once an alternate software product is selected and implemented, each year of maintenance and support will require a justification to continue with that software manufacturer. Therefore, there is no benefit to the Government to spending additional costs to select purchase an alternate software product as that will only result in the same limit competition situation once that alternate product is installed.

3. The anticipated price will be determined fair and reasonable based on one or more of the price analysis techniques described below in accordance with FAR 13.106-3(a)(2).

The current purchase order, 9594CS19P0006, includes several periods of performance for maintenance and support where the costs can be used as a comparison for the cost quoted by the software manufacturer for continued maintenance and support. In addition, the IGCE (which will be based on historical pricing on the current acquisition) will be used to determine the quoted price is fair and reasonable.
