SECTION C (Continued) Information Technology Specialist (Infrastructure Management Branch Project Manager)
Full-Time Personal Services Contractor (PSC) One (1) one-year base year (2,087 hours per year), renewable for up to four (4) one-year option periods at the sole discretion of the Government.
3B/3A ($47.91 $89.19 per hour) In lieu of fringe benefits, the PSC will receive a pay supplement of 15% of the employee's direct labor cost.

This position is located at the Millennium Challenge Corporation (MCC) in Washington, DC and/or the selecte's home of record.
Time-and-Materials (T&M) with One (1) twelve month Base Period and four (4) twelve month Option Periods.
Multiple awards (2) will be made from this solicitation.
This position is located within the Infrastructure Management Branch, in the Office of the Chief Information Officer within the Department of Administration and Finance (A&F) of the Millennium Challenge Corporation (MCC) and reports to the OCIO Infrastructure Management Branch Director. The Incumbent serves as the Infrastructure Management Branch Project Manager.
MCC requires a personal services contractor (PSC) to provide end-to-end operation and management of the MCC's Enterprise Network Architecture. The Infrastructure Management Branch (IMB) also provides technical support for the entire MCC networked customer community to allow smooth, uninterrupted network operation, coordinates the infusion of new technology into the network operating environment, provides operational requirements to the Enterprise Applications and Enterprise Support Services Branches within the OCIO, and provides operational technical support to various MCC projects.
The IMB performs day to day operational management of the MCC's local and wide area network infrastructure, operates the Network facilities and performs fault, configuration, and performance management for all aspects of the network and telecommunications architecture; and performs day to day operational management of the network, application servers, and office automation file servers. This includes file and print service, server-based application support, server operation troubleshooting and restoration, electronic messaging support, preventative maintenance, account administration, and backups, operation and maintenance of the enterprise systems management utilities that perform server and desktop configuration management, remote workstation operation, and software distribution.
MCC is authorized to enter into a contract with an individual as a Personal Services Contractor (PSC) under the authority of Section 614(a)(8) of the Millennium Challenge Act of 2003.
A personal services contract is different from non-personal services Government contract, which establishes an independent contract relationship. Under a non-personal services contract, the contractor or employees of the contractor are subject to the technical direction but not the supervision of the MCC. As defined by the Federal Acquisition Regulation (FAR) 37.104, a personal services contract is characterized by the employer-employee relationship it creates between the Government and the contractor personnel. Thus, the PSC is subject to the relatively continuous technical direction, supervision, and control of the MCC. PSCs may be assigned inherently governmental duties (see FAR 7.502). By law and by the contract's terms, the PSC is subject to most of the laws, rules, and regulations applicable to the direct hire employee such as MCC regulations, conflict of interest, under some circumstances MCC authorized employment security clearances and financial disclosure.
However, under the MCC personal services contract authority, PSCs are not employees for purposes of laws administered by the Office of Personnel Management (OPM).

a)
Serves as OCIO IMB's principal network telecommunications advisor, project manager, and lead for all networking systems matters. Formulates long and short-range goals and operational strategies for the execution of the section's responsibilities.
Defines and establishes requirements for development efforts for network subsystems. Such systems include the Network Management subsystem and Simple Network Management Protocol (SNMP) agents software, network file servers, network commercial-off-the-shelf software, telecommunications cabling network infrastructure (routers, hubs and switches), and work order execution for network operations and maintenance services.
Works with the IMB Director to establish technical and workload objectives, develops and implements operating policies, procedures, and support program requirements; establishes working relationships with other internal groups and external agencies and contractor offices, and acts as an interface to ensure prompt and reliable service to the user community.
Determines advanced computer-related systems concepts based on and in support of the application of computer, and communications technology for the continued modernization of the networking infrastructure. Develops techniques to provide improved computer and communication network operation and maintenance capabilities at minimum costs in material and manpower resources.
Assists in the development of plans to expand and improve, on an evolutionary basis, the network to meet MCC requirements.
Works with system developers and participates in development of the analysis, specifications, and interface requirements for automated information systems (AISs) used in conjunction with the MCC network architecture. Reviews and evaluates operational requirements of the various MCC organizations preparing system or equipment specifications required to meet the networking needs and determines installation requirements. Reviews existing operational processes and techniques, identifies deficiencies, and proposes solutions for any problems found, performs cost/benefit tradeoffs for those solutions, and develops transition plans to implement the solutions.
Manages server and storage resources, communications, network and telephone resources, communications and applications support resources, identity and access resources, disaster recovery and continuity of operations and infrastructure services delivery.
Provides technical direction and leadership in the deployment, operation and maintenance, and enhancement of the large-scale, advanced technology, networking infrastructure.
Develops network project plans, operating plans, and supporting budgets; determines scope, methods, and resource requirements and schedules for network projects and supporting analyses; coordinates actions required to implement new technology and network projects.
Provides support for the acquisition of information technology resources and services; prepares technical specifications, statements of work, and other acquisition related documentation; coordinates technical requirements with the acquisition manager.
Performs contract administration and vendor management. Directs, monitors, and evaluates the performance of work by contractors. Establishes management controls to ensure contractor charges/fees are fair and accurate, the work performed is within scope, and ensures products meet government requirements.
Produces and/or reviews policies, procedures, and desk guides to include obtaining appropriate approvals.
Represents the MCC at professional governmental and industrial organizations in the area of telecommunications information technology. Serves as the MCC representative on various working groups. Negotiates technical working agreements with other Federal agencies, and commercial organizations.
Oversees engineering and/or operational assignments of FTEs, PSCs, and contractors on projects and tasks; provides administrative and technical oversight necessary for accomplishing the work.
Performs other duties as assigned.

The incumbent reports directly to the OCIO Infrastructure Management Branch Director. The incumbent is the technical authority on all matters related to network infrastructure operations and management, and recommendations and commitments made are considered authoritative and are usually accepted without significant change. The incumbent establishes program and functional responsibilities and makes periodic special assignments.
Overall performance is viewed in the context of the successful accomplishment of the MCC automation efforts as reflected in the MCC's Strategic Information Technology Plan.

Guidelines include the Clinger-Cohen Act, the Paperwork Reduction Act, Federal Acquisition Regulations (FAR), Federal Information Processing Standards (FIPS), the Government Performance and Results Act (GPRA), the OMB guidance (M-97-
16) Information Technology Architecture, and MCC information technology policy directives, and Office of Management and Budget Circulars and Bulletins.
General guidance is also provided by the MCC Strategic Information Technology Plan, to which the incumbent provides significant input. Guidelines also exist in the MCC Life Cycle Management for Automated Information Systems Manual and the implementing Technical Standards and Guidelines, and Operational Support Planning Guidelines.
Typically, the laws, regulations, and guides do not cover specific situations, and the incumbent is often required to interpret and reconcile conflicting directives. Judgment is required to apply the guidelines appropriately to assigned projects.

The work involves complicated program interrelationships in a highly specialized multifaceted automation program upon which the incumbent has substantial influence. The incumbent investigates problems and new technologies, determines appropriate courses of action and provides completed staff work. In providing analyses, making recommendations, and performing other related duties, the incumbent encounters highly sensitive issues where his or her judgment and tact are crucial to the effective accomplishment of assigned responsibilities.

The effectiveness of the MCC in satisfying its national commitments is dependent upon the promptness with which each case is handled, and the efficiency with which phase can be carried out. The network management and technical direction provided by the incumbent directly impacts all of these factors. The improvements in data delivery and document distribution technologies will result from projects directed by the incumbent.

The purpose of contacts is to recommend and establish agreements on general policies, procedures, objectives and approaches for the implementation and administration of the MCC's IT infrastructure architecture. Personal contacts are made to identify needs for studies and analyses, formulating procedures, conducting studies and analyses, coordinating with IT infrastructure officials throughout the federal government and private industry, and ensuring the compliance with federal guidelines and oversight. Contacts are for the purpose of collecting information on the systems concepts proposed for implementation on the network from supportability and network performance points of view. The incumbent conducts industry surveys and projects of technological development in areas where MCC plans call for special computer and communications hardware and software requirements. The incumbent discusses proposed alternative technical approaches and plans modifications as solutions to actual and potential operating problems and provides technical assistance.

The work is primarily sedentary in nature, in a standard office environment, and requiring no special physical demands. Travel maybe required.

PSCs for the services of individual experts or consultants are limited by the Classification Act. In addition, the Office of Personnel Management (OPM) has established requirements which apply in acquiring the personal services of experts or consultants in this manner (e.g., benefits, taxes, conflicts of interest).
Overtime is not authorized on this contract.
The pay range for this position , inclusive of locality pay. Final compensation will be negotiated within this pay range based upon the successful offeror's qualifications and work experience. A salary above this pay range will not be entertained or negotiated.
MCC issues W-2s to the PSCs and makes the employer contribution to FICA and Medicare for the PSCs. MCC also withholds FICA, Medicare, federal tax, and state tax on behalf of the PSCs. The PSCs are not eligible for the Foreign Earned Income Exclusion.
Under the MCC personal services contracting authority, PSCs are not employees for purposes of laws administered by OPM, such as Federal Retirement Benefits and health and life insurance. As such, PSCs are not eligible for participation in the Civil Service Retirement System or the Federal Employees Retirement System. Moreover, PSCs are not eligible to receive Federal Health and Life Insurance or participate in the Federal Thrift Savings Plan.
Notwithstanding the above, and if agreed upon by the Government and the PSC before the award of a contract, intermittent PSCs may receive a pay supplement of 15% of the employee's direct labor cost in lieu of fringe benefits.

A full-time PSC earns sick leave on the same basis as direct-hire MCC employees, that is, maximum four (4) hours for every biweekly pay period. This number of hours never increases.
A full-time PSC earns four (4), six (6), or eight (8) hours of annual leave for each biweekly pay period depending on the number of years of previous federal government employment based upon determination made by MCC.
A full-time PSC working at MCC Headquarters in Washington, DC is eligible for parking or transit subsidy, subject to the availability of funds. The full-time PSC whose primary place of performance is not at the MCC Headquarters is not eligible for this subsidy.
A full-time PSC is eligible for credit hours (up to 24 hours earned) under the MCC Credit Hour Program. PSCs may not receive credit hours for time spent in travel status refer to MCC 52.237-70
, section for . PSCs may be compensated for the credit hour balance upon termination subject to availability of funds.
The PSC is subject to the Federal Travel Regulations and MCC travel policies and procedures to the same extent as MCC direct-hire employees.
In accordance with FAR 52.214-34 and 52.214-35, all submissions are to be in the English language and US Dollars.

In order to be considered for award, an offeror must, at a minimum, meet the Required Qualifications listed above in . Consideration and selection will be based on a panel evaluation of the offeror's qualifications. In addition to the required documentation listed in Section 8, offerors are encouraged to write a cover letter, not to exceed one (1) page, to highlight their suitability for this position. The cover letter is not required and will not be accepted in lieu of the required written narrative.
All submissions will be evaluated based on the documentation submitted, the offeror's evidence of the above qualification requirements, performance in a possible discussion/interview if conducted, and information provided by references if contacted. Please note that for evaluation purposes, MCC will take into consideration your proposed labor rate, including the pay supplement in lieu of fringe benefits. All submissions will receive one of three scores for each of the required and desired qualifications: Does Not Meet, Meets, or Exceeds. This contract shall be awarded directly by MCC to an individual, to a firm. At the Government's discretion, e.g., unable to identify a best-value offeror or secure funding, this solicitation may be canceled without an award and a new solicitation for this position may be issued in the future.
The successful offeror(s), who is/are found to represent the best value to the Government, may be offered a Time-and- Materials (T&M), Personal Services type contract for a one-year base period plus four (4) one-year option periods, for a total potential contract period of five (5) years.
All option periods are exercised at the sole discretion of MCC based upon performance, agency requirements, and availability of funding. The contract will be for a full-time PSC position with a maximum of over the total duration of the contract (2,087 hours/year over 5 years).

F1 DELIVERABLES
Deliverables are associated with the duties identified in Section C to include reports as required by the Contracting Officer Representative (COR).
The PSC will provide a brief monthly progress report as a regular deliverable. Monthly progress reports will consist of the following format to measure the progress of the work undertaken that month:

Monthly reports are due the first workday of each month.
Deliverables will be considered "draft" upon initial receipt. Drafts will be reviewed and accepted, or concerns raised/comments provided within two weeks of receipt. In addition to monthly progress reports, the PSC will submit biweekly timesheets on a schedule and format determined by MCC. Timesheets will include a list of hours worked per compact or country program, along with a brief description of the tasks undertaken for each program during the pay period.
The PSC also will produce other reports and analyses as requested by MCC.

The contractor shall submit time sheets for actual hours worked.
Time sheets shall be sent to the COR and/or the PM on the first Monday after the end of the pay period. The COR and/or the PM will approve the time sheets and will forward to the Interior Business Center (IBC). IBC processes payroll checks via direct deposit in the PSC bank account on the second Tuesday after the end of the pay period.
If it is determined that the time is incorrect the time sheet may be revised by the Government, or the Contractor may be required to submit a revised time sheet.
To constitute a proper time sheet, each time sheet must include the following information:
(1) Name of the Contractor
(2) Date of pay period
(3) Contract number; also, modification number, if applicable
(4) Duns number
(5) Employee Signature

a) This Personal Services Contract is authorized under Section 614(a)(8) of the Millennium Challenge Act of 2003 (MCA). The provision provides that such individuals shall not be considered Federal employees for any provision of law administered by the Office of Personnel Management (OPM). A personal services contract establishes an employer-employee relationship, making the personal services contractor (PSC) subject to the relatively continuous supervision and control of the MCC. (FAR 37.104). By law and by the terms of this personal services contract, subject PSC shall be subject to most of the laws, rules, and regulations applicable to U.S. Government employees, including the financial disclosure and conflict of interest laws and regulations as well as MCC regulations. However, under the MCC personal services contract authority, PSCs are not employees for purposes of laws administered by OPM, such as Federal retirement benefits and health and life insurance. PSCs may be assigned inherently governmental duties. (FAR 7.502).
However, it is MCC policy that PSCs shall not complete annual performance evaluations, hire or terminate the employment of MCC direct-hire employees.
b) - The Personal Services Contractor (PSC) shall submit the following required information to MCC:

c) Subject PSC is not eligible for federal retirement and insurance benefits in the same manner as provided to direct hire employees.
d) The PSC will accrue four (4) hours of sick leave for every biweekly pay period. Sick leave balances can be carried over into other MCC personal services contracts. The MCC does not compensate for unused sick leave at the end of the contract.
e) The PSC will accrue four (4) hours of annual leave for every biweekly pay period. After three (3) years of qualifying service as a PSC or direct hire by any federal government entity, annual leave will increase to six (6) hours every pay period. After fifteen (15) years of qualifying service as a PSC or direct hire by any federal government entity, annual leave will increase to eight (8) hours every pay period. Annual leave balances can be carried over into other MCC personal services contracts. Upon termination, a PSC will be paid for accrued annual leave not to exceed 240 hours, subject to availability of funds.
f) Subject PSC may be paid at its regular hourly rate for ten (10) federal holidays and other days that MCC is closed--such as for inclement weather and local in-country holidays, with supervisory/COR approval.
g) Subject PSC is eligible for parking or metro subsidy on the same basis as MCC direct-hire employees, only if PSC is permanently located in the Washington, D.C. area, subject to availability of funds.
h) Subject PSC shall be eligible for credit hours on the same basis (up to 24 hours earned) as direct-hire employees under the MCC Credit Hour Program. Employees may not receive credit hours for time spent in travel status. The PSC shall be compensated for the credit hour balance upon termination, subject to availability of funds.
i) Subject PSC shall be eligible for Compensatory Time Off for Travel, on the same basis as direct-hire employees, in accordance with MCC policy A&F-2010-4.1. Compensatory time off for travel may be earned in fifteen (15) minute increments, for time spent in travel status away from the employee's official duty station, when such time is not otherwise compensable. Employees may not receive credit hours for time spent in travel status. Travel for the purpose of this provision means official travel to accomplish MCC business and must be approved by an authorized MCC official. Compensatory time off should be used before accrued annual leave except when this would cause a forfeiture of annual leave in excess of the annual leave ceiling or restored leave due to expire in the current leave year. Compensatory time off for travel shall be forfeited if not used by the end of the 26th pay period after the pay period during which it was earned and upon termination or expiration of contract.
j) . MCC pays the employer contribution to FICA and Medicare for this contract. MCC shall withhold employee contribution to FICA, Medicare, federal tax, and state tax.
k) All travel will be conducted in accordance with the Federal Travel Regulation (FTR), 41 C.F.R. 301, Department of State regulations, and MCC travel policy. The Government shall pay the Contractor for travel costs and other direct costs in conjunction with services required for the performance of subject contract. If travel is required on subject contract, Contractor will be notified by the COR and will request a travel authorization through the E-Travel website (https://ets.prod.carlson.com). The Government shall pay the Contractor reasonable per diem as specified in the Federal Travel Regulation, 41 C.F.R. 301, and any other transportation expenses if provided for in the Schedule. Upon completion of travel, Contractor shall submit a travel voucher for reimbursement of all travel and other directly related costs. Reimbursement of travel expenses will occur upon approval of the travel voucher by the COR and other MCC approval authority. Overseas travel costs include international air travel, per diem allowances (per State Department/GSA), local transportation, and other miscellaneous costs such as Passports, Medical Examination, etc. Domestic air travel is determined based on predetermined rates for specific travel. Per diem allowances are costs predetermined and set by General Services Administration and compliance is governed by the Federal Travel Regulation.
l) Under certain circumstances, PSCs may be eligible to receive benefits for injury, disability, or death under FECA. The Department of Labor determines eligibility, and payment is subject to availability of funds.
m) Salary changes and personnel-related contract actions, if any, will be processed via a contract modification to the personal services contract.
n) Regular full-time PSCs shall submit the Time Sheet (long term) on a biweekly basis. Timesheets must be approved by the Contracting Officer Representative (COR) and/or the Project Monitor (PM). The PSC shall submit an invoice to the COR for other direct costs which are approved in advance by the CO/COR. Invoices must be approved by the COR.
o) Confidential information, as used in this section means (a) proprietary or personal information or data about an individual, or (b) information or data submitted by or pertaining to an institution or organization.
Confidential information does not include information that (a) is, or becomes, public, (b) becomes known to the PSC on a non-confidential basis from a third-party source, or (c) is required to be disclosed by law or legal process. The PSC must coordinate any request for release of confidential information with the MCC's Freedom of Information Act/Privacy Act Officer.
If the PSC is uncertain as to whether a particular piece of information is confidential, the PSC shall consult with the Freedom of Information Act/Privacy Act Officer before releasing the information outside the MCC. The PSC will follow the rules and procedures of disclosure set forth in the Privacy Act of 1974 (5 U.S.C. 552a) and implementing regulations and policies, with respect to all information subject to the Privacy Act.

q) MCC provides medical evacuation insurance to all its travelers through Global Rescue. In the event a traveler needs evacuation (and Global Rescue concurs), the traveler will be evacuated. This coverage is not the same as a traveler's health insurance. Travelers still need adequate health insurance in addition to their Global Rescue coverage.
Travelers are responsible for obtaining a Global Rescue identification card from the TMC office and ensuring that the Global Rescue Contracting Officer Representative (COR) or Program Manager (PM) is notified to add their name to the policy to ensure coverage.
r) The Contractor certifies that, except for the compensation set out in this contract, she/he is not receiving any additional wages, compensation, or gifts from the MCC for any work contemplated or performed under or in connection with this contract.
s) The Contractor is not eligible to participate in the federal health or life insurance programs.
t) PSCs with a permanent duty station at MCC Headquarters or in one of the MCC overseas offices are authorized to receive a Blackberry, laptop or desktop computer, subject to COR and Chief Information Officer (CIO) approval. MCCNET IT login accounts are contingent upon the Chief Information Security Office (CISO) receiving notification of a successful background investigation by the MCC Office of Security. If a PSC, whether full time or intermittent, requires access to MCCNET, they must complete the MCC on-boarding process (including a successful background investigation). The MCC CISO must approve all account activations on the MCC Network.
u) The PSC is subject to all laws, rules and regulations governing the behavior of regular Federal employees, including, without limitation, the Anti-Deficiency Act and the laws and regulations governing the ethical conduct of employees of the Federal Government. All laws and amendments to laws enacted after the date of this contract, which are applicable to the Contractor, shall be incorporated herein by law without the need to amend the contract. Nothing in this clause shall give the Contractor rights which the Contractor is not otherwise entitled to under law. The Contractor is specifically forbidden to seek other compensated work in a country on a subject for which the Contractor provided services under this Contract for a period of two years following termination of this Contract.
The Millennium Challenge Corporation (MCC) utilizes the Contractor Performance Assessment Rating System (CPARS) to evaluate contractor performance (see FAR, Subparts 42.1502 and 42.1503). Contractors doing business with MCC are required to register in CPARS accessible via the Internet at: http://www.cpars.gov. An evaluation of contractor performance using the CPARS is mandatory for all contract actions exceeding the simplified threshold but may be conducted for contract actions lower than that amount should significant events occur such as a contract termination or extraordinary contract performance by the contractor. As part of this process, the contractor must determine who will serve as their CPARS "Contractor Representative" in the CPARS system. If, at any time, the contractor makes a determination that their CPARS Contractor Representative needs to change to a different individual, the contractor must contact MCC via email at the address CPARS@mcc.gov to notify MCC of the change so that appropriate action can be taken by MCC's CPARS Focal Points to ensure that the contractor receives timely notification of their evaluation. Failure to do so may result in the contractor not receiving their evaluation in a timely manner and may result in the contractor not receiving the opportunity to provide comments in response to MCC's evaluation. Other Direct Charges (ODCs) will be reimbursed for direct costs as provided in the contract and/or task order. To be reimbursed, invoices including ODCs, must provide a detailed breakdown of the actual expenditures invoiced. The contractor shall maintain the original or legible copy of receipts for all ODCs invoiced. MCC reserves the right to request evidence of any ODC reimbursed. To assure timely reimbursement of ODC's, the contractor is strongly encouraged to submit charges within 45 days of the expense.
Personal Service Contractors (PSCs) may be eligible for the following types of leave to address challenges associated with the COVID-19 pandemic. These options are subject to COR approval. Each situation shall be evaluated on a case-by-case basis, to determine if certain types of leave are applicable. All leave types listed below may not apply to every PSC's specific situation.
If the PSC's COR is in a non-supervisory position or does not generally have the authority to approve an excused absence for employees within their department, then the COR will need to obtain approval from their supervisor prior to approving the PSC's use of any excused absence leave or emergency sick leave associated with the COVID-19 pandemic.
