STATEMENT OF WORK
Technical and Advisory Support for Millennium Challenge Corporation's
Continuity of Operations Program Services
C.2.1. Through this acquisition, MCC seeks to acquire technical and advisory services to support all aspects of MCC's Continuity of Operations Program management, including its development, risk assessment, strategy, planning, implementation, operations, evaluation; and emergency management support that includes preparedness, response and recovery.
C.2.2. As an Executive Branch agency, MCC executes a comprehensive set of programs that are aimed to ensure domestic and international security and safety of the MCC workforce and assets, and the resumption of time-sensitive operations and services in case of a major disruption of MCC's normal operations, including localized acts of nature, accidents, and technological and/or attack-related emergencies. The COOP Program is implemented and executed in accordance with Federal laws, Executive Orders, Federal Continuity Directives and other Executive Branch direction. As specified in Annex A of Presidential Policy Directive 40 (PPD-40), the MCC is assigned to the Category IV group of agencies.
C.2.3. Consistent with MCC's Category IV designation in PPD-40, MCC's continuity operations are accomplished through remote disbursed telework when MCC's headquarters facility at 1099 14th Street, NW in Washington D.C. (Franklin Court Building) is not operational. (MCC is one of several tenants that occupy the Franklin Court Building.) When the Franklin Court Building has some operational capability during a continuity event, MCC's continuity operations may be performed at Franklin Court and by telework, as directed by Agency leadership. Given the Agency's telework continuity strategy, MCC's Chief Information Officer provides agency-wide guidance and oversight for the protection of essential records to support the performance of MCC's essential functions under any emergency or potential emergency, and, furthermore, facilitates records management improvements affecting essential records by making them accessible and searchable for users that are teleworking.
C.2.4. A key element of the Continuity of Operations Program is a family of documents known as the Continuity of Operations Plan (COOP) that is prepared in accordance with content and formatting requirements specified by the Federal Emergency Management Agency (FEMA), particularly those in Federal Continuity Directive 1. The principle, though not all inclusive, set of COOP documents include the following:
1) An overarching agency continuity plan that covers continuity plans for MCC's U.S. and overseas activities.
2) Six department-level continuity plans that include a U.S. continuity plan for each division with each department.
3) An overseas continuity plan for MCC's operations in foreign countries with an MCC presence that includes fourteen country continuity plans.
4) A reconstitution plan for MCC's domestic activities.
5) A pandemic influenza and contagious disease plan.
6) A multi-year strategy and program management plan.
7) A continuity risk management plan.
8) A test, training, and exercises (TT&E) program plan that also documents TT&E activities and evaluations.
9) Appendices contain reference documents.
C.2.5.1. The Domestic Security Program ensures the security and safety of the MCC workforce and assets within the United States through its physical, personnel security, insider threat, classified information, controlled unclassified information, suitability, fitness, Homeland Security President Directive 12 (HSPD 12) programs. The Domestic Security Program is responsible for program operations and the development and implementation of agency-wide policies and procedures.
C.2.5.2. The International Security Program ensures the security and safety of the MCC workforce on travel and on assignment overseas. The program analyzes and assesses overseas security and security risks; provides institutional measures to prepare MCC personnel to address travel and overseas security, safety and health concerns in partnership with the Department of State Bureau of Diplomatic Services and offices of the Chief of Missions; and supports personnel on travel and assignment overseas by providing direct support to MCC managers and employees, facilitating support of a medical service provider under MCC contract; and planning and operational coordination with Diplomatic Services and the Chief of Missions. The International Security Program is responsible for program operations and the development and implementation of agency-wide policies and procedures.
C.3 SCOPE
C.3.1. The contractor shall provide technical and advisory services in support of all aspects of MCC's Continuity of Operations Program management, in response to the requirements of PPD-40 as implemented in Federal Continuity Directive 1.
Components of such support include planning, development, implementation, readiness and preparedness, operations, evaluation, and crisis/emergency preparedness and response.
C.3.2. The contractor shall also provide technical and advisory service in support of MCC's emergency management, including emergency preparedness, response, and recovery.
C.3.3. Contractor employee(s) providing services under this contract must be able to obtain a Moderate Risk Public Trust clearance.
C.3.4. Local travel may be required and is not reimbursable. Local travel is estimated at 5 days per year or 2 % of total contract hours.
C.3.5. Unless otherwise stated, preparation of deliverables related to these tasks will be performed in collaboration with Domestic and International Security (DIS) and other MCC staff, including managers, technical staff, and executive assistants.
The deliverables related to these tasks will be due periodically and determined by the program office.
C.3.6. Technical and advisory services provided include document quality control and document quality production. It is the contractor's responsibility to ensure that all documents associated within the scope and tasks of this requirement are produced will be of the highest quality with less than 2% errors margin.
C.3.7. The COOP documents associated with this requirement are extensive and require updating and formatting. Unless otherwise stated, preparation of deliverables related to these tasks will be performed in collaboration with Domestic and International Security (DIS) and other MCC staff, including managers, technical staff, and executive assistants. The deliverables related to these tasks will be due periodically and determined by the program office.
C.4 TASKS
The contractor shall support the program office the Domestic and International Security (DIS) division of the Department of Administration and Finance in performance of the following tasks:
C.4.1 CONTINUITY OF OPERATIONS (COO) PROGRAM TASKS
C.4.1.1 Continuity Risk Assessment and Management Plan
The Contractor shall complete a comprehensive revision of MCC's continuity risk assessment and management plan. These deliverables shall meet the requirements guidelines in Federal Continuity Directive 1 given MCC's PPD-40 agency category designation and current continuity operations strategy. The update shall be performed in close collaboration with the staffs of MCC's Chief Risk Officer and the Chief Information Officer and utilize the risk assessments and plans that are currently being applied to MCC's operations.
The risk assessment will include a review of MCC's current COOP with respect to continuity objective and compliance with Government-wide requirements and guidelines.
The risk management plan will be updated every fiscal year for presentation with COOP documents as directed by the program office and updated in response to inspection and audit reports; completion of TT&E plans; and completion of test and exercise after action reports.
C.4.1.2 Formal Multi-Year Strategy and Program Management Plan (MYSPMP)
The Contractor shall update the MYSPMP to include but is not limited to:

3. Identify and address corrective actions related to past program activities;
4. Planning, training, and exercise milestones and activities; and
5. Provide for the development, maintenance, and operation of MCC's continuity capabilities.
The MYSPMP is to be updated once every fiscal year or as directed by the program office.
The Contractor shall develop criteria and metrics MCC will use to evaluate MCC's readiness posture and program performance, and support collection, processing and report of program performance data. Revisions of the MYSPMP shall include any changes and/or new criteria and metrics to address the evolving need for relevant and timely performance information. The criteria and metrics are to be reviewed and updated at least once every fiscal year or as directed by the program office.
C.4.1.3 Training, Testing & Exercise Program Strategy and Plan
C.4.1.3.1. The Contractor shall develop, document, and update the program's training, testing, and exercise (TT&E) program strategy and plan. In particular, the exercise program must be documented to be in compliance with the Homeland Security Exercise and Evaluation Program. The TT&E plan includes corrective actions from the outcomes of evaluations, exercises and actual continuity of operations events, and will be updated at least once every fiscal year for presentation with COOP documents and in response to the outcomes of evaluations, exercises and actual continuity of operations events, performance on program metrics, and as directed by the program office.
C.4.1.3.2. The agency TT&E strategy must be developed collaboratively with MCC managers and their staff, particularly the Chief Information Officer and staff, and the MCC records manager. Actions in the TT&E plan will be developed consistent with the program office-approved strategy. Since normal MCC operations require a significant and reliable telework capability, the TT&E strategy will include an assessment of the approaches, if any, MCC should take in complying or meeting the intent of Federal TT&E requirements, including those related to:
1. Testing and training related to MCC information systems and essential records;
2. Testing of the internal and external interoperability and viability of primary and contingency communications and information technology systems;
3. Testing of telework capabilities, to include information technology infrastructure required to support telework during a continuity activation;
4. Training on communications and IT systems planning necessary to support or sustain continuity operations; and
5. Exercises to demonstrate capability to continue essential functions from telework sites, to include accessing and using records, communications, and systems.
C.4.1.3.3. The Contractor shall develop, document and update an agency-wide continuity of operations training program, including identification of training needs, development of training materials as an essential means to enable MCC personnel to perform their roles and responsibilities in a continuity environment. The training program will be updated in concert with update of the TT&E plan as directed by the program office. The training program must include:
1. Annual training specifically for (a) MCC's leadership and (b) personnel designated within the orders of succession to assume the authority and responsibility of key leadership positions if leadership is not able to function, on its essential functions, succession, continuity communications, and deployment requirements;
2. Annual training on role and responsibilities for all continuity personnel, including host or contractor personnel, who are assigned to activate, support, and sustain continuity operation. The training program must be consistent with the TT&E strategy and must addresses training needs related to MCC's plan to telework when the MCC headquarters building cannot be occupied for MCC continuity operations; reconstitution plans and procedures, communications and information technology system planning necessary to support or sustain continuity operations; and how to identify, protect, and make available electronic and hardcopy essential records and documents, references, records, information systems, and data management software and equipment needed to support or sustain continuity operations.
3. Annual continuity awareness briefings for the entire MCC workforce to include new on-boarded personnel.
C.4.1.3.4. The Contractor shall develop, document and update an agency-wide continuity of operation test program, including identification of testing needs, to demonstrate the correct operation of all equipment, procedures, processes and systems that support MCC's continuity infrastructure, identify gaps in coverage, and validates existing plans and programs. The testing program must be consistent with the TT&E Strategy and include and document annual testing of alert and notification procedures for continuity personnel, and quarterly testing of such procedures for personnel at MCC headquarters.
C.4.1.3.5. The Contractor shall provide technical and advisory assistance to MCC for the conduct of exercises, particularly the annual National Level Exercise (known as Eagle Horizon that has activities that often takes place during the months of May through August) and MCC internal exercises. Assistance is to include support for the planning, preparation and execution of exercises in coordination with MCC staff; development and drafting of plans, objectives and exercise materials; hands-on support to prepare exercise activities; facilitation and documentation of the post-exercise "hot wash" and participant surveys;
development and drafting of after actions reports, lessons learned, and corrective actions plans.
C.4.1.3.6. The Contractor shall serve as exercise observer/evaluator and facilitator and comprehensively document observations and evaluations as directed by the program office.
C.4.1.3.7. The Contractor shall perform MCC staff continuity of operations program awareness training and emergency preparedness training once a fiscal year or as directed by the program office. The training may be recorded for internal MCC uses such as presentation to personnel who were absent from the training sessions and newly on-boarded personnel.
C.4.1.4 COOP Documents
C.4.1.4.1. The Contractor shall coordinate the agency-wide update, revision and review of MCC's COOP documents. This task includes but is not limited to MCC's agency, department, division and country continuity plans. The standard for review will include the Federal continuity directives applied to MCC. The principle, though not all inclusive, set of COOP documents include the following:
1) An overarching agency continuity plan that covers continuity plans for MCC's U.S. and overseas activities.
2) Six department-level continuity plans that include a U.S. continuity plan for each division with each department.
3) An overseas continuity plan for MCC's operations in foreign countries with an MCC presence that includes fourteen country continuity plans.
4) A reconstitution plan for MCC's domestic activities.
5) A pandemic influenza and contagious disease plan.
6) A multi-year strategy and program management plan (MYSPMP).
7) A continuity risk management program plan.

The Contractor's review standard will include the requirements of Federal continuity directives and national continuity program guidance. The program office will determine how shortfalls in meeting national program requirement will be addressed with advice from the contractor on risk-based consequences of shortfalls.
C.4.1.4.2. The Contractor must coordinate the review and approval of COOP documents with MCC leadership and will be responsible for processing the COOP document approved final drafts for agency-wide publication and dissemination in hard copy and electronic formats. With respect to electronic formats, two shall be produced -- one version will be a replica of the hard copy version while a second version will be the same was the first except sensitive personally identifiable information is redacted.
C.4.1.4.3. The Contractor shall review previously completed plans and assess them for consistency with COOP content and formatting requirements, internal consistency, and data and information accuracy. The review and assessment of previously completed plans will be performed once each fiscal year or as directed by the program office.
C.4.1.5 MCC Mission Essential Functions (MEFs)
The Contractor shall maintain and update, if necessary, appropriate documentation of MCC's MEFs in accordance with Federal continuity directives and other Government-wide guidance. The update and documentation are performed in concern with the tasks described in Section C.4.1.4.
C.4.1.6 Monthly Assessments
The Contractor shall prepare and submit monthly assessment of MCC continuity status, after program office review and approval, to FEMA utilizing the Continuity Status Reports (CSR) reporting process.
C.4.1.7 MCC Emergency Alert Notification System (EANS)
MCC's uses Informacast mass notification system as the primary system supporting the MCC EANS. The EANS provides the communications capability to inform, mobilize and account fir MCC staff during emergency and other extraordinary situations.
The last resort backup system for EANS relies on "call tress" (also known as phone trees, call lists, call chains or phone/text chains) for use by essential personnel.
C.4.1.7.1. The Contractor shall provide technical and advisory assistance support services for compiling and updating Informacast data, as directed by the program office, the agency-wide Informacast data performed quarterly as directed by the program office.
C.4.1.7.2. The Contractor shall develop and implement using Microsoft Excel a searchable directory (searchable by and MCC department and division) of all MCC essential personnel for use by the program office and MCC department, division, and overseas managers. The maintenance of the MCC essential personnel directory shall be performed in concert with the updating of department, division and overseas continuity plans through systematic contact with MCC managers as directed by the program office.
C.4.1.7.3. The Contractor shall draft information system functional requirements for automating telephone/e-mail call trees as an electronically accessible directory and serve as the program office's point of contact to support development and implementation of the automated call tree directory.
C.4.1.8 Incident Command Team (ICT) Operations Handbook
The program office serves as the Incident Command Team (ICT) is responsible to the MCC's executive leadership (specifically, Executive Management Team EMT) for facilitating incident responses and COOP activation activities, including communicating warnings, informing the EMT of substantial changes in threat or hazard situations, providing the EMT notifications from the President and Federal Emergency Management Agency (FEMA), receiving and disseminating EMT direction to MCC staff, and operating systems that account for MCC staff. In all circumstances the program office provides the Agency's tactical crisis leadership and is accountable to program office's department head. The program office's responsibilities include:
o Advises the EMT of any/all changes during an incident which affects MCC, including those related to security, health, and the ability to reconstitute MCC operations.
o Conducts assessments of MCC facility safety; physical, communications and classified information security;
and ability to sustain continuity operations after COOP activation. Provides response options to MCC Corporate Officers/EMT regarding assessment findings.
o Rapidly identify key emergency issues.
o Provide medical emergency or rescue response to victims o Communicates with Occupant Emergency Response Team members (who help evacuate MCC Franklin Court space) o Independently determines needs and requirements for life safety measures and implements them when needed.
o Ensures that immediate lifesaving measures are implemented when needed.
The Readiness and Preparedness section shall be delivered by subsection and updated as determined by the program office.
C.4.1.9 Emergency Management Services
C.4.1.9.1 The Contractor shall, as determined by the program office, draft standard operating procedures and user reference materials on MCC crisis/emergency preparedness, response, and recovery, including incidents affecting MCC staff on overseas travel or assignment; and workplace violence and criminal activity at MCC headquarters.
C.4.2 GENERAL PROCEDURES FOR ALL TASKS
C.4.2.1. The Contractor will provide technical and advisory support on DIS' behalf. The contractor shall present the plans for internal MCC signature and publication.
C.4.2.2. The Contractor shall present documents for internal MCC signature and publication. Preparation of deliverables related to these tasks will be performed in coordination and collaboration with DIS and other MCC staff. The detailed specification of the deliverables related to these tasks will be determined by the program office.
C.5 QUALIFICATIONS OF CONTRACTOR
Due to the nature of this requirement, the contractor must possess superior skills in proof reading, production of documents, and document formatting and Microsoft Office applications.
C.6 DELIVERABLES
The Contractor shall submit all deliverables in electronic form where feasible, and in hardcopy. A deliverable matrix for deliverable types is located in Section F. Deliverables are to be in accordance with Section F.4.1 and, provided on mutually agreed upon dates between the contractor and program office. Deliverables will be considered "draft" upon initial receipt.
MCC will review the Contractor's draft documents and accept or provide comments provided within ten (10) business days of receipt. The Contractor shall appropriately address the MCC's concerns and provide final deliverables within ten (10) business days of receiving the MCC response.
C.7 PERFORMANCE LOCATION
The Contractor shall perform services at MCC headquarters Monday - Friday in the Franklin Court Building, 1099 Fourteenth Street, NW, Washington, DC 20005. While most work will be performed at MCC headquarters, the Contractor may perform services from a remote (telework) location during agency emergency or continuity events and or other contingencies as determined by the COR.
C.8 SUPERVISION OF EMPLOYEES
The contractor's employee(s) shall remain under the contractor's direct supervision at all times. The contractor manages its employees(s) leave / paid time off and coordinates with the government COR to ensure there is no gap in service. The Government will provide instructions/guidelines within the scope of the contract through the COR. The contractor fully understands and agree that the contractor is not, nor shall represent himself to be an agent or partner of, or joint venture with, the Government; and that he shall neither supervise nor accept supervision from Government employees.
C.9 BUSINESS HOURS and COVERAGE
Work under this contract shall be performed between the core hours of 7:00AM 6:30PM. If the contractor determines there exists a need to perform work outside of these hours, prior approval must be sought and granted by the COR. Further, the contractor may be required to provide support outside of normal business hours on an as-needed basis at the COR's request.
The contractor will backfill the position within 48hrs of any scheduled or unscheduled absences by its employee(s). The Contractor will be required to provide a qualified replacement employee in the event of a Contractor employee being absent for greater than 48 hours.
C.10 INFORMATION SECURITY
Government furnished information may take the form of policies, standards, guidelines or technical documentation. The contractor shall protect from loss or unauthorized disclosure any materials or information made available to it during the performance of the Contract. When not in use, written materials that the COR identifies as sensitive or confidential shall be secured in locked receptacles provided by the MCC. The contractor shall provide security levels and controls that are required by regulation and consistent with best government and professional practices. They shall provide a certified security environment where Government data resides is protected while at rest, in motion and in use.
Contractor staff may be required to attend Government furnished information security awareness briefings or training at the discretion of the COR.
C.11 GOVERNMENT FURNISHED EQUIPMENT (GFE)
The Government will provide all hardware and software to the contractor to complete the tasks associated with Continuity of Operations and Emergency Management Services.
C.12 POST AWARD MEETING
The Government will have a post-award meeting within five (5) working days after Contract award. The post-award meeting will be held at MCC Headquarters in Washington, DC and will also serve as the kick-off meeting which will include a discussion of Contract requirements, the schedule for the completion of this requirement and any other pertinent information that the contractor will need to meet the performance requirements of this contract.
C.13 QUALITY CONTROL
The contractor shall develop and maintain an effective quality control program to ensure services are performed in accordance with the statement of work. The contractor shall develop and implement procedures to identify, prevent, and ensure non-recurrence of defective services. The contractor's quality control program is the means by which the contractor assures himself that his work complies with the requirements of the Contract. The contractor shall provide a draft Quality Control Plan (QCP) with their quote. A final QCP is due 30 calendar days after Contract award. After acceptance of the QCP, the contractor shall obtain the CO's acceptance in writing of any proposed change to his QC system.

Section E - Deliverables Deliverables will vary. In certain instances, the Contractor may be asked only to provide advice (which would be confirmed by email) while, in other cases, the Contractor will be requested to provide a more written ad hoc report, presentations or edits to documents. MCC and the Contractor will agree on the form of the deliverable at the time of each technical direction for service and prior to the actual services being rendered.
The Contractor's responsibilities will frequently require not just reviewing documents or reports but include staff participation on phone calls, and in meetings. All participation in phone calls and in meetings will be documented by email that summarizes the background, objectives and outcomes or recommendations of the meeting or phone call.
Deliverables will be considered "draft" upon initial receipt and will be reviewed by MCC; comments should be addressed with one week of receipt of MCC comments.
Unless specifically instructed by MCC otherwise, all such reports are to be submitted in English, in an electronic copy using WINDOWS based MS-Office 2007 or later products including WORD for text, data tables in EXCEL, appropriate MS-Office 2007 or later programs for exhibits, and schedules using MS-Project. Digital photo files should be submitted in JPG format.
GIS data should be submitted both in ArcView files, and PDF printable files. Presentations should be prepared with PowerPoint. All work files shall be submitted to MCC along with PDF files.
The contractor shall submit monthly Activity and Expenditure Reports to the Contracting Officer's Representative (COR) and the Contracting Officer (CO) in an electronic format. These reports must include a monthly expenditure report, as well as a running total of all budget expenditures to date.

52.242-70 MCC 52.242-70 CONTRACTOR PERFORMANCE ASSESSMENT RATING SYSTEM
(CPARS) REGISTRATION (NOV 2019)
The Millennium Challenge Corporation (MCC) utilizes the Contractor Performance Assessment Rating System (CPARS) to evaluate contractor performance (see FAR, Subparts 42.1502 and 42.1503). Contractors doing business with MCC are required to register in CPARS accessible via the Internet at: http://www.cpars.gov. An evaluation of contractor performance using the CPARS is mandatory for all contract actions exceeding the simplified threshold, but may be conducted for contract actions lower than that amount should significant events occur such as a contract termination or extraordinary contract performance by the contractor. Inquiries regarding the registration process should be addressed to the CPARS help desk.

As part of this process, the contractor must determine who will serve as their CPARS "Contractor Representative" in the CPARS system. If, at any time, the contractor makes a determination that their CPARS Contractor Representative needs to change to a different individual, the contractor must contact MCC via email at the address CPARS@mcc.gov to notify MCC of the change so that appropriate action can be taken by MCC's CPARS Focal Points to ensure that the contractor receives timely notification of their evaluation. Failure to do so may result in the contractor not receiving their evaluation in a timely manner and may result in the contractor not receiving the opportunity to provide comments in response to MCC's evaluation. (a) The Contracting Officer may designate a Government representative to act as the Contracting Officer's Representative
(COR) or Project Monitor (PM) to perform functions under the contract such as review and/or inspection and acceptance of supplies, services, including construction, and other functions of a technical nature. The Contracting Officer will provide a written notice of such designation to the COR and/or PM and the Contractor. The designation letters will set forth the authorities and limitations of the COR and/or PM under the contract.
(b) Modifications to this contract are effective only if reduced to writing and executed by the Contracting Officer. The Contractor is specifically prohibited from performing any work that is outside the scope of this contract without the approval of the Contracting Officer. The Contracting Officer cannot authorize the COR or any other representative to sign documents (i.e., contracts, contract modifications, etc.) that require the signature of the Contracting Officer.

MCC 52.204-70 SECURITY REQUIREMENTS FOR CONTRACTOR PERSONNEL - FEBRUARY 2019
A. Compliance with MCC Safety and Security Regulations at MCC Headquarters
1. Personal services contractors (PSCs) and contract employees including those working for subcontractors shall be subject to and abide by all MCC safety and security policy and procedures while on MCC premises, and satisfy applicable requirements for fitness to perform work for or on behalf of MCC, personnel security, and obtaining an MCC Photo Identification (ID) Badge.
2. MCC may impose applicable criminal, civil and/or administrative sanctions, including removal, suspension, termination or suspension of access to information, information systems, or MCC facilities, against any PSC or contractor employee who fails to adequately protect classified national security information or sensitive information, including such information designated as Controlled Unclassified Information, from unauthorized disclosure. The sanctions imposed are under the authority of the applicable laws, regulations, Government-wide and MCC policies.
B. PSC and Contract Employee Fitness and MCC Photo ID Badge Requirements
1. The following are requirements for a PSC or contractor employee who works under this contract and requires access to any of the following: MCC Headquarters, MCCNet, Sensitive But Unclassified (SBU), Foreign Government Information (FGI) or any other designated sensitive information (such as classified national security information and Controlled Unclassified Information under 32 CFR Part 2002).
a. Such an individual must be:

b. In addition, if the individual is not a U.S. citizen for or in a position designated as moderate or high risk (i.e., a public trust position), the individual must have been residing, working and/or attending an educational institution in the U.S. for at least three, years.
c. MCC may allow such an individual to perform services under this contract based on: (1) a favorable suitability/fitness screening as an interim fitness determination, and (2) a favorable interim credentialing determination for issuance of an MCC Photo ID Badge, as applicable. An interim fitness determination does not satisfy requirement a. iii.) of this paragraph, and an interim credentialing determination does not satisfy requirement a. iv.) of this paragraph.
d. An investigation for an individual's fitness will be required to satisfy requirement a. iii.) except whenever the individual already has an investigation on file that meets the requirements for an investigation based on all applicable position designation(s) for the individual that satisfies/satisfy guidelines issued by the Suitability and Credentialing Executive Agent (SuitCredEA), the Security Executive Agent (SecEA) and the individual has been working for or on behalf of a Federal agency continuously for at least one year in one or more Federal positions or as a contractor employee that was/were subject to suitability or fitness investigation satisfying guidelines issued by the Suitability and Credential Executive Agent. However, no exception to the investigation requirement will be granted whenever MCC obtains new information in connection with the individuals that calls into question the individual's fitness under the criteria for suitability in 5 CFR 731.202. The investigation required will be based on position designation performed by MCC in accordance with 5 CFR 731 and 5 CFR 1400.
2. PSCs and contractor employees for or in public trust positions are subject to reinvestigation for fitness within the timeframe specified by the SuitCredEA.
3. A PSC or contractor employee whose position risk designation increases due to reassignment or change in job duties or responsibilities, is subject to the fitness investigation requirements for the higher risk position at the time the position designation is changed. If the position with the higher risk designation is the same one occupied by the individual, the individual may remain in the position while the investigation is being conducted; otherwise, the individual may not perform services under this contract in the new capacity until the requirements of B.1. of this clause are satisfied. Any upgrade in the investigation required for the new risk level will be initiated by MCC within 14 calendar days of the reassignment or change in job duties or responsibilities.
4. Fitness determinations will be made by MCC using the criteria and guidelines for making suitability determinations in 5 CFR 731.202 and related guidelines of the SuitCredEA. When no new investigation is required, MCC may determine an individual unfit when the investigative record on file for the individual shows conduct that is incompatible with the core duties of the relevant position by applying the criteria and guidelines referenced in this paragraph.
5. If a PSC or contractor employee develops one or more issues with respect to the criteria in 5 CFR 731.202 prior to any required investigation or reinvestigation, MCC may conduct an investigation at any time sufficient to resolve the issues and determine the…
