CRYPTO SUBSCRIPTION-BASED WEB PLATFORM FOR THE

CONSUMER FINANCIAL PROTECTION BUREAU, OFFICE OF

RESEARCH, MARKETS, AND REGULATIONS, WASHINGTON, DC

COMBINED SYNOPSIS/SOLICITATION

This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; proposals are being requested and a written solicitation will not be issued.

This solicitation is being issued as a Request for Proposal (RFP) under 9531CB22R0009. The solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular FAC 2022-05.

The NAICS Code for this procurement is 519190 – All Other Information Services.

1.0 PRICING TABLE – Total Evaluated Price

The Consumer Financial Protection Bureau (CFPB or Bureau) is seeking the right to use a crypto subscription-based web platform for a 12-month base period and for up to four 12-month government option periods, and the right to use and maintain an archive of the acquired data to support “Work Product” and “Existing Work Product” (as defined in 2.6) for a period of five years after the base period or the last exercised option year (if exercised), whichever is later.

Please see 2.6, below, for the full extent of Government Use Rights required under this solicitation.

Proposals shall include a price for the base year and each option period: Please complete the below Pricing Table by providing a Firm Fixed Price for the Base Period, Option Period 1, Option Period 2, Option Period 3 and Option Period 4; these figures will be totaled to arrive at each vendor’s/offeror’s Total Evaluated Price.

2.0 DESCRIPTION OF REQUIREMENTS

2.1 Background

The Consumer Financial Protection Bureau (CFPB or Bureau) actively conducts research in support of the Bureau’s mission to protect consumers. To better assist in those efforts, the Research, Markets, and Regulations (RMR) Division seeks to acquire the right to use a crypto subscription-based web for a period to include the base period and up to four additional government option periods, and the right to use and maintain an archive of data acquired by the Bureau during all base and executed option periods (if exercised) that can provide a more comprehensive picture of the cryptocurrency market than what is currently available from public sources. See 2.6, below, for the full extent of the Government’s Use Rights that the Government requires under this solicitation.

2.2 Scope

The Bureau would like to obtain access to a subscription-based web platform which will enable Bureau employees to forensically monitor crypto-asset flows through multiple blockchains, as well as identify crypto-asset wallets that may belong to sanctioned entities or known scammers. This platform should also provide big-picture market analysis.

ALL REQUIREMENTS HEREIN ARE MINIMUM UNLESS NOTED OTHERWISE.

2.3 Minimum Requirements

The contractor shall provide CFPB access to a web interface with the following features:

• Subscription with minimum of two CFPB logins

• Crypto-asset wallet and blockchain information dating back to 2013 for both Ethereum and Bitcoin, including labels compiled both through manual, in-house intelligence.

• Labels should include labeling of Mt Gox and DarkSide wallets and transactions.

• An in-house intelligence team that is actively labeling new crypto-asset wallets.

• Labeling of exchanges and crypto-asset miners (including sanctioned miners) by the country they are located in.

• The ability to screen transactions and wallets against the following sanctions lists:

o The U.S. Treasury’s Office of Foreign Assets Control (OFAC) Specially Designated Nationals and Blocked Persons (SDN) List o The United Nations Security Council Consolidated List o UK HM Treasury Consolidated List o EU Financial Sanctions Consolidated List o Japan Ministry of Finance Sanctions List o Australia Department of Foreign Affairs and Trade (DFAT) Consolidated List o Consolidated Canadian Autonomous Sanctions List

• Crypto-asset addresses listed under the Israeli Anti-Terrorism Law

• At least 80 different parameters/categories that transactions can be filtered by, including:

o Bridges o Layer 2 o Charity o ATM o Malware o Extremism o Political Campaign o Ransomware

• The ability to filter blockchain transactions through customized rules or filters. The filtering must support the ability to:

o Filter by country;

o Filter by one or more parameters;

o Filter by any labeled cluster of crypto-addresses o Labeling of wallets and transactions that move through mixers and tumblers

(which attempt to obscure crypto-asset flows), such as Samourai Wallet and Wasabi Wallet.

o Data coverage for at least 550 crypto-assets.

o At least 1 billion labelled crypto-asset addresses.

o At least 100 billion combined labels for wallet addresses and transactions.

• Access to a forensics tool with support for multiple blockchains, including Avalanche, Binance Smart Chain, Elrond, MimbleWimble, Optimism (the Layer 2 solution), and Solana providing the ability to follow the trail of transactions from a single crypto-asset wallet along a given blockchain, with support for multiple blockchains).

• Visual, graph-driven displays of transaction tracing that are intuitive to use and do not require supplementary training (at additional cost) to leverage the platform.

• The transaction display should include visuals that show what percentage of each wallet is exposed to the particular parameters described above – through either a widget or by hovering over the wallet address.

• The ability to export the data to CSV

• Access to data from the full suite of categories and crypto-asset tokens that the vendor supports.

• Vendor must also attach a screenshot of its active SAM.gov registration.

2.4 Deliverables

The following deliverables are required and shall be submitted to the Contracting Officer’s Representative (COR). The Contractor shall ensure all deliverables are clear, concise, technically accurate, well-organized, properly referenced, and complete by the appropriate due dates.

2.5 Analytical, Technical, and Administrative Support Requirements

Support for users of the dataset shall be provided throughout the course of the contract.

The contractor shall provide a single point of contact for technical and administrative questions (e.g. relating to the transfer of data). The contractor shall provide a single point of contact for analytical questions (e.g. relating to the representativeness of a segment of loans). This point of contact may be the same as the technical point of contact provided that that person is qualified to handle both types of issues. The contractor shall provide, at a minimum, a response time of two business days or less.

2.6 The following Government Use Rights must be provided by the vendor at a minimum:

2.6.1 Full right to publish Work Product (i.e. research; reports; and internal bureau products such as memos, internal drafts, and other work to support Bureau functions) based on these data

2.6.2 No advance notice, advance review of, or permission for publication is required

2.6.3 Right to reference use of the dataset in publications and other public communications using the data is provided during the time period of the contract and for a period of five years after the base period or last exercised option year, whichever is later;

2.6.4 Right to archive and continue using the data for any Work Product that existed at the time of the expiration of the contract. (“Existing Work Product”), for a period of five years after the base period or last exercised option year, whichever is later. The Existing Work Product includes Work Product that, by the conclusion of the base year or last exercised option year:

i. Has appeared in public, including: submitted to a conference, submitted to a journal, appeared on the Bureau’s own website, published on the SSRN, including CFPB office of research working paper series OR

ii. Had been drafted for internal memo, data report to CFPB executives, other internal CFPB publication, or entered the Bureau’s internal review process for external and internal publication

2.6.5 Right to merge the data with all other datasets without affecting any CFPB usage or publication rights is provided

2.6.6 “Government,” for purposes of Government Use, includes the CFPB, CFPB employees, and CFPB contractors with a business need to access the data in order to perform necessary analysis.

2.7 QUALITY ASSURANCE SURVEILLANCE PLAN (QASP)

The Contracting Officer’s Representative (COR) will measure the Contractor’s performance in the categories listed below (evaluation based on meeting the requirements of this SOW):

Surveillance method: Random Evaluation.

This method employs a “spot check” style of evaluation and may be adjusted base on quality trends. The Government retains the right to inspect all requirements of the contract. Unacceptable performance will be recorded and the Contractor shall be required to correct the unacceptable condition within a 24-hour time period. If the Contractor does not correct the unacceptable condition within 24-hours, the COR will notify the Contracting Officer who will take appropriate administrative action for unacceptable performance. When an observation indicates defective performance, the COR will require the Contractor to initial the observation. The initialing of the observation does not constitute concurrence with the observation, it only indicates acknowledgement that the Contractor has been made aware of a potentially defective performance.

4.0 PLACE OF PERFORMANCE/TYPE OF CONTRACT

The work shall be performed at the Contractor’s facilities. This will be a Firm Fixed Price Contract.

5.0 FAR 52.212- 1 INSTRUCTIONS TO OFFERORS - COMMERCIAL ITEMS (JAN

2017)

(a) North American Industry Classification System (NAICS) code and small business size standard. The NAICS code and small business size standard for this acquisition is 519190 – All Other Information Services.

(b) Submission of offers. Offerors must submit their proposal via email to patrick.sisk@cfpb.gov no later than 12:00 p.m. EST on August 11, 2022, with any vendor questions due August 4, 2022 at 12:00 p.m. EST. Offers may be submitted on letterhead stationery, or as otherwise specified in the solicitation. As a minimum, proposals must show --

(1) The solicitation number;

(2) The time specified in the solicitation for receipt of offers;

(3) The name, address, and telephone number of the offeror;

(4) A description of the offeror’s ability to meet the minimum Government requirements to include:

• All minimum requirements in Section 2.3.

• Screenshot of vendor’s active SAM.gov registration.

• Acknowledgement that it meets all other minimum requirements of the solicitation.

(5) Price in accordance with Paragraph 1.0;

(6) A completed copy of the representations and certifications at FAR 52.212-3 (see FAR 52.212-3(b) for those representations and certifications that the offeror shall complete electronically);

(7) Acknowledgment of Solicitation Amendments;

(8) Include a statement specifying the extent of agreement with all terms, conditions, and provisions included in the solicitation. Offers that fail to furnish required representations or information, or reject the terms and conditions of the solicitation may be excluded from consideration.

(c) Period for acceptance of offers. The offeror agrees to hold the prices in its offer firm for 30 calendar days from the date specified for receipt of offers, unless another time period is specified in an addendum to the solicitation.

(d) Late submissions, modifications, revisions, and withdrawals of offers.

(1) Offerors are responsible for submitting offers, and any modifications, revisions, or withdrawals, so as to reach the Government office designated in the solicitation by the time specified in the solicitation.

(2)

(i) Any offer, modification, revision, or withdrawal of an offer received at the Government office designated in the solicitation after the exact time specified for receipt of offers is “late” and will not be considered unless it is received before award is made, the Contracting Officer determines that accepting the late offer would not unduly delay the acquisition; and—

(A) If it was transmitted through an electronic commerce method authorized by the solicitation, it was received at the initial point of entry to the Government infrastructure not later than 5:00 p.m. one working day prior to the date specified for receipt of offers; or

(B) There is acceptable evidence to establish that it was received at the Government installation designated for receipt of offers and was under the Government’s control prior to the time set for receipt of offers; or

(C) If this solicitation is a request for proposals, it was the only proposal received.

(ii) However, a late modification of an otherwise successful offer, that makes its terms more favorable to the Government, will be considered at any time it is received and may be accepted.

(3) If an emergency or unanticipated event interrupts normal Government processes so that offers cannot be received at the Government office designated for receipt of offers by the exact time specified in the solicitation, and urgent Government requirements preclude amendment of the solicitation or other notice of an extension of the closing date, the time specified for receipt of offers will be deemed to be extended to the same time of day specified in the solicitation on the first work day on which normal Government processes resume.

(e) Contract award. The Government intends to evaluate offers and award a contract to the Low

Price Technically Acceptable (LPTA) offeror without discussions. Therefore, the offeror’s initial offer should contain the offeror’s best terms from a price and technical standpoint.

However, the Government reserves the right to conduct discussions if later determined by the Contracting Officer to be necessary. The Government may reject any or all offers if such action is in the public interest; accept other than the lowest offer; and waive informalities and minor irregularities in offers received.

(f) Unique entity identifier. The Offeror shall enter, in the block with its name and address on the cover page of its offer, the annotation “Unique Entity Identifier” followed by the unique entity identifier that identifies the Offeror's name and address. The Offeror also shall enter its Electronic Funds Transfer (EFT) indicator, if applicable. The EFT indicator is a four-character suffix to the unique entity identifier. The suffix is assigned at the discretion of the Offeror to establish additional SAM records for identifying alternative EFT accounts (see subpart 32.11) for the same entity. If the Offeror does not have a unique entity identifier, it should contact the entity designated at www.sam.gov for unique entity identifier establishment directly to obtain one. The Offeror should indicate that it is an offeror for a Government contract when contacting the entity designated at www.sam.gov for establishing the unique entity identifier.

(g) System for Award Management. Unless exempted by an addendum to this solicitation, by submission of an offer, the offeror acknowledges the requirement that a prospective awardee shall be registered in the SAM database prior to award, during performance and through final payment of any contract resulting from this solicitation. If the Offeror does not become registered in the SAM database in the time prescribed by the Contracting Officer, the Contracting Officer will proceed to award to the next otherwise successful registered Offeror.

Offerors may obtain information on registration and annual confirmation requirements via the SAM database accessed through https://www.acquisition.gov.

(h) Debriefing. If a post-award debriefing is given to requesting offerors, the Government shall disclose the following information, if applicable:

(1) The overall evaluated price of the successful and debriefed offeror.

(2) A summary of rationale for award;

(3) Reasonable responses to relevant questions posed by the debriefed offeror as to whether source selection procedures set forth in the solicitation, applicable regulations, and other applicable authorities were followed by the agency.

6.0 FAR 52.212-2 EVALUATION -- COMMERCIAL ITEMS (NOV 2021)

(a) LPTA Procedures: The Government intends to award a Firm Fixed Price contract to the responsible vendor whose proposal, while conforming to the solicitation, is most advantageous to the Government using Lowest Price Technically Acceptable (LPTA) competitive procedures. The determination of “most advantageous” will be based on the technically acceptable proposal that offers the lowest price among those proposals submitted and offers a fair and reasonable price. “Technical Acceptability” will be determined solely based on the vendor’s ability to satisfy all the Government requirements. Proposals that do not meet all the requirements specified will not be considered for award.

The following technical factors shall be used to evaluate offers:

1. Ability of the vendor to meet the Government’s minimum requirements – The Government will evaluate the information provided under Paragraph 5.0 (b)(4) of this solicitation to determine if it meets the Government requirements.

• Ability to meet all minimum requirements in 2.3 above.

• Government Use Rights – Meets the minimum requirements identified in

Section 2.6 of the solicitation.

• Acknowledgement that it meets all other minimum requirements of the solicitation – Meets the minimum requirements identified in the solicitation.

2. Price - To be considered for award, the Offeror must provide completed Rate Tables in accordance with Paragraph 1.0 of this solicitation. The Lowest priced offeror will be determined based upon the Total Evaluated Price as provided in the completed Rate Table at 1.0. The Total Evaluated Price, consisting of the total proposed in the base and each option year, will be evaluated for realism and reasonableness.

(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).

(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer’s specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.

7.0 TECHNICAL EVALUATION RATING SCALE.

The Government will assess each of the proposals against the solicitation using the following ratings:

Acceptable The proposal meets all requirements of the solicitation.

Unacceptable The proposal fails to meet one or more of the minimum requirements identified in the solicitation. Proposals with an unacceptable rating will not be considered for award.

Proposals must meet all solicitation requirements in order to earn an “acceptable” rating. Only those proposals determined acceptable will be considered for award.

(d) Comptroller General Examination of Record. The Contractor shall comply with the provisions of this paragraph (d) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, as defined in FAR 2.101, on the date of award of this contract, and does not contain the clause at 52.215-2, Audit and Records-Negotiation.

(1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor’s directly pertinent records involving transactions related to this contract.

(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.

(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law.

(e)

(1) Notwithstanding the requirements of the clauses in paragraphs (a), (b), (c), and (d) of this clause, the Contractor is not required to flow down any FAR clause, other than those in this paragraph (e)(1) in a subcontract for commercial products or commercial services.
