Enclosed is a Request for Proposals (RFP) for the Landscaping Services in Kuwait. If you would like to submit a proposal, follow the instructions in Section L of the solicitation, complete the required portions of the attached document, and submit it to the attention of Samuel Byun via email at sbyun@usagm.gov and ensure to copy me at tharvin@usagm.gov.

The U.S. Government intends to award a firm-fixed-price (FFP) Commercial Contract to the responsible Offeror submitting a proposal which has been determined to be the best value, following Tradeoffs, to the Government. The USAGM intends to award a contract based on initial quotations, without holding discussions, although USAGM reserves the right to conduct discussions with the Offeror.

Proposals are due by 09/09/2021, 10:00 AM ET via email to my attention and Samuel Byun at sbyun@usagm.gov. 1.1. STANDARD SERVICES

The Contractor shall maintain the appearance of grass, shrubbery, garden areas, trees, and related landscape elements for the U.S.

Government at the United States Agency for Global Media, Kuwait Transmitting Station, Kuwait. The Government will measure the

Contractor's work by the appearance of the landscape covered under the contract. The Contractor shall perform complete gardening and landscaping maintenance services as described in the contract for all areas identified in Attachment 2 drawings. The Contractor is also responsible for the garbage/trash collection, the hauling and disposal of the landscaping waste to any authorized trash collection points designated by the local authority. The Contractor shall ensure that trucks are empty upon arrival at the first collection point.

From the collection points, the garbage/trash shall be disposed to a location authorized by Kuwait Government. This includes transporting from the different collection points to the point/s of disposal. The Contractor shall include all planning, administration, and management necessary to assure that all services comply with this contract, and all applicable laws and regulations. The

Contractor shall meet all the standards of performance identified in the contract. The Contractor shall perform all related support functions such as supply, subcontracting, quality control, financial oversight, and maintenance of complete records and files.

The Contractor shall perform complete Inner facility landscape/grass cutting maintenance. The Contractor shall include all planning, administration, and management necessary to assure that all services comply with the contract, and all applicable laws and regulations.

The Contractor shall meet all the standards of performance identified in the contract. The Contractor shall perform all related support functions such as financial oversight, supply, quality control, subcontracting, and maintenance of complete records and files.

Section D - Packaging and Marking

D.1 PACKAGING AND MARKING

All deliverables shall be delivered to the Contracting Officer's Representative (COR) identified in Section G and shall be marked as follows:

1. Name and address of the Contractor;

2. Contract Number;

3. Description of item contained therein; and

4. Consignee's name and address.

D.2 PAYMENT OF POSTAGE AND FEES

All postage and fees related to submitting information including forms, reports, etc. to the Contracting Officer or COR shall be paid by the Contractor.

Section E - Inspection and Acceptance

52.246-4 Inspection of Services - Fixed-Price (Aug 1996)

(a) Definition. "Services," as used in this clause, includes services performed, workmanship, and material furnished or utilized in the performance of services.

(b) The Contractor shall provide and maintain an inspection system acceptable to the Government covering the services under this contract. Complete records of all inspection work performed by the Contractor shall be maintained and made available to the

Government during contract performance and for as long afterwards as the contract requires.

( c) The Government has the right to inspect and test all services called for by the contract, to the extent practicable at all times and places during the term of the contract. The Government shall perform inspections and tests in a manner that will not unduly delay the work.

An authorized representative of your company must sign the SF-1449 including all amendments to the solicitation (SF30 documents) and all supporting documents or the proposal may be considered nonresponsive.

An Offeror is required to be registered in SAM when submitting an offer or quotation, and shall continue to be registered until time of award, during performance, and through final payment of any contract, basic agreement, basic ordering agreement, or blanket purchasing agreement resulting from this solicitation.

ii. Volume 1 - Technical Offer

Technical offers shall not exceed fourteen (14) pages.

The Technical Offeror must address the requirements of Section C "Description/Specifications/Work Statement" of this solicitation.

The Offeror needs to show a proof of registration in SAM.Gov.

Pricing information must NOT be included in any part of Volume 1 "Technical Offer".

iii. Volume 2 -Price

Volume 2 "Price" has two (2) pages limit.

The Offeror shall submit its pricing in accordance with the table in Section Band Exhibit 1 of this solicitation.

Price offer must contain the Offeror's price to perform the work set forth in Section C "Description/ Specifications/Work Statement";

therefore, it must be current, accurate, complete and well documented. Any assumptions forming the basis of the submittal must be clearly identified in Volume 2 "Price".

Price Schedule must be submitted in U.S. dollars at the minimum, and additionally in Kuwaiti Dinars. Pricing information shall not be included anywhere other than in Volume 2 "Price". The proposed approach should be explained in Volume 2 "Price".

Section M - Evaluation Factors for Award

52.217-5 Evaluation of Options (July 1990)

Except when it is determined in accordance with FAR l 7.206(b) not to be in the Government's best interests, the Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. Evaluation of options will not obligate the Government to exercise the option(s).

SECTIONM EVALUATIONFACTORS FOR AWARD (FAR 12 / FAR 13 Procedures)

The major evaluation factors for this solicitation include technical, experience, past performance and cost/price factors. Although technical factors are of paramount consideration in the award of the contract, cost/price is also important to the overall contract award decision. All evaluation factors other than cost or price, when combined, are significantly more important than cost or price. In any case, the Government reserves the right to make award(s) to that offeror whose proposal provides the best overall value, following

Tradeoffs, to the Government.

Offerors are advised that award will be made to that offeror whose proposal provides the combination of features that offers the best or greatest overall value to the Government on a Tradeoffbasis. The Government is more concerned with obtaining performance capability superiority rather than the lowest overall cost.

The evaluation will be based on the demonstrated capabilities of the prospective Contractors in relation to the needs of the project as set forth in this RFP.

b) Factor 2: Technical Acceptability. Technical acceptability will include a review of the Project Manager; Relevant Experience

(and references); personnel (technicians/laborers), tools, supplies/materials and; licenses, permits and registration; and Management

Plan, etc. as defined in Sections L and M, along with any technical information provided by the Offeror with its proposal/quotation.

Evidence that the Offeror can provide the necessary personnel (technicians/laborers), tools, supplies, materials, and financial resources needed to perform the work;

The Offeror shall address its plan to obtain all licenses, permits and registrations required by local law.

If the offeror already possesses the locally required licenses and permits, a copy shall be provided.

The Offeror's Management Plan for landscaping services to include but not limited to:

(1) A Work Plan taking into account all work elements in Section C, Statement of Work.

(2) A Safety Plan taking into account all work elements in Section C, Statement of Work

(3) Identify types and quantities of supplies and materials required for performance of services under this contract. Identify if the offeror already possesse the listed items and their condition for suitability and if not already possessed or inadequate for use how and when the items will be obtained;

( 4) Plan of ensuring quality of services including but not limited to contract administration and oversight; and

( 5) If insurance, permits and registration is required by the solicitation, a copy of the Certificate of Insurance( s ), or a statement that the potential contractor will get the required insurance, and the name of the insurance provider to be used.

c) Factor 3: Relevant Experience ( Experience with any other entities other than the U.S. Government)

The Relevant Experience Factor evaluation will assess the relevance and breadth of the Offeror's experience and the quality of the

Offeror's performance with any other entity other than the U.S. Government. The Government is seeking to determine whether the

Offeror has experience that will enhance its technical capability to perform and whether the Offeror consistently delivers quality services in a timely and cost effective manner. In evaluating relevant experience, the USAGM will only take into consideration the performance assessments from the Offeror's private sector, educational, non-profit, commercial customers.

The Offeror shall provide the list of customers ( Other than U.S. Government) over the past three (3) years, demonstrating prior relevant experience with references (provide dates of contracts, places of performance, value of contracts, contact names, telephone and fax numbers and email addresses). If the Offeror has not performed comparable services in Kuwait, then the Offeror shall provide its international experience. Offerors are advised that the relevant experience information requested above may be discussed with the client's contact person. In addition, the client's contact person may be asked to comment on the offeror's:

+Quality of services provided under the contract;

+ Compliance with contract terms and conditions;

+ Effectiveness of management;

+ Willingness to cooperate with and assist the customer in routine matters, and when confronted by unexpected difficulties; and

+ Business integrity / business conduct.

The Government will evaluate Factor 1, 2, 3, except Factor 4, using the following adjectival rating.

- Exceptional: Greatly exceeds all minimum requirements of the criteria; has a high probability of success; contains no weaknesses or deficiencies.

- Good: Exceeds all the minimum requirements of the criteria; has an above average probability of success; contains no significant weaknesses and only minor, correctable weaknesses exist.

- Acceptable: Meets all the minimum requirements of the criteria; has an average probability of success; no significant weaknesses and any deficiencies can be readily corrected.

- Marginal: Fails to meet one or more of the minimum requirements of the criteria; low probability of success; major weaknesses and/or significant number of deficiencies exist.

- Unacceptable: Fails to meet any of the minimum requirements of the criteria; proposal needs major revisions; very low probability of success.

d) Factor 4:. Past Performance (Only pertaining to Experience with the U.S. Government)

Solicitation No. 951700-21-R-0033 USAGM Kuwait Annual Landscape Maintenance – Kuwait Transmitting Station

1. PERFORMANCE WORK STATEMENT

This is a firm-fixed price (hereafter FFP) contract for the annual landscaping maintenance services of the U.S. Government transmitting station, located at Mutlaa in Kuwait. The Contractor shall perform gardening services in all designated spaces inside the inner facility parameter, approx. 390,000 square feet. The lawn areas included under this contract, and depicted in Attachment 2, are approx. 22,000 square feet. The dimensions provided are approximate, and it shall be the contractor’s responsibility to verify all dimensions at the site survey.

1.1. STANDARD SERVICES

1.2. MANAGEMENT AND SUPERVISION

SUPERVISION. The Contractor shall designate a representative who shall be always responsible for on-site supervision of the Contractor’s workforce. The assigned supervisor shall be the focal point for the Contractor and shall be the point of contact with the U.S. Government personnel.

The supervisor shall have sufficient English language skill to be able to communicate with members of the U.S. Government staff. The supervisor shall have supervision as his or her sole function.

1.2.1. SCHEDULES. The Contractor shall maintain work schedules. Maintenance Services and garbage collection/hauling shall be performed between the hours of 7:30 AM and 3:00 PM Sunday through Thursday, except for approved holidays. For maintenance items other than routine daily services (i.e. – monthly, quarterly, annual services), the Contractor shall provide the COR with a detailed plan as to the personnel to be used and the time frame to perform the service. Other hours may be approved by the Contracting Officer's Representative. The Contractor must provide at least 24-hour advance notice to the COR who will consider any deviation from the hours identified above.

1.2.2. QUALITY CONTROL. The Contractor shall be responsible for quality control. The Contractor shall perform inspection visits to the work site on a regular basis. The Contractor shall coordinate these visits with the COR. These visits shall be surprise inspections to those working on the contract.

1.2.3. TECHNICAL GUIDANCE. The Contractor shall have the services of a trained horticulturist with experience in the climate and soil conditions found locally to give technical guidance to the Contractor's work force, and to develop and guide the Contractor's programs for lawn, flower and tree care.

1.2.4. GROUNDS MAINTENANCE PLAN. The Contractor shall submit an annual Grounds Maintenance Plan that reflects the proposed frequency for meeting the requirements of this contract. The Grounds Maintenance Plan will be developed to fit the requirements of local conditions, types of vegetation, and climate factors. The Contractor shall submit the Grounds Maintenance Plan to the COR for approval within 30 days after contract award, and annual updates thereafter 30 days prior to option year renewal.

The requirements for the Grounds Maintenance Plan addressed in this performance work statement shall be broken down into Monday through Friday, between the hours of 7:30 AM and 3:00 PM (as described in Section 2), weekly and monthly activities.

1.3. LAWN CARE

The Contractor shall maintain the height of grass between 4 and 6 centimeters, at the areas highlighted in Attachment 2. The Contractor is responsible for all equipment and fuel needed to complete this task.

1.3.1 The Contractor shall edge all sidewalks, driveways, and curbs each time the adjacent grass is cut.

1.3.2 The Contractor shall trim grass around trees, shrubs, cultivated areas, sprinkler heads, valves, fences, buildings, poles, and structures, so that grass height does not exceed the height of the adjacent grass.

1.3.3 The Contractor shall weed out the grounds and gardens on a continuous basis to prevent the growth of weeds into lawn and landscapes. The Contractor may use weed-killing chemicals to prevent the growth of weeds to eliminate grass and weeds in the cracks and joints within or along sidewalks and curbs. The Contractor shall obtain approval of the COR for all applications of weed killers.

1.3.4 The Contractor shall, whenever necessary, repair areas damaged by vehicular traffic, oil and gas, building repairs, and normal foot traffic. The damaged area shall be filled in and leveled and then seeded or sodded and maintained to conform to adjacent areas. The grass used for these repairs shall be Argentine grass, and/or the same as the existing grass at the facility.

1.3.5 The method, frequencies, and dates of grass cutting, hedging, trimming, weeding, and turf repair shall be part of the Contractor's Grounds Maintenance Plan.

1.4. PRUNING

1.4.1. The Contractor shall maintain trees, shrubs, hedges, bushes, vines, ground cover and flowers.

1.4.2. The Contractor shall prepare a written schedule, as part of the Grounds Maintenance

Plan, showing the method, frequencies, and dates of pruning. This typically requires Bi-annual tree pruning during the start of the rainy season and the start of the dry season.

1.4.3. The Contractor shall prune all shrubs, vines, bushes, ground cover, and trees to:

• Direct and encourage plant growth in directions desired,

• Remove dead and unsightly growth, and

• Maintain a neat and attractive appearance

The Contractor shall prune according to the schedule in the Grounds Maintenance Plan to ensure that all heavy pruning is accomplished during the proper season according to best horticultural practice. The Contractor shall prune all hedges and shaped shrubs to always maintain proper shape.

1.4.4. At no additional cost to the Government, the Contractor shall replace any tree, bush or shrub that is killed or rendered unusable for its intended purpose through negligent or irresponsible practices that are attributable to the Contractor. In addition, the Contractor shall obtain approval from the COR prior to the relocation of any tree, shrub, arbor, or plant life.

1.5. REMOVAL OF DEBRIS. The Contractor shall remove cuttings, grass, leaves, branches, bark, palm fronds, dead vegetation, paper, trash, and other foreign materials from the maintained areas, including walkways, road ways, open drainage systems, smoking stations, and curbs within or adjacent to the area. The Contractor shall remove all debris and equipment from the work site before the end of each workday. Debris removal shall prevent unsightly accumulation. The Contractor shall promptly remove collected debris to an authorized disposal site. The Contractor is responsible for all expenses incurred in the collection and disposal of debris. The Contractor shall clean gutters and down spouts of all collected debris annually.

1.6. WATERING

1.6.1. The Contractor shall water lawns, flowers, shrubs, and trees to provide for moisture penetration to a depth of 7 centimeters in the areas designated by the COR. If natural precipitation is sufficient to fulfill this requirement, the Contractor may request the COR's permission to suspend watering to avoid too much water in the soil.

1.6.2. The Contractor shall present the method, frequencies, and dates of watering in a written schedule in the Grounds Maintenance Plan. The schedule shall consider the kinds of vegetation, local soil conditions, and the seasonal variations in plant moisture requirements.

1.6.3. The Government shall provide all hoses, portable sprinklers, and other similar irrigation equipment.

1.6.4. The Government shall furnish the supply of water and electricity.

1.7. FERTILIZER

1.7.1. The Contractor shall fertilize and lime the soil to promote proper health, growth, color, and appearance of cultivated vegetation, following proper horticultural practice for the types of vegetation, soil, weather conditions, and seasons of the year.

1.7.2. The Contractor shall present the method of application, fertilizer type, frequencies, and dates of fertilizing and liming in the Grounds Maintenance Plan. The fertilizer type shall be approved by the COR.

1.7.3. The Contractor shall provide fertilizer, equipment and tools to complete this task.

1.8. WEEDING

1.8.1. The Contractor shall weed out the grounds and gardens on a continuous basis to prevent the growth of weeds into lawns and landscapes. The Contractor may use weed-killing chemicals to prevent the growth of weeds to eliminate grass and weeds in the cracks and joints within or along sidewalks and curbs.

1.8.2. The Contractor shall obtain approval of the COR for all applications of weed killers.

1.9. PEST AND DISEASE CONTROL

1.9.1. The Contractor shall maintain a program for controlling pests and plant disease so as to maintain flowers, shrubs, vines, trees and other planted areas in a healthy and vigorous condition.

1.9.2. The Contractor shall obtain approval of the COR for all pesticides.

1.9.3. The Contractor shall present a plan for pest and disease control as a part of its Grounds Maintenance Plan.

1.10. HAZARDOUS AND TOXIC SUBSTANCES.

It is the Contractor's responsibility to ensure the safe handling, application, removal and environmentally sound disposal of all hazardous or potentially hazardous fertilizers, weed killers, and pest control products utilized in this contract.

2. WORKING HOURS. All work shall be performed during Sunday through Thursday, between the hours of 7:30 AM and 3:00 PM, except for the holidays. Other hours may be approved by the Contracting Officer's Representative. The Contractor must provide at least 24-hour advance notice to the COR who will consider any deviation from the hours identified above.

3. DELIVERABLES. The following items shall be delivered under this contract:

4. PERSONNEL REQUIREMENTS

4.1. GENERAL. The Contractor shall maintain discipline at the site and shall take all reasonable precautions to prevent any unlawful, riotous, or disorderly conduct by Contractor employees at the site. The Contractor shall preserve peace and protect persons and property on site. The Government reserves the right to direct the Contractor to remove an employee from the worksite for failure to comply with the standards of conduct. The Contractor shall immediately replace such an employee to maintain continuity of services at no additional costs to the Government.

4.2. STANDARD OF CONDUCT

4.2.1. Uniforms and Personal Equipment. The Contractor's employees shall wear clean, neat and complete uniforms when on duty. All employees shall wear uniforms approved by the Contracting Officer's Representative (COR).

4.2.2. Neglect of duties shall not be condoned. The Contractor shall enforce no sleeping while on duty, unreasonable delays, or failures to carry out assigned tasks, conducting personal affairs during duty hours and refusing to render assistance or cooperate in upholding the integrity of the worksite security.

4.2.3. Disorderly conduct, use of abusive or offensive language, quarreling, intimidation by words, actions, or fighting shall not be tolerated. Also included is participation in disruptive activities, which interfere with normal and efficient Government operations.

4.2.4. Intoxicants and Narcotics. The Contractor shall not allow its employees while on duty to possess, sell, consume, or be under the influence of intoxicants, drugs or substances that produce similar effects.

4.2.5. Criminal Actions. Contractor employees may be subject to criminal actions as allowed by law in certain circumstances. These include but are not limited to the following actions:

1) Falsification or unlawful concealment, removal, mutilation, or destruction of any official documents or records or concealment of material facts by willful omission from official documents or records.

2) Unauthorized use of Government property, theft, vandalism, or immoral conduct.

3) Unethical or improper use of official authority or credentials.

4) Security violations; or,

5) Organizing or participating in gambling in any form.

4.2.6. KEY CONTROL. The Contractor shall receive, secure, issue and account for any keys issued for access to buildings, offices, equipment, gates, etc., for the purposes of this contract. The Contractor shall not duplicate keys without the COR's approval. Where it is determined that the Contractor or its agents have duplicated a key without permission of the COR, the Contractor shall remove the individual(s) responsible from this contract. If the Contractor has lost any such keys, the Contractor shall immediately notify the COR. In either event, the Contractor shall reimburse the Government for the cost of rekeying that portion of the system.

4.3. NOTICE TO THE GOVERNMENT OF LABOR DISPUTES. The Contractor shall inform the COR of any actual or potential labor dispute that is delaying or threatening to delay the timely performance of this contract.

5. INSURANCE

The Contractor is required by FAR 52.228-5, "Insurance - Work on a Government Installation" to provide whatever insurance is legally necessary. The Contractor shall at its own expense provide and maintain during the entire performance period the following insurance amounts.

5.1. GENERAL LIABILITY (includes premises/operations, collapse hazard, products, completed operations, contractual, independent contractors, broad form property damage, personal injury):

General Liability:

5.2. The foregoing types and amounts of insurance are the minimums required. The Contractor shall obtain any other types of insurance required by local law or that are ordinarily or customarily obtained in the location of the work. The limit of such insurance shall be as provided by law or sufficient to meet normal and customary claims.

5.3. The Contractor agrees that the Government shall not be responsible for personal injuries or for damages to any property of the Contractor, its officers, agents, servants, and employees, or any other person, arising from an incident to the Contractor's performance of this contract. The Contractor shall hold harmless and indemnify the Government from any claims arising therefrom, except in the instance of gross negligence on the part of the Government.

5.4. The Contractor shall obtain adequate insurance for damage to, or theft of, materials and equipment in insurance coverage for loose transit to the site or in storage on or off the site.

5.5. The general liability policy required of the Contractor shall name "the United States of America, acting by and through the Department of State", as an additional insured with respect to operations performed under this contract.

5.6. The Contractor agrees that the Government shall not be responsible for personal injuries or for damages to:

• any property of the Contractor,

• its officers,

• agents,

• servants,

• employees, or

• any other person, arising from an incident to the Contractor's performance of this contract. The Contractor shall hold harmless and indemnify the Government from any and all claims arising, except in the instance of gross negligence on the part of the

Government.

5.7. The Contractor shall obtain adequate insurance for damage to, or theft of, materials and equipment in insurance coverage for loose transit to the site or in storage on or off the site.

5.8. Government as Additional Insured. The general liability policy required of the Contractor shall name "the United States of America, acting by and through the Department of State," as an additional insured with respect to operations performed under this contract.

5.9. Time for Submission of Evidence of Insurance. The Contractor shall provide evidence of the insurance required under this contract within ten (10) days after contract award. The Government may rescind or terminate the contract if the Contractor fails to timely submit insurance certificates identified above.

6. LAWFUL OPERATION, PERMITS AND REGULATIONS

6.1. Without additional expense to the Government, the Contractor shall comply with all laws, codes, ordinances, and regulations required to perform this work. If there is a conflict between the contract and requirements of local law, the Contractor shall promptly advise the Contracting Officer of the conflict and of the Contractor's proposed course of action for resolution by the Contracting Officer.

6.2. The Contractor shall comply with all local labor laws, regulations, customs and practices pertaining to labor, safety, and similar matters, unless they are inconsistent with the requirements of this contract.

6.3. Bonds. The Government imposes no bonding requirement on this contract. The Contractor shall provide any official bonds required, pay any fees or costs involved or related to the authorization for the equipping of any employees engaged in providing services specified under this contract if such bonds or payments are legally required by the local government or local practice.

6.4. Employee Salary Benefits. The Contractor shall be responsible for payment of all employees’ wages and benefits required by host country law or agreements with its employees. The Government, its agencies, agents, and employees shall not be part of any legal action or obligation regarding these benefits which may subsequently arise. Where local law requires bonuses, specific minimum wage levels, premium pay for holidays, payments for social security, pensions, sick or health benefits, severance payments, child care or any other benefit, the Contractor is responsible for payments of these costs and must include them in the fixed prices in this contract.

6.5. Permits. Without additional cost to the Government, the Contractor shall obtain all permits, licenses, and appointments required for the prosecution of work under this contract. The Contractor shall obtain these permits, licenses, and appointments in compliance with applicable host country laws. The Contractor shall provide evidence of possession or status of application for such permits, licenses, and appointments to the Contracting Officer with its offer.

Application, justification, fees, and certifications for any licenses required by the host government are entirely the responsibility of the Contractor.

7. TRANSITION PLAN. Within 15 days after contract award, the Contracting Officer may ask the Contractor to develop a plan for preparing the new Contractor to assume all responsibilities for gardening services. The plan shall establish the projected period for completion of all clearances of contractor personnel, and the projected start date for performance of all services required under this contract. The plan shall assign priority to the selection of all supervisors to be used under the contract.

8. QUALITY ASSURANCE AND SURVEILLANCE PLAN (QASP).

8.1. The QASP is designed to provide an effective surveillance method to promote effective contractor performance. The QASP provides a method for the Contracting Officer's Representative (COR) to monitor contractor performance, advise the Contractor of unsatisfactory performance, and notify the Contracting Officer of continued unsatisfactory performance. The Contractor, not the Government, is responsible for management and quality control to meet the terms of the contract. The role of the Government is to conduct quality assurance to ensure that contract standards are achieved.

Performance Objective PWS Para Performance Threshold Standard Services.

Performs all gardening services set forth in the performance work statement (PWS).

1 All required services are performed and no more than three (3) customer complaints are received per month.

8.2. SURVEILLANCE. The COR will receive and document all complaints from Government personnel regarding the services provided. If appropriate, the COR will send the complaints to the Contractor for corrective action.

8.3. STANDARD. Performance standards are provided in table 10.1. The COR shall notify the Contracting Officer of any complaints so that the Contracting Officer may take appropriate action to enforce the inspection clause (FAR 52.212-4, Contract Terms and Conditions- Commercial Items), if any of the services exceed the standard.

8.4. PROCEDURES.

8.4.1. If any Government personnel observe unacceptable services, either incomplete work or required services not being performed they should immediately contact the COR.

8.4.2. The COR will complete appropriate documentation to record the complaint.

8.4.3. The COR determines the complaint is invalid, the COR will advise the complainant. The COR will retain the annotated copy of the written complaint for his/her files.

8.4.4. If the COR determines the complaint is valid, the COR will inform the Contractor and give the Contractor additional time to correct the defect if additional time is available.

The COR shall determine how much time is reasonable.

8.4.5. The COR shall, as a minimum, orally notify the Contractor of any valid complaints.

8.4.6. If the Contractor disagrees with the complaint after investigation of the site and challenges the validity of the complaint, the Contractor will notify the COR. The COR will review the matter to determine the validity of the complaint.

8.4.7. The COR will consider complaints as resolved unless notified otherwise by the complainant.

8.4.8. Repeat customer complaints are not permitted for any services. If a repeat customer complaint is received for the same deficiency during the service period, the COR will contact the Contracting Officer for appropriate action under the Inspection clause.

CONTRACTOR FURNISHED PROPERTY

The Contractor shall provide all the below listed equipment, materials, tools, supplies and clothing, required to perform the standard services as specified in this contract. Such items include, but are not limited to, uniforms, personnel equipment, tools of trade, cleaning supplies, equipment and any other operational or administrative items required for the performance of the duties and requirements of this contract. The quantity indicated for each item is the required minimum. The Contractor shall maintain sufficient parts and spare equipment for all the below listed Contractor-furnished materials to ensure uninterrupted service.

(1) Uniforms. Minimum of five (5) t-shirts or shirts and one (1) pair of protective footwear per year. The Contractor shall not pass on the cost of the uniforms and footwear to the contract employees but should include it as part of their prices set forth in Section 1-The Schedule, Subsection 2.0-Pricing.

(2) Personal Protective Equipment (PPE). PPE must be always serviceable. Damaged or otherwise unserviceable items shall be replaced at no additional cost to the Government.
