IDENTIFICATION ACCESS CONTROL HARDWARE, SOFTWARE, INSTALLATION

AND MAINTENANCE SYSTEM AND ANNUAL MAINTENANCE

SECURITY SERVICES BACKGROUND

The United States Department of Education (Department), Office of Finance and Operations (OFO), Security Services administers the personnel, physical, information and continuity of operations of the Department’s Security Services Program. The Department provides Security Services for the above government-owned facilities and facilities leased from the U.S. General Services Administration (GSA) or private commercial property management companies.

Security Services has a requirement to ensure installation and maintenance of access control systems and equipment for identification of all individuals into all future facilities.

The Department has a continuous requirement for the installation and maintenance of security systems at its facilities that are fully compatible with the current existing infrastructure to ensure proper monitoring and access control in accordance with the following Federal laws, directives, and policies:

1. The Intelligence Reform and Terrorism Prevention Act of 2004 (IRTPA) addresses the problem of ongoing backlogs and timeliness delays in the process for background investigations and granting of security clearances. The purpose of the IRTPA is to reform the intelligence community and the intelligence and intelligence-related activities of the United States Government.

2. Homeland Security Presidential Directive 12: Policy for a Common Identification Standard for Federal Employees and Contractors (HSPD 12) requires all Federal agencies to complete background investigations prior to issuance of the HSPD 12/Personal Identity Verification Identification (PIV ID II) credentials to enhance security, increase Government efficiency, reduce identity fraud, and protect personal privacy by establishing a mandatory, Government-wide standard for secure and reliable forms of identification issued by the Federal Government to its employees and contractors (including contractor employees). HSPD 12 mandates a Federal standard for secure and reliable forms of identification.

3. National Security Presidential Directive-51/Homeland Security Presidential Directive-20 (NSPD-51/HSPD-20), National Continuity Policy emphasizes the importance of a comprehensive national program involving all government levels and the private sector for integrated and scalable continuity planning. NSPD-51/HSPD-20 prescribes continuity requirements for all executive departments and agencies, and provides continuity guidance for the states, territories, tribal and local governments, and private sector organizations.

4. National Continuity Policy Implementation Plan (NCPIP) directs Federal agencies to implement Continuity of Operations (COOP), Continuity of Government (COG) and continuing performance of National essential functions. COOP is an effort within organizations to ensure that Mission Essential Functions continue to be performed during

PAGE 7 OF 52 91990021R0030

a wide range of emergencies, including localized acts of nature, accidents, and technological or attack-related emergencies. The purpose of COG is a coordinated effort within each branch of government to ensure that national essential functions continue to be performed during a catastrophic emergency. It provides directive guidance to assist federal organizations in developing continuity plans and programs, to include the identification of Mission Essential Functions (MEFs) and Primary Mission Essential Functions (PMEFs), that support the eight National Essential Functions (NEFs)—the most critical functions necessary for leading and sustaining our Nation during a catastrophic emergency.

Federal Information Processing Standards 201 (FIPS PUB 201: Personal Identity Verification (PIV) of Federal Employees and Contractors) specifies the architecture and technical requirements for a common identification standard for Federal employees and contractor employees pursuant to the Federal Information Security Management Act (FISMA) of 2002. The overall goal is to achieve appropriate security assurance for multiple applications by efficiently verifying the claimed identity of individuals seeking physical access to Federally controlled Government facilities and electronic access to Government information systems to include the operability of US Access PIV cards.

The Department’s Physical Security and Law Enforcement Branch is responsible for the security and physical access for all Department facilities throughout the United States. The primary responsibilities of the Physical Security and Law Enforcement Branch are:

1. Building a Perimeter and Access Control Program to include:

a. Monitoring of office or parking access, public space and perimeter barriers, and intrusion detection systems

Processing Standards (FIPS) 201, policies for common identification verification and interoperability among agencies and departments for federal employees and contractors

d. Manage the Electronic badge access systems (building employee identification program)

e. Security Screening of Employee, Contractor, and Visitors personal package/bag screening, entrance and exit logs through sign-in sheets and by closed circuit television (CCTV).

2. Investigating administrative allegations of behavioral misconduct, assaults, or threats and incidents involving theft of government and personal property

3. Implementing procedures to safeguard life of personnel, property, and assets of the Department during an emergency in accordance with Occupant Emergency Plans (OEP) and Emergency Action Plans (EAP) describing the actions federal building occupants should take to ensure safety

4. Providing safety awareness training to ensure occupants are advised of emergency evacuation procedures and prepare safety bulletin notifications for Department

PAGE 8 OF 52 91990021R0030

management, employees, Contractors, and visitors to safeguard property and personal safety

5. Conducting inspections and risk assessment that include current security design criteria of all facilities and meets Federal standards. The Department of Homeland Security (DHS) Interagency Security Committee Standards (ISC) defines the security criteria of a facility.

BRAND NAME JUSTIFICATION

UNITED STATES DEPARTMENT OF EDUCATION

Office of the Chief Financial Officer Contracts and Acquisitions Management

BRAND NAME JUSTIFICATION

(a) This justification has been developed in accordance with Federal Acquisition Regulation (FAR) 13.501- Brand Name Justification.

BRIEF SUMMARY OF ACQUISITION:

The Department has a continuous requirement for the installation and maintenance of security systems at its facilities that are fully compatible with the current existing infrastructure to ensure proper monitoring and access control in accordance with Federal laws, directives, and policies. Security Services has a requirement to ensure installation and maintenance of access control systems and equipment for identification of all individuals into all future facilities.

ANALYSIS AND SUMMARY OF ACQUISITION PLANNING REVIEW:

The acquisition planning review consisted of key individuals with extensive historical and technical knowledge of the Department’s security infrastructure. The key individuals included the Contracting Officer Representative (COR), Contracts and Acquisitions Management (CAM) Contracting Officer (CO) and OFO program officials. These individuals collectively concluded that it is in the best interest of the Department to acquire the DSX, Inc solution because alternative products in the marketplace would be costly to effectively test and implement. For additional details regarding the associated costs.

How is the Department maximizing the effective use of competition and choosing the best contract type for this acquisition?

Market research shows that DSX, Inc is a commercially available solution that has been acquired by the Department in years past. The Department intends to solicit DSX, Inc product line resellers in accordance with the procedures in FAR Parts 12 and 13.

How is the Department mitigating risk when noncompetitive contracts are used?

The Department will mitigate risk by posting a Request for Quote (RFQ) on SAM.gov for the item to allow for market visibility and promote competition. The resulting solicitation will be competed amongst all authorized resellers, thus still providing competition. The brand name justification will be posted along with the RFQ. The Department’s alternative is to acquire a solution considered equivalent to DSX, Inc.

product line. This alternate solution has not been deemed as a viable one, as the risk of incompatibility with the Department’s current infrastructure increases. In 2014, the Department upgraded all DSX Proximity Readers/Smart Card readers with multi-technology readers in an effort to guard against system compromised of the older technology and to integrate into the current EDSTAR background tracking system. This upgrade not only protects the physical assets but also the information in partnership with

PAGE 23 OF 52 91990021R0030

OCIO. The Office of Finance and Operations (OFO), is recommending the DSX product line based on its reliability and the partnership with Silent Partner a certified vendor of DSX and to ensure the current integrated system stays intact. DSX meets the system criteria outlined in the SOW. Changing of either the DSX access control or the EDSTAR security management package would be cost prohibited as both systems would have to be redesigned and integration of the new system would cause an immediate re-compete of the total EDSTAR systems. EDSTAR is a conglomerate of three companies supporting four systems on one platform

How is the Department creating opportunities to transition to a lower risk contract?

The current need is for a brand-name solution. Until the business need no longer requires a brand-specific solution, this risk will remain. The Department remains committed to encouraging competition to the maximum extent possible.

CO DETERMINATION:

For the reasons explained and supported with a Brand Name Justification, the CO chooses a noncompetitive contract method. A justification for this brand name justification has been prepared and will be posted on FBO with the solicitation.

Noncompetitive contract:

In accordance with FAR 13.501, Special documentation requirements, the Contracting Officer will be awarding a task order utilizing a brand name justification. DSX, Inc. is the hardware and software manufacturers of the access control system that supports the Department’s HSPD-12/PIV critical mission system EDSTAR, which is the Homeland Security Presidential Directive (HSPD)-12 and Federal Information Processing Standards (FIPS) 201 requirements mandated by OMB. The DSX software technology provides visitor and card holder management within the system. Preventive maintenance helps identify vulnerabilities, fix problems and safeguard against major breakdowns and to extend to life of hardware.

PROGRAM OFFICE CERTIFICATION OF ACCURACY AND COMPETENESS

This is to certify that the portions of this justification developed by the undersigned program office personnel, including supporting documentation and data verifying the Government’s needs, schedule requirements and other rationale for other than full and open competition, are accurate and complete.

Contracting Officer Certification:

This is to certify that the data supporting this justification is the responsibility of the undersigned Contracting Officer, and that such data and rationale are accurate and complete.

The quote shall be written in enough detail so that a review panel can adequately judge its full merits.

Although the SOW spells out the objectives/ deliverables, it is up to the vendor to propose the most effective plan to meet these objectives. The vendor is encouraged to exercise independent judgment with respect to the best methods of attaining the objectives of this requirement.

The offeror's submission shall consist of three volumes: Volume I: Technical Quote, Volume II: Past Performance, and Volume III: Business Quote. All information necessary to judge the technical soundness and management capabilities of the offeror shall be contained in the technical quote. The technical quote shall NOT contain any reference to specific price or cost.

The business quote will contain all information related to the determination of the price associated with each of the courses.

The Department reserves the right to make awards without clarifications or discussions.

The technical quote shall illustrate the offeror’s approach for satisfying the requirements contained in this solicitation. The technical quote must be clear, coherent, and prepared in sufficient detail for effective evaluation of the offeror's quote against the technical evaluation criteria. It must disclose the offeror’s technical approach in sufficient detail to provide a clear and concise presentation that includes, but is not limited to, the requirements outlined below.

The technical quote shall be limited to a maximum of 10 single-spaced 8.5 x 11 inch pages using font size no smaller than 12 points, with margins no smaller than 1 inch on every side. 3. Abstract Summary The abstract summary should provide the quote’s contents in language understandable to an informed layperson. It shall highlight salient features of the quote including a description of the approach and plans toward satisfying the requirements of the SOW. (Does count towards page count)

4. Technical Approach The offeror’s technical approach provides sound and proven methodology for providing competency modeling and assessments that are of high quality, innovative and satisfy the Government’s needs.

Volume II- Past Performance

Vendors are instructed to describe no less than three (3) recent past performance examples that can provide insight into the declared past performance that must be relevant. At least one past performance must be for the Vendor (not a subcontractor) and demonstrate the ability to provide training of similar size, scope, and complexity as the SOW objectives. There is no limit on the number of past performance examples. Failure to provide at least three recent and relevant past performance examples will result in the solution being declared “Neutral” and the Department will not raise the issue during negotiations, if negotiations occur, as it will be reasonably assumed that the Vendor does not possess recent and relevant past performance. “Recent” is defined as any work that has been performed within the last 5-years from the date of this solicitation. “Relevant” is defined as work performed for a single customer that is all-inclusive and similar in size, scope and complexity to the scope in the SOW.

The Government also reserves the right to obtain past performance information from other sources including performance reports from the Past Performance Information Retrieval System (PPIRS) and Contractor Performance Assessment Reporting System (CPARS).

Volume III- Business Quote

Offerors shall submit a business quote that reflects the maintenance costs to fulfill the SOW. The Business Quote shall be submitted as a separate document from the Technical Quote, and will contain complete information in sufficient detail for the Government to make a fair and reasonable price determination. The Contracting Officer may reject a quote if a negative determination is made, or if proposed prices are found not to be reasonable.
