Limited-Sources Justification 91990021Q0007 procedures. The original order or BPA must not have been previously issued under sole-source or limited-sources procedures.”
The initial procurement was competed among all eligible SDVOSB multiple-award schedule vendors using FAR 8.405 procedures whereby Foxhole Technology, Inc was awarded the task order. Foxhole Technology, Inc is currently providing critical technical support services under task order EDCIO15O5018. The period of performance is scheduled to expire 23 March 2021.
Foxhole is supporting on-going projects, which could be negatively impacted by a service interruption. Having another vendor assume the services, without a comprehensive transition would create a loss of critical service and reduce operational capabilities.
The Department received a solicitation protest on the re-competition for this requirement. The protest, B-419577.1, is scheduled for a decision 20 May 2021.
It is cost-effective, efficient, and timely to maintain the current support for four months to allow the Department to conduct competition (including a protest decision), and smoothly transition to a new vendor.
5. BEST VALUE DETERMINATION
This order represents the best value consistent 8.404(d). The hourly pricing established by the Government under the GSA MAS contract has already been declared fair and reasonable. The Contracting Officer will review the level of effort and labor mix prior to award in accordance with 8.405-2 (d).
6. MARKET RESEARCH AMOUNG SCHEDULE HOLDERS
Market research was not conducted for this action as in the interest of economy and efficiency, the new work is a logical follow-on to an original Federal Supply Schedule order.
7. OTHER SUPPORTING FACTS
No other facts were used to support this Limited Sources Justification.
8. STATEMENT OF ACTION TO REMOVE BARRIERS
This task order allows time for competition (including protest resolution), and transition of services. Prior to the end of the task order, the Department will award a new task order on a competitive basis and transition the services.
