SECTION 7. STATE OF ILLINOIS PROVISIONS

IDOT Funding Assistance for Goods or Services (excluding construction) Buyer means the entity receiving the product or service.

Department means Illinois Department of Transportation (IDOT)

7.1 Prohibited Interest of Local Official

No member, or officer, or employee of the Buyer or local public body with financial interest or control in this contract during their tenure or for one year thereafter shall have any interest, direct or indirect, in this contract or the proceeds thereof.

7.2 State of Illinois Indemnification

The Contractor agrees to hold harmless and indemnify the State of Illinois, and its officials, employees, and agents, from any and all losses, expenses, damages (including loss of use), suits, demands and claims, and shall defend any suit or action, whether at law or in equity, based on any alleged injury or damage of any type arising from the actions or inactions of the Contractor and/or the Contractor’s employees, officials, agency, subcontractors, and shall pay all damages, judgments, costs, expenses, and fees, including attorney’s fees, incurred by State and its officials, employees and agents in connection therewith.

7.3 Unlawful Discrimination

Compliance with Nondiscrimination Laws. Contractor and contractors under subcontract made pursuant to this Agreement, shall comply with all applicable provisions of State and Federal laws and regulations pertaining to nondiscrimination, sexual harassment and equal employment opportunity including, but not limited to, the following laws and regulations and all subsequent amendments thereto: (a)The Illinois Human Rights Act (775 ILCS 5/1-101et seq.), including, without limitation, 44 Ill. Admin. Code Part 750, which is incorporated herein; (b) The Public Works Employment Discrimination Act (775 ILCS 10/1et seq.); (c) The United States Civil Rights Act of 1964 (as amended) (42 USC 2000a- and 2000h-6) . (See also guidelines to Federal Financial Assistance Recipients Regarding Title VI Prohibition Against National Origin Discrimination Affecting Limited English Proficient Persons [Federal Register: February 18, 2002 (Volume 67, Number 13, Pages 2671- 2685)]); (d) Section 504 of the Rehabilitation Act of 1973 (29 USC 794); (e) The Americans with Disabilities Act of 1990 (42 USC 12101 et seq.); and (f) The Age Discrimination Act (42 USC 6101et seq.).

7.4 Independence of IDOT or the State

Services performed pursuant to this Contract are not rendered as an employee of the Illinois Department of Transportation or the State of Illinois. Contractor agrees that it and none of its employees, agents, or subcontractors will hold themselves out as, or claim to be, agents, officers, or employees of IDOT or the State, and will not make any claim, demand or application to or for any rights or privilege applicable to any officer, agent, or employee of the State, including, but not limited to, rights and privileges concerning worker’s compensation and occupational diseases coverage, unemployment compensation benefits, Social Security coverage or retirement membership or credit.
