About this file
This is a Liquidated Damages Form issued by the Town of Palm Beach, Florida, establishing financial penalties for contractor non-performance on construction projects. The document acknowledges that the Town requires timely work completion, with time being of the essence, and recognizes the difficulty in calculating actual damages from project delays. The form stipulates that contractors and their surety bonds shall pay liquidated damages in daily amounts as specified in the attached Florida Department of Transportation schedule (paragraph 8-10) for each calendar day of delay beyond the scheduled completion date, including any approved time extensions granted through written change orders. If a contractor is terminated for default prior to project completion, liquidated damages continue to accrue and are charged against the contractor until the work is ultimately completed. The document requires authorized company representatives to sign and date a confirmation of understanding and compliance with these liquidated damages terms.
The specific liquidated damages rate schedule is referenced as the adopted Florida Department of Transportation schedule and is provided in an attachment to this form, though the exact daily rate is not specified within the document itself. The form serves as a standard contractual requirement for the Pinewalk Transfer Station Repairs project, valued at an Engineer's Opinion of Cost of $206,290, which involves structural repairs, concrete work, pavement restoration, ramp modifications, and drainage installation at the transfer station facility in Palm Beach.
