About this file

This is an insurance requirements document issued by the Colorado Department of Corrections for the Restorative Justice Program contract opportunity. The document establishes mandatory insurance coverage requirements that contractors and subcontractors must obtain and maintain throughout the contract term. Required coverage includes Workers' Compensation Insurance for employees; General Liability Insurance with minimum limits of $1,000,000 per occurrence and $1,000,000 general aggregate; Automobile Liability Insurance with $1,000,000 combined single limit per accident if vehicles are used; Protected Information Insurance with $1,000,000 per occurrence and $2,000,000 aggregate if access to confidential offender information is required; Professional Liability Insurance with $1,000,000 per occurrence and $2,000,000 aggregate for professional or technical services; and Crime Insurance including employee dishonesty coverage with $1,000,000 limits. Contractors must provide certificates of insurance within seven business days of the effective date, and evidence of insurance is required before contract issuance.

The document specifies that the State of Colorado must be named as an additional insured on all commercial general liability policies and that contractor coverage must be primary over any state insurance programs. All insurance policies must include 30-day cancellation notice provisions and subrogation waiver clauses. Public entities meeting the definition under the Colorado Governmental Immunity Act may maintain self-insurance in lieu of commercial policies. Contractors are advised to determine applicable coverage needs and obtain insurance quotes prior to bid submission, as coverage amounts may or may not be negotiable depending on services provided. Certificates should be submitted to doc_purchasing@state.co.us.
