About this file

This is a Certification of Noninvolvement in Prohibited Activities in Russia or Belarus form required by the State of New Jersey for vendors seeking to enter into or renew contracts with local contracting units under the Local Public Contracts Law. The certification applies to all vendors providing goods, services, or bonds to New Jersey local contracting units and requires vendors to verify their status on the Office of Foreign Assets Control (OFAC) Specially Designated Nationals and Blocked Persons list. Vendors must select one of three certification options: (A) certifying they are not identified on the OFAC list due to Russia or Belarus-related activity, (B) indicating they are unable to certify option A because they are identified on the list for such activity, or (C) certifying they are identified on the OFAC list but their Russia or Belarus-related activity is consistent with federal law, regulation, license, or exemption, with detailed explanation required. The form requires vendors to provide complete contact information including name, Federal Employer Identification Number (FEIN), address, phone number, fax number, and email address, along with an authorized representative's signature and date.

The certification is mandatory pursuant to N.J.S.A. 52:32-60.1 et seq. and N.J.S.A. 40A:11-2.2, with violations subject to enforcement action by the Department of the Treasury, including sanctions, debarment, suspension, or declaration of default. The definition of "Vendor" encompasses natural persons, corporations, partnerships, limited liability entities, governmental entities and their instrumentalities, and any parent, subsidiary, or entity under common ownership or control with such entities. Vendors are required to review the OFAC Specially Designated Nationals and Blocked Persons list available at https://sanctionssearch.ofac.treas.gov/ prior to completing and submitting the certification form with their contract bid or renewal request.
