About this file
This document is a Maintenance Bond template for the City of Fort Worth's 2026 Asphalt Resurfacing Contract 3, City Project No. 106175, located in Tarrant County, Texas. The bond serves as a guarantee that the contractor will remedy any defects in materials or workmanship for a two-year maintenance period following final acceptance of the work by the city. The related contract involves approximately 65,672 square yards of 2-inch asphalt pavement and surface milling, 26,450 square yards of 3-inch asphalt pavement and 11-inch pavement pulverization, 424 tons of Cemlime, and 42 barrier-free ADA ramps.
The maintenance bond requires both the principal contractor and a corporate surety authorized to do business in Texas to be jointly and severally liable for the bond amount, though the specific dollar amount is left blank in this template. The bond remains in effect for the entire two-year maintenance period and allows for successive recoveries for multiple breaches. If the contractor fails to repair defective work after receiving timely notice from the city, the city may hire others to perform the repairs with costs borne by the contractor and surety, and any legal disputes must be resolved in Tarrant County, Texas courts or the U.S. District Court for the Northern District of Texas, Fort Worth Division.
