About this file
This document contains questions and answers related to Solicitation Number 89243222RNE000025 for the Fabrication and Testing of a FORTIS 8-Axle Railcar. The solicitation seeks the testing and fabrication of a prototype FORTIS 8-Axle Railcar to conduct testing required by AAR S-2043 standards and receive approval from the AAR-EEC to operate on freight networks. The Department of Energy National Nuclear Security Administration will provide the pre-approved railcar design and documentation to support procurement of S-2043 certification. The selected contractor must fabricate a prototype railcar compliant with AAR standards, including S-2043, and is responsible for associated certification costs. Key deliverables include a prototype railcar capable of transporting one spent nuclear fuel cask. No changes will be made to the April 4th, 2022 response deadline.
Questions covered include clarification that the Department of Energy will provide all required system monitoring equipment for installation on test railcars, confirmation that provided equipment meets S-2043 requirements, and treatment of potential design changes and delays within the contract's 5 year and 6 month maximum period of performance. The document establishes processes for partial or full termination consistent with Federal Acquisition Regulation termination clauses should the project be cancelled after award.

Q&A AM 6 ‐ DOE Solicitation 89243222RNE000025 Amendment 6
Q&A Final - DOE Solicitation 89243222RNE000025 Amendment 6 Q # RFP Reference Page QUESTION ANSWER
6.1
Section C.3.4, (amendment 4)
1.Section C.3.4, page 17 of the solicitation (amendment 4) states: “Other GFE for the multiple-car testing includes two buffer railcars (one with IWS), an escort railcar and System Monitoring Equipment.” Please clarify if the DOE-supplied GFE includes sufficient System Monitoring Equipment (SME) to be installed on all four (4) railcars in the multiple car testing: two (2) buffer cars; one (1) Fortis cask car; and one (1) escort vehicle.
The System Monitoring Equipment (SME) is GFE. DOE will provide the SME to be installed on all four (4) railcars in the multiple car testing: two (2) buffer cars; one (1) Fortis cask car; and one (1) escort vehicle.
6.2 Section C.3.4, (amendment 4) Page 17
Regarding the same section referenced in question 1 above, please clarify whether the supplied SME is an existing design that has already been tested to meet the requirements of S-2043 paragraph 6.2, or whether it is a new design that has not yet been tested according to S-2043 paragraph 6.2
The SME has been designed and tested according to S-2043 requirements. However, separately, DOE is developing a new Safety and Security Monitoring Equipment (SSME) system that is expected to be available to be used on the Fortis railcar, but if there is a delay, then the existing SSME system could be used.
6.3
52.217-9 (Option to Extend Services) on page 61 of the RFP (amendment 4) states that the “total duration of this contract, including the exercise of any options under this clause, shall not exceed 5 years and 6 months”.
Several potential design issues have already been identified during this proposal process. Will schedule delays caused by the need for design revisions be an exception to this time limit?
If the Contractor and DOE both agree that design changes are needed, the schedule can be modified by mutual agreement.
DOE will base liability determinations and corrective actions upon root cause analyses. The contractor is obligated to mitigate its costs associated with rework, remanufacture, redesign, or other associated costs by alerting DOE of design flaws, inconsistencies, inaccuracies, or errors in a timely manner upon discovery of DOE-supplied design flaws, inconsistencies, inaccuracies, or errors. If DOE and the contractor agree that the DOE-supplied designs contain design flaws, inconsistencies, inaccuracies, or errors, DOE will limit its liability for the cost of rework, remanufacture, redesign, or any other costs to the amount necessary to remedy the defects. DOE will not assume liability for contractor’s failure to appropriately mitigate. This will be addressed in accordance with the changes clause.

6.4
52.217-9 (Option to Extend Services) on page 61 of the RFP (amendment 4) states that the “total duration of this contract, including the exercise of any options under this clause, shall not exceed 5 years and 6
If the answer to question 3 is no, how does the DOE envision developing and enforcing deadlines for design revisions that will facilitate the completion of the project within the 5 years and 6 months’ timeframe described in the RFP?
Refer to the response in 6.3
6.5
Should a decision be made by the Federal government to cancel this project following the award of this contract, please describe the DOE’s process for both partial and complete termination of any contract arising from this RFP.
Please reference the following clauses: FAR 52.249-2, FAR
52.249-6, FAR 52.249-8, 52.249-14.
6.6 In Section L-8 DOE-L-2013 on page 143 of amendment 5 of the RFP
The submission deadline has been changed from April 5, 2022 to April 4, 2022. However, this change was not redlined or called out elsewhere in Amendment 5 documentation. Please clarify whether the deadline for submissions is April 4, 2022 or April 5, 2022
See Ammendment #6
6.7
Due to the volume of additional information resulting from the Q&A and the outstanding questions posed above, we respectfully request an extension of the proposal submittal deadline to Tuesday, April 19, 2022.
At this time there will not be any further extensions to the due date.
